Regular meeting of the City Council of the pity of Rexburg, Madison County, f Idaho, was held Wednesday, Aug: 1~, 1970 at City Hall at 7;30 P.M, ~~ Mayor Henry Shirley present and presiding. ~? Councilmen present; Barton Jensen, Wendell Ritchie, Ruth Smith, Albert Pieper, Glenn Peterson, and Richard L. Davis. 1` Also present: City Clerk, Beulah Johnson and City Attorney, Mary Smith. RE: MINUTES Minutes of August 5, 1970 were read,corrected and motioned by Albert Piepe ~ Seconded by Ruth Smith that the minutes be passed. Motion carried i RE: DAVID MELENDEZ - PERMIT FOR PARKING TRAILER HOUSE ON 5th West. David Melendez met with the Council on his permit to park a trailer house on fifth West.. Explained the problem of zoning and his understanding that it {". was permissable. He had proceeded with all permits and construction. He was advised that Mary would draw up a petition and he would be able to take it too his surrounding neighbors in a 300 foot radius, asking for permissic ~n to park his trailer house on this lot for two years. If successful, per- . mission would be granted from council. RE: JOHN PARKINSON - DISCUSSED CITY IMPROVEMENT PROJECT John Parkinson met with the Council and discussed the City Improvement project Asking far his meter to be placed next to the curb, instead of in the side- walk, It was motioned by Barton Jensen that meters be installed next. to the curb on Center Street, when possible. Also that solid cement be placed from curb to sidewalks. Seconded by Dick Davis, uncarried. Wendell Ritchie reported he hasn't finished checking out business district yet for the change in the garbage pick-up charge. RE: OPEN BURNING Mayor Shirley read a letter from the State explaining the open burning, the banning of any burning where there wasn't a stack or chimney. RE: DOG POUND an Discussion on dog pound and Dr. Stegelmier having the pound in his jurisdic- tion. A firm proposal from him should be in soon. RE: PETLTIONS - MRS. CAROLYN THOMPSON ~ MRS. GARRET CASE Petitions were presented from Mrs. Carolyn Thompson and Mrs. Garret Case, along for permission to .conduct kindergartens. Motioned by Barton Jensen Seconded by Glenn Peterson that permission be granted, Those voting AYE Barton Jensen Wendell Ritchie Ruth Smith Albert Pieper Glenn Peterson Richard L. Davis Those voting NAY None 2E: STUDENT HOUSING PROBLEMS Discussion on student housing and the problems. City Attorney, Mary Smith was asked to inform Remco, builders of Cedar Apartments to comply with fence Ordinance. Also it was agreed that all student housing would be enforced to abide by this. tE: .WELCOME HOME GIFT FOR RETURNING SERVICEMEN Mayor Shirley,`ask for suggestions on the Welcome Home gift for all returning service men, and for some club to have to take over this project. The Soroptimist Club was suggested. Mayor Shirley said he would contact the President Mrs. Cara Newman and see if they would take this for a project this j~~ar. y; mith suggested possibly a belt buckle would be appropriate. ;E: HE DAMAGE st EAST WHERE STREET WAS WIDENED Tl- ~:~~.; was a discussion onhelping people repair the damage caused when tlae street on l.st East was widened. The Mayor informed him that we would give him a defin- ~ ite decision at the next regular council, September 3, 1970. ZE: DISPOSING OF ALL OLD EQUIPMENT BELONGING TO THE CITY Albert Pieper stated that he wanted to advertise and dispose of all the old equipment the city has. Also, Mrs. Vance Hendricks had ask that some type of school crossing be placed on East Main by Smith Park as this was a dancerous crossing. Mayor Shirley stated he would discuss this with Police Chief, Murray Ford. Mr. Pieper ask for permission to get a conventional truck for the street flusher, and the bids be let. 2E DRINKING FOUNTAINS ON MAIN STREET Ruth Smith moved that two drinking fountains be placed on Main Street, Seconded by Albert Pieper. Those voting AYE Barton Jensen Albert Pieper Ruth Smith Henry Shirley, Mayor Those voting NAY RE: BILLS Dick Davis Glenn Peterson Wendell Ritchie Bills in the amount of $28,442.42 were read. Motioned by Barton Jensen, seconded by Richard L. Davis that they be pa~:~d. The motion carried. Also present: City Attgrney, Mary Smith, City Clerk and Treasurer, Beulah Johnson, Lynn Williams, representing Rexburg Standard and Journal. ~'~ MINUTES. Minutes for August 19, 1970 were read and corrected. Motioned by Richard Davis, seconded by Albert Pieper that the ;minutes be passed. Motion carried. UILDING REPORT uilding permits with corresponding building value of $75,047 and $150.00 ermit fee charged for the month. ~tE: MR. AND MRS. GERALD BIRCH Mr. and Mrs, Gerald Birch met with the council, to discuss the dr~pwning, earlier this summer, of their son Darin. A letter fxom the Birch's attorneys Holden ~ Holden was read, which follows: Rexburg City Council Rexburg, Idaho Re: ~Dxowning Death of Darin Birch Gentlemen; We were contacted by Gerald and LaRae Birch shortly after the drowning
