Kay APPROVAL OF MIN CJTES Minutes of November 21, 2002, will be approved on December 19, 2002. Winston Dyer -The following Commissioners were excused from the meeting: Ted Whyte, DaVawn Beattie, Doug Smith, and Mary Haley. Noncontroversial agenda items: Raymond Hill -Inquired on the process to change the Comprehensive Plan for the City of Rexburg. Raymond would like to change the block Located at the east end of Main Street on the South side of Main Street to residential from the current Commercial designation.. Kurt Hibbert -Indicated that the request could come lip the form of a letter. Discussion from the Commissioners concenling the current Comprehensive Plan and possible changes that could improve the planning process for the City. The new Historical Preservation Ordinance was reviewed as a tool to preserve structures of historical significance. Neighborhood Associations are welcomed and encouraged to provide input to the Commission on zoning issues for their neighborhoods. • ~~ • Medical Office Addition - Dr. Craig Heiner f~ Winston Dyer -Reviewed an approval for the Heiner site plan in 1988 for an office expansion. The Chair asked for a motion or debate on the request. The neighborhood association does not object. Steve McGary moved to approve the site plan as approved in 1988; Mike Ricks seconded the motion; all voted aye; none opposed. The motion carried. Public Hearin 7:10 pm City of Rexburg - :Rezone property between the RR Tracks and 295 North 1St East from (Light Industrial) to (Open Space) Winston Dyer opened the Public Hearing for the Zone change. There was discussion on the definition of Open Space Zoning. The discussion centered on removing Open Space Zoning for Public Facilities. Kurt Hibbert -Discussed the request from the City of Rexburg to change the property to an Open Space Zone. Those in favor of the rezone request: Kurt Hibbert represented the City of Rexburg in support of the change. s,, • Those neither for nor against the proposal: None given. Those against the proposal: None given. Winston closed the public testimony. Kurt Hibbert -Continued to review the location of the property on the overhead screen. There is one access off 2°d North near the; rail road tracks that is 99 feet wide. There was some discussing on adjoining properties. Jerry Hastings moved to approve the; zone change request and send it to City Council; David Stein seconded the motion to change the zoning to open space; all voted aye; none opposed. The motion carried. Request for a Conditional Use Permit - 342 South 4th East Gordon & Chantelle Madson Robert Schwartz moved to bring thi:> request back off the table; David Stein seconded the motion; all voted aye; none opposed. The motion carried. 2 i ~_ ~ Kurt Hibbert- Reviewed the proposal on the overhead screen. The Staff indicated that the home passed the health and safety review. Winston clarified that this request is to get approval for an existing use. They are seeking a permit from the City of Rexburg. The question is to whether to send this request to public hearing or to turn down the request. Mike Ricks moved to send this request to a Public Hearing; Jerry Hastings seconded the motion; all voted aye; none opposed. The motion carried. A Public Hearing will be scheduled at the next available meeting. Mike Ricks -Commented on the Chamber of Commerce sign being placed in the highway right of way. The Commissioners would like the Chamber to comply with the conditions set forth when the sign was approved by the Planning Commission June 26, 2002. Kurt was asked to have the sign relocated in the approved location. The Commission discussed the sale of used cars on private lots around town. Kurt Hibbert -Reviewed the neighborhood meetings scheduled for next week. The Widdison Addition and the Rexburg Acres Addition have one hour information meetings scheduled at City Hall. Discussion on the adoption of an. RR2 Zone before the annexation proposal. can be processed. Kurt recommended completing the Zoning Tables before the Comprehensive Plan is changed. He recommended changnlg the format of the Zoning Ordinance to be user friendly. This would be a significant rewrite of the Zoning Ordinance. Stephen Zollinger -Commented that the new language for the Zoning Ordinance would. have to contain the exact language before it can be adopted by the City Council by Ordinance. Discussion on the methodology for changing the Zoning Ordinance. The Commission is plamling to reform the current zoning ordinances. Craig Rindlisbacher -City/County GIS Manager - He has some background in planning. Craig reviewed the history of the planning process for Ricks College. Craig discussed the long range planning process. He commented on necessary processes for successful planning. Craig commented that "planning is messy" and "the process is more important than the product". He talked about the spin out process from a central plan. Many heads (people) are needed to create a plan. The planning principles can be sound but the opportunities will change. Craig said, "If the plan is in place we can implement them (opportunities). However, "If the opportunity appears and the plan has not addressed it; it is too late". Craig mentioned that the current Comprehensive Plan planning does not address growth for the North entrance to Rexburg. He reviewed the importance of relationships and schematics in the plan. They are the most critical components of the plan. Craig reviewed. the schematic plan for the