Planning and Zoning Minutes
November 18, 2004
Attendance: Shawn Larsen -Mayor, Council members: Rex Erickson, Paul Pugmire, Donna Benfield,

Chairman Dyer opened up the meeting at 7:12pm

3. New business:
Preliminary Plat- The Riverwoods Townhomes: 04 00397
Brandon Jenks: My name is Brandon Jenks, I live on 1989 N 1100 E, Newdale, Idaho
First of all this is on Trejo St. just across from Les Schwab, you go past the dental center on the right off
to the side of the road and backed up to the school ground on the south end of the property.
- Similar building to Legacy Townhomes, we are just upgrading a little bigger and a little better.
- This Plat is just for the first 26 Units. The back ones we have to do some changes on the land to
make everything work.
- Trying to plat the front 26 first and what ever we do to the rear we're going to have to do in the
second phase. The way things are stated out there will be some common areas.
- There will be a homeowner's association on the project, so the homes will have a common water,
sewer, landscaping, snow removal, and of course an insurance policy on common areas.
- The whole front of the project will be green space, and if you look to the South side we have
parking along the back.
- There seem to be more than enough parking spaces as far as requirements go.
Chairman Dyer: Commissioners, questions for the applicant? One thing just so you understand, we are
disadvantaged in that we did not get this to review it ahead of time, so I don't know how far the action
will be able to go tonight under those circumstances.
Conflicts with the Preliminary Plat:
-Incomplete plat; the setback does not fit the requirement.
- Does not show utilities
Mary Haley: I would make a motion that we deny the approval of this preliminary plat as we do not have
• enough information.
Joseph Laird: I 2°d that.
Chairman Dyer: It has been seconded to deny approval of the plat based on insufficient information. Is
there further discussion of the motion? Mr. Stein.
David Stein: Mr. Chairman, request to table it.
Chairman Dyer: Certainly. That is a possibility. Mrs. Haley?
Mary Haley: I don't wish to change my vote. Based on the fact that we have ordinances and if we don't
have the information, it shouldn't have been started in the first place.
Chairman Dyer: You're seconding to her motion. So we still have a valid motion and a second on the
floor. Further discussion?
Ted Hill: I would be more in favor to table it, than deny it. The city has made some commitments
already, in issuing a building permit. Obviously there needs to be some work done on the plat. I would
rather see it tabled tonight.
Chairman Dyer: Any further discussion? What we could do, then is take a vote on it and see how that
stands. If it passes as a denial, then they can reapply. We will see it in the next meeting anyway, one way
• or another. Any further comment? Chair will call for the vote on the motion then those in favor signify
by saying Aye *Aye. Those opposed *aye.
Motion carries four to three.
City Council Discussion with Planning and Zoning on Comprehensive Plan
- Mayor Larsen conducted a discussion on creating a vision for both the School District and the
community, and Brigham Young University Idaho and the community. After a detailed discussion
with two members of the board attending the meeting (Lynn Wilcox and Brent Mendenhall)
Council member Paul Pugmire came up with this vision between the School District and the
community:
Schools are among those few facilities that both create and reflect a community.
Schools should be located to enhance development of community interactions. The city
and school district should work together, through existing transportation and
infrastructure systems and to share facilities to the benefit of the entire community.
(Achieving educational excellence will also be added into the vision).
- Many of the Council Members and the Planning and Zoning Commissioners feel it is very
difficult to receive public input.
- The school districts number one focus is environment that is best for educational benefits, then
the community.
• Group Discussion on the future school: (Building Inside of town vs. Outside of town)
Inside of Town

- School would have more of a neighborhood community atmosphere; it would separate instead of
- strengthen the community bond with the School District if built outside of town.

Outside of Town
- With all of the growth in Rexburg, in 15-20 years the school would be a part of the City.
- There is not enough space for a school inside City limits; need 50-60 acres.
Other points of discussion:
- It is important to understand the restrictions of both the School District and the City in order to
create a working relationship. An example of a working relationship was the school band using
the tabernacle for aconcert-sharing facilities. As new facilities are built, there is more
opportunity for the city and the school district to work together.
- The City, Commissioners and School District need to establish a sense of cooperation
among the community.
-Best place to build a school is residential.
- Plan to have school a closed campus.
Discussion on the Vision of Brigham Young University Idaho and the community:
- The University seems to be a community unto itself.
- Goal is to make the two entities one community.
- Our whole drive on downtown redevelopment is to bring the University and the city together.
- Paul Pugmire came up with this vision:
More than any entity or facility, Brigham Young University Idaho has made
Rexburg what it is today.. The city respects the University's need for self-
determination. We all recognize that what the University does has a great effect
on the surrounding community. Full coordination between the city and the
university is necessary in order to mutually strengthen each other and to integrate
well, all of the varied interests at full. In particular the city recognizes that the
issues associated with the area immediately surrounding the Unive~°sity requfre
the greatest amount of cooperation between the city and the University.
Mayor: I would like to move on quickly to discuss Section 7: Land Use on page 48. (Read part of the
section).
Discussion on Mixed Use Zone and Prozone: (Section 7: Land Use on Page 48)
Mixed Use Zone:
- Want to add the Mixed Use Zone under Commercial Land Use.
- The mixed use zone is the only zone where apartments can be constructed above commercial
areas; where you can integrate; where you take a commercial zone and you put residential into a
commercial zone.
- Puzpose of Mixed Use Zone: to try and densify housing to create market in and above
commercial districts which are not central business district.
- Another facet that we discussed is the idea to assign that to neighborhoods that are currently in
transition; and it is unknov~~n at the moment whether that neighborhood is going to stay strongly
residential or transition to commercial.
- Mixed use would not be allowed in Single Family Residential (R1 by the new definition). •
- Suggestion: Instead of having all residential zones available, it will be all except LDRl
- Mixed Use Zone is now called C'omtnercial Residential (residential into commercial).

