Mayor Shirley then declared the motion carried. OFF S"TREET AND OVERNIGHT PARKING Discussion on off street parking and overnite parking, to be re-evaluated also parking problem at the Idamont Hotel. BLACK TOP FOR PARKING AREA AT THE AIRPORT It was moved by Albert Pieper, seconded by Ruth Smith that the city black top the main parking area at the airport this year, with the cost not to exceed $1500.00 Those voting AYE: Those voting NAY: BUILDING REPORT Barton Jensen Richard L. Years totals are $150,935.00 and $237. RE: GRAY CLAWSON - MONTHLY REPORT Gray Clawson presented his monthly report to the council. He stated the equipment that was needed at this time for him to operate the judges office. He also accepted $200.00 per month as his wage for the duties he performs. RE: BILLS Bills in the amount of $9,244.93 were read, moved by Albert Pieper, secon- ded by Dick Davis that they be paid, unanimously carried. RE: WTNL)hLL RITCHIE - TREES AT CITY DUMP Wendell Ritchie reported that several cotton wood trees had been disposed of by Barricks from Ross Covingtons, He was to take some steps to prevent. this. from happening again. Mayor Henry Shirley was present and presiding. Council members present were Richard L. Davis, Ruth Smith, Glenn Peterson, .Albert Pieper, Barton Jensen. Absent was Wendell Ritchie, Also present was City Attorney Mary Smith, City ~ Clerk and Treasurer Beulah Johnson and Mr.. Allred representing KRXK Radio. L Rexburg i."; 11 ~; , parking in that area. RE: MINUTES Minutes of April 1, 1970 were read. Moved by Richard L. Davis, Seconded by Albert Pieper that minutes stand as read. The motion caxried RE: PLANS FOR A PROPOSED THEATER BUILDING ON SOUTH CENTER Paul DeMourdant, Hugh Drennen, aim DeMourdant and Bill Kennedy presented plans for a proposed theater building on South Center, next to Barrett's Dress Shop. Their purpose in meeting with the Council was to obtain approval on their proposed solution to the parking requirement of the zon- ing ordinance. The requirement of the one parking space for every four seats would be met by utilization of the parking lot at Dee's Food Fair and at First Security Bank. Fifteen spaces would also be provided on their own property just north of the proposed theater at the present time, but these _ spaces might be replaced by a building later on, as other parking is dev- eloped. After some discussion, Barton Jensen moved that the city approve the proposed parking arrangement, providing copies of leases with Dee's Food Fair and First Security Bank are presented at the time of application with the City for a building permit. Seconded by Glenn Peterson and un- animously approved. Paul DeMourdant expressed his thanks for the time and consideration given them by the council and that in the future he would be happy to help provide additional parking in the back of this area for all the businesses. RE: LAWRENCE LYSTRUP F, DEAN NIELSON OF POCATELLO MET WITH THE COUNCIL Lawrence Lystrup and Dean Nielson of Pocatello presented plans for a new low income housing unit on First West and Second North streets. They re- quested the city to provide sewer line service to the project. It was. explained to them .that the city builds trunk lines, only and it is the responsibility of the builder to supply his own lateral line to the exis- ting city facilities regardless of distance. There is a sewer main avail- able on either First North or Center Street. Lystrup explained that the plans call for a $580,000 project, and city sewage facilities may be a factor governing. its feasibility in Rexburg. R BLAIR MANWARING PLANS FOR MELENDEZ HOUSING Blair Manwaring presented plot plans for the Melendez housing project west of the College Heating Plant on 3rd South and asked for a letter certifying that the city requirements have been met., Mayor Shirley ask Mary to write the letter after a motion by Albert Pieper, seconded by Glenn Peterson that approval be given when all requirements or compliance with the building code are met. The motion carried. RE: ALVIN MILLER - BUILDING PERMIT FOR MULTIPLE HOUSING The City Planning board reported that Alvin Miller had applied for a build- ing permit fox multiple housing, an apartment and motel with a swimming pool. The board recommended that the plans be accepted. It was moved by Glenn Peterson, seconded by Ruth Smith that Miller's Plans be accepted. The motion carried. LIGH'~IN~ AT 4TH SOUTH ANDIST WEST AREA Mayor Shir~le~y as~'~hat councilman Albert Pieper inspect lighting at 4th South and lst~ West area and report back on the conditions. 