University of Idaho. It says: "The core of the campus will be academic facilities and the peripheral functions go on the outside". This is not how the campus was originally configured. The plan ("This idea") moved facilities in that direction over time. The schematic says more about the relationship of the components of the plan than the actual plan. Craig commented that "those are the important elements of the plan". • He asked for the Planning Commission's comments concerning the relationship of the City of ` Rexburg's transportation plan and the University. Craig asked: "What is the relationship between commercial and housing?" Craig's final comment to the Commission was to focus on the plan. Craig indicated that the Commission should focus on the components of the plan and the map will follow the plan.. Discussion on the Comprehensive Plan being a binding document for the Community. Amendments can be made every six months. Craig indicated that the Comprehensive Plan is a dynamic document and zoning is a tool to achieve the goal of the Comprehensive Plan. Winston Dyer -The checks and balances for the City is that the zoning must meet the Comprehensive Plan. Kurt Hibbert -Discussion on the Zoning Districts proposed for amending Zoning Ordinance 725. Kurt reviewed the proposed Zones that will be added or modified. The following Zones were reviewed: Rural Residential One, Rural Residential Two, Medium Density Residential Two, General Business District, Motor Business District, Neighborhood Business District, Community Shopping Center, and a Regional Shopping Center, Light Industrial, Heavy Industrial, Professional Office Overlay, Urban Mixed Use Overlay, Professional Office, Research, Technology and Office, and Transitional Agricultural. Winston Dyer -Reviewed MDR2 in the handout. Kurt Hibbert -Reviewed Chapter 10 of the Zoning Ordinance. He reviewed the cross section of the ;~~• planned road layout without curb and gutter. The sidewalk would be required by Ordinance. John Millar -Reviewed the minimum of 2 acres needed to have an RR2 zone to prevent spot RR2 zones. Animals and Animal rights need to be discussed for RR2 zoning. Kurt Hibbert -Reviewed legal use of animals in RR2 and the State Statute covering Animals. Winston Dyer -Reviewed the 2 acre minimum. John thought it should be at least a 5 acre minimum for RR2 zoning. Discussion the minimum lot widths that are addressed in the table. Jerry Hastings -Suggested 120 foot lot line for RR2 with a minimum of 5 acres per development. Discussion on net acre verses gross acre. Net acre does not include right of way. It was recommended to have a minimum of two units per net acre. Winston Dyer -Commented on current parking violations where cars that are being parked on lawns. Kurt Hibbert -Reviewed the proposed new zones to the Commission. Kurt will complete the recommended additions and changes to the Zoning Ordinance for Commission approval. Winston Dyer -Reviewed the proposed locations of the new zones in the community with the Commission. 4 ` • David Stein -Questioned the need for HBD under the new plan. . Discussion on the plan presented by Craig and using that process for the City's planning approach. Winston Dyer -Question how existing uses would work into the new model. Jerry Hastings -The next step would be to review the permitted uses in each of the zones in the handout. Winston Dyer -Reviewed the process of modifying the table. All the Conditions and Provision would be addressed. Regulation Table 31 should be dropped. Jerry Hastings would like some section numbers in the document. Winston Dyer -Asked to review the neighborhood business district. Kurt reviewed Provo's description of a neighborhood business district. Business hours for a neighborhood. business was discussed. Jerry Hastings - He wouid iike neighborhood business zones io nt into the neighborhood. A residential landscape would be preferable. Winston Dyer - As we have broken the components of the plan down, it would be good to match the new or existing zones with the Comprehensive Plan. Kurt Hibbert -Discussed the Community and Regional Shopping Center Zones. Winston Dyer -Requested the addition of a transportation component. Kurt reviewed the (SCZ) zone • and the language that covers transportation for the zone. Kurt Hibbert -Continued the review of the handout on the proposed zoning changes for Chapter 3 of the Zoning Ordinance 725. Winston. Dyer -There are areas that need to reviewed for appropriate uses with the proper buffering. Winston Dyer -Discussed Vertical and. Horizontal Zoning. Mixed Use Zoning was discussed with a handout from Kurt for the City of Orem in their State Street. Steve McGary -Would like to see the horizontal aspect of zoning included into the amended Ordinance. Discussion on how to include horizontal zoning into the Ordinance. David Stein -This is an overlay plan with conditional uses. It would allow for horizontal growth. Kurt Hibbert -Reviewed the development of standards that maybe included in the new zones. A Professional Office Zone would create a buffer for adjacent residential neighborhoods. Research, Technology and Office Zone (RTO) Companies would like to use areas near the r1 LJ -• University for this Zone. Kurt indicated the possibility of University dependent companies being ~ drawn to this zone. Discussion on the location of an RTO zone that would be adjacent to the University. Winston Dyer -Said it would be a useful tool with an unseen application. Transitional