Prozone:
t -Public considers it zone busting when the city creates the prozones. On the other hand, if a
neighborhood decides what's good for their neighborhood and they present it to the city for
approval, then it is acceptable.
Mayor Larsen reads through Rl R2 and mixed use zone on the comprehensive plan. Kurt clarifies that
neighborhood business district is included in Rl.
Discussion continues on R1, and R2.
Comprehensive Map: Two clerical errors were found. One where the professional plaza is-the entire
parking lot was designated as single family. The other is across the street where an area is supposed to be
green because it is residential. Steve Zollinger recommended that the corrections be made the next time
the map is amended.
Mayor Larsen: I think with that, and with some typing errors, is this document as you discussed this
evening, how would you like to proceed to move forward and accept this document? Would the planning
commission like to have a chance to review it, and send a recommendation to the council?
Chairman Dyer: The commissioners, if we have the time and the means, would really like to have a
;~ ~~ chance to get some input.
Mayor Larsen: We'll take your recommendation and look forward to having it complete.
Meeting with the City Council adjourned at 9:40pm.

5. Unfinished/Old Business:
A. Zoning Ordinance
Design Standards -Building under 25,OOOsq. ft.
Kurt Hibbert: We were assigned last commission meeting to have a subcommittee meeting with some of
the contractors. We have had a chance to talk to a couple of contractors informally. That meeting has not
taken place with the contractors and subcommittee to have them review those standards. As soon as I get
done with the zoning ordinance we plan on holding that meeting.
Mary Haley: Can we table permits or anything?
Kurt Hibbert: I'm not sure what we have in right now, under review. Mr. Hill, were you able to talk to
any contractors about helping us review that document, the design standards on buildings less than 25,000
square feet?
. Jerry Hastings: No. The secretary had a discussion with me tonight and she talked to a couple of
neighbors and she was. going to contact builders and invite them to participate in that meeting. What
about the proposed annexation?

~~ Kurt Hibbert: This is an issue we've got to work through. We have a petition for an annexation out on
` the East side of town that is not contiguous to the city right now. The burden has been put back on the
property owner to contact property owners to help make this parcel adjacent without the city having to go
out and do that.
Jerry Hastings: Where's that at?
Kurt Hibbert: On the East side, it's out on Barney Dairy road. Robert Huskinson's property. He has four
parcels on all sides. If he can have any one of those parcels, around him to petition, he would be
contiguous with the city. There's a lot of pressure for more homes, and as that builds, I think we will
need more business space to get that done.
Further discussion on the breliminarv plat decision at the be~innin~ of the meeting continues:
- The commission turned it down because it did not meet the ordinance requirements.
- They inquired the reason for the building permit issued and Kurt explained that they are allowed
to build anything they want on the property, but when they sell them off separately, everything has
to fit the ordinance requirements.
Chairman Dyer: Okay, the chair is going to regain control of this meeting here. Thank you for your
input; thank you all for your patience and understanding as we entered our concerns. Did you accomplish
what you needed to accomplish tonight Mr. Hibbert? I apologize that I had to leave for a minute or two.
So, you've done everything and we are then indeed ready to go?
Kurt Hibbert: Yes.
Chairman Dyer: Was there to be a discussion on annexation?
Kurt Hibbert: We did talk about that and we do have a petition that is noncontiguous right now. He is
working on getting that adjacent property owner which would then make it contiguous, and for your
information, would then go to city council who would make a decision then meet back here for review.
Chairman Dyer: Okay, you got what you needed for your design standards.
Kurt Hibbert: We have not had that meeting yet, Mr. Chairman; we need to do that with the contractors
and the subcommittee.
Chairman Dyer: Is there anything else that we need to bring up tonight?