1~E BLAIR MANWARING - BOOKLET ON ORDINANCES ~ PROCEEDURES, LOCAL ARMY RESERVE .NEW POST OFFICE. Blair Manwaring discussed the-.need for a new booklet on the City Ordinances and proceedures to be published to have on hand for sale for interested parties. Mayor Shirley informed him that the city Clerk would be glad to ~ help him gather all the material needed so that this could be done in the very near future. Blair, being a member of the planning board and an Army Reservist, pointed out that the removal of the Local Army Reserve facility is being contemplated. He recommended that letters be written to the Idaho Representative in an attempt to-:keep the facility in Rexburg. He also recommended letters be written in an attemp to secure the building of a new host Office in Rexburg. RE: ZONING FOR AREA ADJACENT TO THE FUTURT:_. HIGH SCHOOL The request for the area adjacent to the future high school to be zoned commercial was rejected., ~.. '.E: GLENN PETERSON REPORTS - GAS TANKS ABOVE GROUND IN R-1 Glenn Peterson reported that there were gas tanks above ground in R-1 areas,'' and that this is against the gas ordinance governing the .City. He will investigate and report back. '.E: MAYOR SHIRLEY REPORTS - HORSES IN CITY LIMITS Mayor Shirley reported that several horses had recently been moved withi the city limits. Notice of violation had been made to the owner, who is making arrangements for their removal. The Mayor reiterated the City Ord -- ante prohibiting livestock, ;E: A DELEGATION OF CITIZENS FROM 5th WEST STREET A delegation of citizens from fifth West Street indicated that their st- reef is being used as a cutoff route between Highway 88 and l91 by many large. trucks. They feel that the proposed 50 foot street is too narrow and is a safety hazard. It was explained to them that a 50 foot street is wide enough if parallel parking is maintained and that this is all the city can provide at this time. tE: DICK SKIDMORE ASKING PERMISSION TO ADD ON TO PRESENT UNIT WEST OF COLLEGE FIELDHOUSE Dick Skidmore requested permission to add on to the unit he now owns in Block 9 just west of the College Field House, It was moved by Dick Davis seconded by Ruth Smith that we follow the Planning Boards recommendation and reject permission. The motion carried. tE: DON GROVER REQUESTING ZONE CHANGE ON MAIN STREET Don Grover requested a zone change for the lot just east of his residency: on Main Street. It was moved by Albert Pieper that we take necessary ste to change the zoning. Those voting AYE Richard L. Davis Ruth Smith Glenn Peterson Albert Pieper Barton Jensen Those voting NAY None .E: CHANGING OF SIGNS BY SCHOOLS It was motioned by Dick Davis, seconded by Ruth Smith that the City change the signs by the schools from 15 miles an hnur to 20 miles an hour. The motion uncarried. '.E: FILING CABINETS FOR POLICE DEPARTMENT Barton Jensen moved that we purchase two filing cabinets for the Police Department, seconded by Dick Davis. Uncarried. '.E: GENERAL PROBLEMS DISCUSSED Painting the fence at Park View was discussed. The Mayor said he would check the cost, etc. The Council agreed the Albert Pieper proceed to get specifications on the street flusher. Discussion on having a commercial cleaner clean some of our old existing sewer lines to prevent future clogging. E: POLICY TO FILL ABANDONED IRRIGATION DITCHES Dick Davis moved that the Gity adopt a Policy to fill abandoned irrigation ditches on city property, upon request and at the discxeation of the City. M yor /? ~-C~~ City Clerk MINUTES OF A SPECIAL CITY COUNCIL MEETING OF THE CITY OF REXBURG, IDAHO a~ RE; RE: A special meeting of the City Council of The City of Rexburg, Madison County, Idaho, was held on Wednesday April 29, 1970 at the City Ha11 at 7:30 P.M.. Mayor Henry Shirley present and presiding. Councilmembers present were Wendell Ritchie, Richard L. Davis, Albert Pieper, Ruth Smith, and Barton Jensen.. Absent and excused was Glenn Peterson. Also present were City Attorney Mary Smith, City Clerk ~, Treasurer Beulah Johnson and. City Engineer Clayter Forsgren. SEWER AGREEMENTS ON LID Sewer agreements on LID were discussed and returned from all councilmembers to the City Clerk for payment to the parties having refunds coming from the recent sewer installations. AIRPORT NEEDING GRAVEL Albert Pieper reported that the Airport needs some gravel from the city, that the county would haul it if the city would donate the gravel. EXTENDING SEWER ON NORTH HIGHWAY There was a discussion on extending the sewer for the area on North High- way „ as per a request in a recent petition. It was decided that this would delay the all over project on the city improvement program, andmake it to late for the work to be-done, also the petition they handed in was several weeks late. There were. several other possibilities that could be investigated to help the people of this area extend the sewer in the need- ed areas. BANK OF COMMERCE. SIDEWALK It was moved by Barton Jensen, seconded by Richard Davis that the Idaho Bank of Commerce be allowed to build their sidewalk on the west side three feet less .than the old original sidewalk.
