Don Ellis discussed his need for land for microwave dishes for his cable
telivision franchise, and also urged the council to give immediate atten-
ton to the ordinance permitting him to have the T. V. Franchise.
BILLS: Bills in the amount of $10,752.02 were read by Barton Jensen, it was
seconded by Dick Davis that they be paid. The motion carried.

A regular meeting of the City Council of the City. of Rexburg, Madison. County,
Idaho, was held on Wednesday, the 4th day of February, 1970, at the hour of
7:30 o'clock P.M. at the I~ity Hall, being the regular meeting place of said
Council, at which meeting there were present and answering roll call, the

"Mayor Shirley stated that Don Ellis of KRXK Radio Wanted the council to take
` definite steps on the cable T.V. Franchise. It was moved by Barton Jensen
and seconded by Albeit Pieper that the City pass an Ordinance awarding the
T.V. Cable Franchise to Don Ellis. The motion carried
Don Ellis also wished to ]-ease property north. of the present reservoir;
" after discussion on this, it was decided to have Dick Davis investigate the
possibility of acquiring ].arid for a new reservoir at a higher altitude and
trade the present land on it, and to have Don Ellis see if he could. lease

RE: GLEN HUNTER- REGARDING ZOA(ING OF LAND
Glen Hunter met with the Council regarding some land left him by David
Hunter his father, asking about zoning and building. He was referred to
the building inspector.

it would be permissable in this case, and although. Mr. Brown had signed the
easement, he ask that he be given sufficient time, until he had discussed
this with the prospective buyer. Mary Smith, City Attorney, suggested
that she contact Mr. Brown and have him take the prospective buyer up to
the City engineer and have him explain the probabilities. of this type of
building..

Councilman Albert Pieper introduced an ordinance entitled "An ordinance
concerning the creation of, improvements in, assessments against propert
in, and street improvement bonds for Local Improvement District No. 18 for
the purpose of improving and constructing certain streets and alleys,
constructing and installing sanitary sewer laterals, constructing and re-
constructing curbs, gutters and sidewalks and constructing drainage works
incidental to said improvements within said district; and providing
when this ordinance shall be in effect."
The motion was made by Councilman Glenn Peterson and seconded by Council-
~` man Ruth Smith,. that the rule requiring ordinances of a general and penman-

AN ORDINANCE CONCERNING THE CREATION OF, IMPROVEMENTS IN, ASSESSMENTS AGAIN-
ST PROPERTY IN, AND STREET IMPROVEMENT BONDS FOR LOCAL IMPROVEMENT DISTRICT
N0. 18, FOR THE PURPOSE OF TMPROVING AND CONSTRUCTING CERTAIN STREETS AND
ALLEYS, CONSTRUCTING AND TNSTALLTNG SANITARY SEWER LATERALS, CONSTRUCTING
AND RECONSTRUCTING CURBS, GUTTERS AND SIDEWALKS AND CONSTRUCTING DRAINAGE
WORKS INCIDENTAL TO SAID IMPROVEMENTS WITHIN .SAID DISTRICT: AND PROVIDING

tE: LETTER FROM THE STATE PLUMBING BOARD
Mr. D. LeRoy Armstrong,City Water ~ Sewer Superintendent read a letter
recieved by him from the State Plumbing Board, which follows:
Dear Mr. Armstrong;
A delegation of your local Rexburg contractors called on Mr.
Clarence Wilde, Chairman of The State Plumbing Board, last week,. '"~~
complaining of waht they claim to be irregularities in plumbing
installation and inspection practices in The City of Rexburg.
While they were advised that they should take their case directly
to The City we do want to call to your attention a couple of their
complaints and you can advise whether they are based on fact or ,~,ctt
The first complaint was that The City entered into an agreemen
with the general contractor on the new sewer system to insgall
service connections to a point within five feet of the house. We
are sure that you are aware that this is a violation of The State
Plumbing Code which requires that any plumbing installed on private
property must be installed by a licensed plumbing constractor or
the home owner doing his .own work.
The other complaint was that the plumbing being installed in
new buildings on The Ricks College campus was not being inspected
by you but by a representative of the owner. We feel certain that
this information must be incorrect as I know you are aware that all
plumbing within The {~;.ty of Rexburg must be inspected by you if
The City is to xet~n its exempt status under The State Plumbing Law.

re I will appreciate it very much"if at your convenience you will give me ,
a reply to these allegations so we may know what to tell these people. ~~"