Agricultural One, was reviewed. The Commission discussed the number of animals allowed in that zone. Discussion on the Grover property. Dean and Lois Grover would like to have a Transitional Agricultural zone designation. The Commission recommended a minimum of 2 livestock per acre with a maximum of l O livestock. They recommended striking the feed lot description and adding a minimum size of two acres. Winston Dyer asked the Commissioners if they were agreeable with the Document that Kurt presented. The Commission agreed with the direction the City of Rexburg is heading with the zoning additions arld iLlllerldlllerl tJ. New Business: Comprehensive Plan -Planning and Zoning Commission Winston asked the public for input on the Comprehensive Plan. (• Winston Dyer -Recommended having an open zone around Public Facilities for expansion. Discussion on the creation of a Neighborhood association -Pending request to rezone an area from LDRI to LDR. There is a neighborhood association near the University that would like a zone change from LDRI to LDR. The single family planning designation. needs to be broken down into smaller units. There was discussion on the need to have westenl and southern expansion for residential developments. Mike Ricks joined the meeting. Continued discussion on the maintenance of the low residential density. Discussion on protecting low density areas of the City. Discussion on clearly defining the Comprehensive Plan to protect LDR. Discussion on the Sherwood Hills neighborhood protective covenants prohibiting apartments. The Commission is not familiar with the protective covenants for Sherwood Hills. Jerry Hastings -Asked about the Restrictive Covenants for Sherwood Hills. He indicated that the neighbors must police the protective covenants for the development. The covenants in Sherwood Hills reflect LDR1. 6 Val Christensen -Asked for input on how the Comprehensive Plan was designed. . Winston Dyer -Reviewed concept of keeping the Comprehensive Plan broad and general to avoid spot zoning. Val Christensen - Expressed a need for some definition to the Comprehensive Plan. Robert Schwartz -Discussed the transition of a neighborhood by allowed use with current zoning. Val Christensen - Made a comment that 90 percent of his neighborhood of Sherwood Hills would like to be rezoned to LDR. Winston Dyer -MDR has been favored to encourage housing for the University. The Commission wants to take a proactive approach to protect the neighborhoods. Steve Oakey -Commented on the recapture process for old neighborhoods. He mentioned other City's of marts to recap ure oidei• neighborhoods. He requested a historical preservation view on the Comprehensive Plan. Kurt Hibbert -Indicated that the Historical Sites in the City of Rexburg should be identified and protected in the Comprehensive Plan. Winston Dyer -Reviewed the concept of down zoning in one neighborhood would cause more pressure on older neighborhoods. . Steve Oakey -Provided an example of an older neighborhood that is being brought up with the long term goal to build larger developments in that neighborhood. Discussion on additional neighborhoods that would prefer to have an LDR zone. Mike Ricks -The apartments will be forced on neighborhoods (Localized Dense locations or spread the density) for the long term effect. Mike would prefer to have flexibility in the development of property. He is hesitant to Micromanage individual properties. Val Christensen -Commented on the options neighborhoods have to change or stay the same based on the desires of the neighborhood. Discussion on the need for Design Standards in the amended Zoning Ordinance. Jerry Hastings -Recommended. using SIC codes to identify Commercial Businesses. Kurt Hibbert -Discussed the City of Orem's Ordinance for `accessory apartments'. Orem is not allowing accessory apartments without paying for an extra connection for water and sewer. Jerry Hastings -Requested the Commission resolve some immediate concerns by modifying the Zoning 7 • rules. The Commission needs to demonstrate fairness. ~/~ The Commission is concerned with the Zoning Ordinance allowing afour-plea in the back yard of a residential home. Robert Schwartz - Reviewed a neighborhood change in his neighborhood that moved from a proposed Professional Office project t:o the colistruction of a Hospital parking lot: Robert would-have preferred the Professional Office project which would have less night lighting. The Commissioners would like the Comprehensive Plan to be the gate keeper. This would help with the growth problems the City is currently experiencing. Jordan Dyer -Instructed the Planning Commission to place a few items on the table and address them. "Just Do It". Jordan indicated that it is easy to say what we don't like, however we need to have a plan and do it. Examples will include driveway widths, accessibility, percent lot coverage, snow removal will have to be realistic, and parking lots. Winston -Requested the Commissioners bring their top three issues to the next meeting. The next meeting will be a work meeting. It is proposed for the 19`~ of December. ~\ • Robert Hastings moved to send RR2 Zone to City Council as discussed; Steve McGary seconded the motion; all voted aye; none opposed. The motion carried. Steve McGary moved to have the 19'x' of December as a work meeting for the Comprehensive Plan and to have the Commissioners' give reports on their recommended planning for the future of Rexburg.
