Mayor Shirley instructed Mary Smith to write Mr. Thompson a letter informing him that 24 inch pipe was not acceptable'i and it would have to be replaced with a 36 inch line. R FLOYD BAGLEY AND CORDON THTCHER MET WITH THE COUNCIL_ WATER FOR 4th east Floyd Bagley and Gordon Thatcher met with the Council asking the City for adequate water for 4th East in the Sorenson addition, as Mr. Bagley .has new homes in that area. Dick Davis explained the possibilities, and will inves- tigate to see if they are feasible. KENT JOLLEY AND JIM HAMILTON - PROPOSED PROFESSIONAL OFFICE MALL Kent Jolley and Jim Hamilton presented a proposed professional office mall in Block l of the Rigby Addition, which would necessitate the rezoing of the area from A-1 to limited commercial, with restrictions placed on the type of building to be erected in the Mall. The Council expressed unofficial appro- val of this plan and agreed to hear further information on it in the near future. RE: BARYON JENSEN- DITCH FOR EDWARD HOOK Barton Jensen Moved that the City open the ditch for Edward Hoak, The motion failed for lack of second. RE: BILLS Bills were read for the amount of $35,096.15. Moved by Barton Jensen, Seconde by Glenn Peterson that the bills be paid. Council members present, Barton Jensen, Richard L. Davis, Albert Pieper,Glenn Peterson, Ruth Smith; absent, and excused Wendell Ritchie and City Attorney Mary Smith. Present also, Beulah Johnson, City Clerk ~ Treasurer, Don Ellis of KRXK and Mr. Bly from Rexburg Standard and Journal. RE-: LARRY PERKINS - THE UPCOMING PROJECT ON MAIN STREET. Larry Perkins from the City Engineers office met with the council and discuss-' ed the upcoming project on Main Street. Items discussed were sidewalks, `~ radius at intersections, storm sewer drains. RE": DEAN RICKS - OBJECTION OF SEWER ON 2nd NORTH - PERMISSION FOR LIMITED COMMER- CIAL ' Dean Ricks met and registered an objection for the sewer on 2nd North which ', was included in the LID #19. Stating he had already installed a full block ~r ~:~ by himself several years ago. After some discussion on the bena~'~~•~ :~~~~' the property, Mr. Ricks withdrew his abjection, and was tv secure are easement for installing sewer for the north of his property. Also. Mx. Ricks ask per-. mission to use his abondoned chicken-coops for limited commercial, for the construction of campers. The council advised him that permission would be given for two years. Renewable at that time. RE: LORIN KAUER-PRESIDENT OF REXBURG CANAL CO:BUILDING UP OF CANAL BANKS Lorin Kauer, President of Rexburg Canal Company, met with the council asking the city to build up the canal banks to avoid further damage and expense. Dick Davis is to investigate and take action to repair, Motioned by Barto Jensen. Seconded by Ruth Smith for Davis and Albert Pieper to take appro~ priate action. Jujimoto, Raymond Erikso~t, and Bob Beebe were using from the .Rexburg Canal t;:~~:uase the city couldn't provide enough with the city ditch, therefore they had been furnishing water for these people. Dick Davis moved that Barton Jensen check out and make arrangements with Mary. iRE: BUILDING REPORT Building permits with corresponding building value of $387,326and $39.50 permit fee charged for the month. Years totals are $712,016 and $924,50 RE: CENSUS REPORT COUNT .Preliminary census report count is 8,265. The official announcement of po ulation will be made later by the Director of Bureau of the Census, RE: AUDIT CON`T'RACT" Audit contract was presented. Mayor Shirley is to check with Merrill Rudd' be~~c•e a decision is made. RE: RESOLUTION: FEDERAL HOUSING RENT SUPPLEMENT FOR QUALIFIED PEOPLE. RESOLUTION N0. RESOLUTION APPROVING PARTICIPATION BY LOCAL HOUSING (~.~VNRS IN THE FEDERAL RENT SUPPLEMENT PROGRAM WHEREAS, und~-r ~ e pr 'ons of Section 101 of the Housing and Urban Develop- ment Act of 1965,'~the Sec tart' of Housing and Urban Development is auth- orized to enter into contracts to make rent supplement paymens to certain qualified housing owners on behalf of qualified low-income families who are elderly, handicapped, displ~~ed, victims of natural disaster, or occupants of substandard housing; and-.. WHEREAS, the provisions of said Section 101 cannot be made availabl ~: to housing owners in certain localities unless the governing body of the locality has by resolution given approval for such .participation in the Federal Rent Supplement Program. Ruth Smith is to investigate and make recommendations. RE: PROBLEMS DISCUSSED Skunk problem in the city was discussed Flusher bids were discussed The airport conditions were discussed. SIGNS - REMQVAL ON SOUTH 2ndEAST 39 ~I Barton Jensen motioned that several signs be removed from his street on Squth 2nd East. Failed for lack of second. ;E: SURVEY OF CITY STREETS Albert Pieper and Dick Davis are to make a survey of the city streets, to see which has. priority for the badly needed repairs, and for surfacing 1st North as an alternate route for main Street, when the work begins on Main Street Improvements, which are in LID #19. Also there was a discussion on installing the new street sign markers that were purchased last year. No decision. Discussion on the need of cleaning the city ditch.- tE: DON ELLIS - MICRO WAVE DISHES r°1 Don Ellis discussed micro wave- dishes and that he thought he could use his ~ .own property at the radio tower site for his building, for the station. s ~c FINAL READING OF ORDINANCE #.507 The Mayor requested City Attorney, Mary Smith, read for the third time the pro-. posed ordinance entitled "AN ORDINANCE GRANTING TO DON ELLIS, HIS HEIRS AND ASSIGNS, THE RIGHT AND PRIVILEGE TO CONSTRUCT, ERECT, OPERATE AND MAINTAIN OVER AND UNDER THE STREETS, ALLEYS AND PUBLIC WAYS OF THE CITY, POLES, TOWERS, WIRES, CABLES AND UNDERGROUND CONDUITS, AND TO CONDUCT AND OPERATE A COMMUNITY ANTENNA TELEVISION SYSTEM IN THE CITY OF REXBURG, IDAHO, AND PROVIDING THE TERMS, CONDITIONS AND REGULATIONS THEREOF." Which proposed ordinance was then read fully and .distinctly at length, Councilman Barton Jensen moved, seconded by Ruth Smith that said ordinance be placed upon its final passage. The Mayor ordered the roll call of the Council called, and the roll being called by the City Clerk, the vote upon the final passage of the ordinance was as follows: Those voting "AYE" Barton Jensen Richard L.
