REGULAR MEETING OF THE City Council of the City of Rexburg, Madison County,
Idaho, was held Wednesday, May. 20, 1970. at City Hall at 7:30 P.M, -
Mayor Henry Shirley was present and presided. Council members present were,
Albert Pieper, Wendell Ritchie, Ruth Smith, Dick Davis, Glenn Peterson, and
Dr. Barton Jensen. Also present were City Attorney Mary Smith, City. Clerk
$eulah Johnson, City Auditor, Merrill Rudd, and representatives from Rexburg
Standard $ Journal.
RE: MINUTES
Minutes of April 29, 1970 were read. Moved by Barton Jensen, seconded by
Dick Davis that minutes stand as read.

Minutes of May 6, 1970 were read. Moved by Ruth Smith, Seconded by Albert
Pieper, that minutes stand as read. The motion carried.
RE: TOM MATTHEWS TO ATTEND STATE ELECTRIC MEETING IN TWIN FALLS
Mayor Shirley ask for permission to have Tom Matthews, City Electric inspec-
for to attend State Electric meeting in Twin Falls, June 3rd and 4th.
Permission was granted. Also that Glen Bean would be taking Matthews
position as building inspector this fall.

TO THE REXBURG
JOHN MURFORD PRESENTED PETITION:Expressng disapproval for the
CITY COUNCIL:
WHEREAS THE City Council has been petitioned to rezone the following
described property from R2 to C1 Zone, Class 1 and that they permit profess-
ional offices to be constructed theron:
Commencing at the Southwest corner of Lot 4, Block 35, Original
Rexburg Tpwnsite, City of Rexburg, County of Madison, Idaho, as
per recorded plat thereof, and running thence East 5 rods; thence
North 144 feet; thence West 5 rods; thence South 144 feet, to the
place of beginning.
AND WHEREAS, the undersigned, are desirous of objecting to the granting
of such rezoning,
NOW, THEREFORE, the undersigned respectfully request that the City .
Council deny the application that said property be changed to Cl Zone,
Class 1, and deny the application for a permit to construct professional
offices thereon.
The undersigned further respectfully request that said property keep its
R2 classification.

RE: REZONING THE PROPERTY AT 154 N 4th E.
A Group of citizens, educators and family men met with the .Council and ex-
pressed their opinion of rezoning the property at 154 N. 4th E. They stet
that their desire being to zone this area residential for the benefit of the
new proposed high school.
RE: ORDINANCE 507 READ
Ordinance #507 was read, moved by Barton Jensen that it be placed on its .
third and final reading June 3, 1970. .,r
. 1969 AUDIT PRESENTED
Merrill Rudd presented the 1.969 Audit. Stating that he wanted~to change his
fee from a set contract of $1100.00 to $10.00 per hour for his services and
$4.50 per hour for his steno work, for 1970 Audit, service not to exceed
$1800.00
LID # 18 ~ 19 DISCUSSED

REPORT ON NEW STREET FLUSHER FOR CITY
Albert Pieper presented a report on a new street flusher for the City.
After considerable discussion, Ruth Smith moved we purchase a new truck to
mount the flusher on. Seconded~by Albert Pieper,

NEED FOR A 1iANll POWER MOWER IN SMITH PARK
Albert. Pieper told of the need for a hand power mower in Smith Park. It was
moved by Barton Jensen, Seconded by Ruth Smith, and the motion carried that
we purchase one.: Also Barton Jensen moved, the parks committee check the
beautification of the Main Streets, with the various clubs in town that have
expressed interest, as the work will start soon on Main Street.
DISCUSSION ON PURCHASING IN THE CITY AND ALL DEPARTMENTS.
There was a discussion on purchasing in the city and all departments.. Bar
ton Jensen-moved that all purchases be as follows:
$5.00 department head
.$5.00 to $100.00 department head and one councilman
All over $100.00 to go through the whole councih for approves
Seconded by Ruth Smith.

RE: rERTTLIZING BOTH CITY PARKS ~°'
Ruth Smith is to investigate fertilizing both City Perks, {

RE: RALPH THOMPSON USED 24 INCH PIPE IN PLACE OF 36 INCH.
Dick Davis reported that Ralph Thompson had used 24 inch pipe in place of
36 inch pipe that should have been used for the storm sewer on lots 1,2 $ 3
on Maple Drive in Powell Addition. Mayor Shirley instructed Mary Smith to
write Mr. Thompson a letter informing him that 24 inch pipe was not acceptable'.
and it would have to be replaced with a 36 inch line.
R FLOYD BAGLEY AND GORDON THTCHER MET WITH THE COUNCILS WATER FOR 4th east
Floyd Bagley and Gordon Thatcher met with the Council asking the City for
adequate water for 4th East in the Sorenson addition, as Mr. Bagley has new
homes in that area. Dick Davis explained the possibilities, and will. inves-
tigate to see if they are feasible.
KENT JOLLEY AND JIM HAMILTON - PROPOSED PROFESSIONAL OFFICE MALL
Kent Jolley and Jim Hamilton presented a proposed professional office mall
` in Block I of the Rigby Addition, which would necessitate the rezoing of the
area from A-1 to limited commercial, with restrictions placed on the type of
building to be erected in the Mall. The Council expressed unofficial appro-
va1 of this plan and agxeed to hear further information on it in the near
future.
RE: BARYON JENSEN- DITCH FOR EDWARD HOOK
' Barton Jensen Moved that the City open the ditch for Edward Hook, The motion ~~~
failed for lack of second.
RE: BILLS
Bills were read for the amount of $35,096.15. Moved by Barton Jensen, Seconde
by Glenn Peterson that the bills be paid.

Idaho, was held Wednesday, June 3, 1970 at City Hall at 7:30 P.M.
Mayor Henry Shirley present and presiding. Council members present, Barton
Jensen, Richard L. Davis, Albert Pieper,Glenn Peterson, Ruth Smith; absent,
and ..excused Wendell Ritchie and City Attorney Mary Smith. Present also,
Beulah Johnson, City Clerk ~ Treasurer, Don Ellis of KRXK and Mr. B1y from
Rexburg Standard and Journal.
RE: LARRY PERKINS - THE UPCOMING PROJECT ON MAIN STREET.
Larry Perkins from the City Engineers office met with the council and discuss-`
ed the upcoming project on Main Street. Items discussed were sidewalks, ~°
radius at intersections, storm sewer drains.
RE; DEAN RICKS - OBJECTION OF SEWER ON 2nd NORTH - PERMISSION FOR LIMITED COMMER-
CIAL
Dean Ricks met and registered an objection for the sewer on 2nd North which
was included in the LID #19. Stating he had already installed a full block