After much discussion the .problem was turned over to Councilman Dick Davis
City Engineer, Clayter Forsgren, and Bud Armstrong,for investigation as to
what steps could be taken.
RE: LETTER FROM THE FIREMEN"S RETIREMENT
Dear Mrs. Johnson:
It has come to our attention that Mr. Silas P. Clements has not retired
as a full time paid fireman, of the City of Rexburg.
Mr. Clements' Termination Notice, signed by Mr. A. H, Brock, the for-
mer mayor o~ the City of Rexburg, advised that his termination date was May
15th,. 196 *. Clements' and Mayor Brock's signatures were notarized by
the City. .~i~~~urg's Attorney, Mary Smith, Notary Public of the State of
Idaho.
Idah~~;.Code, Section 72-1429 (B)---(Pension Payment-Voluntary Retirement
After Twenty Fire Years.-Any fireman with not less thah twenty five years'
active service as defined in Section 72-1402 (H) as a paid fireman as defined
in Section 72-1402 (A) within the state, ma at his o tion, retire, and in

72-1411 hereof.) This Code does not allow a retired fireman to work as a
full time paid fireman, in the State of Idaho and receive pension benefits.
Also, Idaho Code, Section 72-1427 provides for the presentation of false
claims.
~ Therefore, the Firemen's Retirement Fund is requesting Mr. Clements to
refund the pension payments for the period covering May 15th, 1969, thru
December 31st, 1969, in the amount of $1,912.05. Also, he owes Excise Tax.
for the same period, the amount of $229.50, with a like amount due from the
City of Rexburg, or a total of 2,371.05 is owing the Firemen's Retirement
Fund, for the last seven and one-half months of the year, 1969. We should
receive the above amount, in this office, at no later date than Maxch -2nd,
1970.
As of January 1st, 1970, we are looking forward to Mr. Clements making
all future Excise Tax payments in the usual manner. If you find you are in ~~
need of additional information, please feel free to communicate with this
office, at your convenience.

The building report was read. Total figures as follows:
Total Building value for the month is $17,000 Total permit fee for the

Judge Clark's Retirement was discussed, Mayor Shirley ~ Glenn Peterson are
to talk with him and see what fan be arranged.
RE: NELSON RICKS CREAMERY - WHAY'DUMPSNG
Wendell Ritchie is to check Nelson Ricks Creamery to see where they are
dumping their whay, as the alloted time for using the City Dump had expired
last month,
RE: COST FOR TRAFFIC LIGHT AT 2nd East
Glenn Peterson reported that the cost fox traffic light at 2nd East would
be close to $2000.00. He is to investigate further and see what lites we
have on hand, and the possibility of using them.

Ruth Smith reported on the miniture golf course and the f~.cilities that
C. V. Anderson used for concession stand was .for sale. After some discussion `y
it was decided it would be to the cities advantage to wait until spring and

MINUTES OF THE REGULAR CITY COUNCIL
MEETING OF THE CITY OF REXBURG, IDAHO
A regular meeting of the City Council of the City of Rexburg, Madison County,
Idaho, was held on Wednesday, the 18th day of February, 1970, at the City Hall
at 7:30 P.m.
Mayor Henry Shirley was present and presided. The following Councilmen were
present: Richard Davis, Albert Pieper, Barton Jensen and Wendell Ritchie.
Absent and excused: Ruth Smith, Glenn Peterson, and City Clerk, Beulah Johnson
The Mayor asked Mary Smith, City Attorney who was present, to take the minutes.
Mr. Alred from the Rexburg Standard-.Journal Newspapers was also present.
~E: NEW POLICE OFFICER
Jack Huber was sworn in as a new City Police Officer.
.E':' REPORT ON CITY PLANNING BOARD MEETING
Wendell Ritchie reported on the City Planning Board meeting. Among other
things, that H. Craig Burrell wanted to place a trailer on some property on
Second North, which was zoned R2. The Planning Board recommended that he be
perr~~itted to do so on a temporary basis, and that the permit must be renewed
every year.
'.E: THE 1970 PROPOSED SEWER AND STREET PROJECTS
The 1970 proposed sewer.,~and street projects were discussed. The Mayor called
a special meeting of the'(3ouncil with the City Engineer for Wednesday, Feb-
ruary 25, 1970, at 7:30 P.M. to consider these projects in greater detail.

Wendell Ritchie reported that the Police Car was being repaired. The matte r
was discussed. The Mayor reported that anew car had been ordered.
.E: NEW TRUCKS FOR THE STREET DEPARTMENT.
Albert Pieper brought up the matter of new trucks for the street department.
It was discussed. Also, he suggested that the Council consider the advisabi
ity of having purchase orders being submitted Icy city employees. The Mayor
stated that this was being cpnsidered and some system was being devised.
E: PURCHASE OF MINATURE GOLF COURSE
Mayor Shirley reported that Ruth Smith had received word from Lyle Thompson
that he would sell the City the Minature Golf Course at the City Park for.
$1,000.00, payable over a period of two years. Lt was moved by Barton Jensen
seconded by Richard Davis that the City Purchase the miniture Golf Course
and that the Mayor be authorized to enter into the necessary contract with Mr.
Thompson. The motion eaxried utinnimously. ,.
