Kay Winston Dyer welcomed the public to the meeting. Approval of the Minutes: DaVawn Beattie made a motion to approve the minutes far July 18, 2002 with a spelling correction for Paul Lafoliette. Steve McGary seconded the motion, all voted aye, none opposed. The motion carried. Noncontroversial Items added to the agenda Winston Dyer announced that Commissioner Glenn Walker resigned his Planning and Zoning position with a letter of resignation. Winston thanked Glenn far his service and said his great input will be missed by the P&Z Commission. A replacement candidate will be sought from the City Impact Zone. The Chair exercised Executive Privilege and read a statement concerning BYU-Idaho's announcement to begin building 156 units of married student housing. The statement is on file with the minutes. Kiii~ reviewed the Conditional Use Permit request that was not addressed at the July 10, 2002 P&Z meeting. The Commission discussed the site plan request at that meeting. The request for a three unit site plan was approved with conditions outlined in the July I0, 2002 meeting as follows: 1) Require a hard surface with drainage approved by City Staff 2) Adequate lighting from Wall pack lighting (Bank Lighting) for the parking areas 3) Abandon the 4~' west access to the units 4) Provide access from 2°a south as the primary access to the units n LJ C. • Discussion on the applicants need to meet conditions on page 53 of the Planning and Zoning Ordinance Book. Maly Haley - Requested information on the plan for parking and where the parking staiis would be piaced on the property. Mary was concerned with the number of parking stall that would be required for 24 students. Blake reviewed his plans for the location of the parking stalls and additional pavement. Slake Loveland -Indicated that he does not have a site plan. The Commission debated delaying a decision until a site plan could be made available. Stephen Zollinger -The required parking is one parking stall per student and two parking stalls for managers. The existing parking is grandfathered by prior use for students. Discussion on the parking issues and the number of stalls. Stephen Zollinger -Reviewed the location that parking would be allowed. Current parking stalls will be allowed, however additional parking stalls will require staff approval per the City Ordinance. Jacob Fullmer withdrew his motion after the discussion on Staff approving the site plan for parking. Winston Dyer -The floor was opened for additional comments from the Commission. Ted Whyte -Discussed the options available to the Commission concerning parking approvals. Winston Dyer -The Commission is concerned with the end result of this proposal. Discussion on the geographic constraints that will be placed on the number of parking stalls allowed. Parking can only be placed on one side or the other of the back lot. There may be up to 18 stalls allowed by Ordinance. • Winston Dyer -Clarification of the Conditional Use Permit conditions that can be allowed. Stephen Zollinger -Reviewed the HUR and MDR property in the area. Doug Smith made a motion to grant a. Conditional Use Permit with the following conditions: 1) Parking must meet City Ordinances __ 2) Maintain the existing fence as a buffer and conference wi*h the neighbors concerning additional buffering if needed 3} Comply with all other City Ordinances that apply to the Permit Discussion on the consultations needed with the neighbors to the North. This request is for HDR zoning on the back part of the lot. Randy Webb - 2526 Mesa ,Idaho Falls, Idaho -Reviewed the request on the overhead screen. They are planning to add 3 more 4-plexes. They are planning additional fencing to buffer the Larsen property. Discussed the proposal and the occupancy -They are planning to have MDR at the side of the Larsen's home and I-~DR at t`he back of his home. They plan to add +hree triplexes wi*,h HDR and buffer with landscaping. • Mary Haley - Reviewed the recent history of this property, The property was recently changed to MDR. Spencer reviewed other buffered properties in the City. He requested that this property remain MDR to help buffer his property. Traffic will increase substantially with this new development. He is opposed to changing the properly to HDR. Ferron Sonderegger - 1627 West 190 South - He is located a half mile north of Spencer in the new Impact Area. He has the same concerns that Spencer has with this development. He discussed other resident's concerns with HDR zoning in only one area ofthe City. He would prefer spreading out the grvVJtci. Russ Van Allen - 932 South 1560 West -Reviewed his location on the overhead screen. He is opposed to allowing HDR next to the Larsens. Paula Sonderegger - 1627 West 190 South -She is concerned with the additional traffic that will impact the area. There are only two ways to exit their location. They can hardly tum and go west when they get off the highway. That is too much traffic for the area. She is opposed to HDR zoning. The public testimony was closed. Mike Ricks- - Reviewed the recent zone change to MDR for this location. Mike does not see a need to change the zoning. Discussion on the proposal to change the zoning from MDR to HDR. The Commissioners indicated the need to follow the zoning laws. _ Mike Ricks made a motion to deny the request for a zone change from MDR to HDR, Steve McGary Seconded tl~e mouor,, Discussion - Aii voted aye; none opposed. Mr. Webb will not change the site plan after the HDR request was denied. Randy Webb -Reviewed the site plan and discussed two fire hydrants for the development. Discussion of buffering the canal wiuh a fence on the North side. Randy said they are going to put fencing aro,,,,d the whole property. Chain Link with slats will buffer the Larsen's property and chain link around the rest of the property. . DaVawn Beattie made a motion to approve the site plan requiring compliance with City Ordinances and with iighnng at the entrances. Kurt Hibbert - Reviewed the site on the overhead screen. The Fire Department has approved the site plan. Storm drainage, landscaping, and parking were reviewed. Discussion on the surrounding boarder areas and weed control. Snow storage and implement parking were reviewed. They are planning on an elevated display area with Arizona landscaping of mostly gravel. Drainage for the development was reviewed with water flow going to the North or to the South before a westerly drainage to a detention pond one to two feet deep. Curb, gutter and sidewalk will be extended on the West side of the property. Sewer and water lines were reviewed. The location is facing airport road. Marv Lowenberg - 5666 North Yellowstone, Idaho Falls, Idaho - Discussed a Highway sign similar to the American Falls store that they plan to have in Rexburg. The sign would be 12 feet by I6 feet and consistent with the Rexburg Sign Ordinance. Mike Ricks - Re~~ewed the road widths around the building. The roads are 30 feet wide. Discussion on the elevation of the building and the additional gravel needed to come up to grade with the road. Winston Dyer -They plan to build up the site with gravel for the building. Mary Haley -Discussed grease traps for the building. Winston reviewed the plans for outside drainage and the gravel bottom detention pond. This pond does allow for filtration before the water enters the ground water supply, A fixed storm drainage system discharges directly to a river or stream. Doug Smith -Desired additional trees and green area consistent with the neighbors landscaping. DaVawn Beattie -Requested additional information on the plan for green area around the building and display areas. Winston Dyer -Reviewed the site plans for green area and a sidewalk that would join the Erickson property to the So»th. Ted Whyte - He is concerned with the landscaping that maybe displayed on this site. Further discussion on the presentation of the property as seen by the traffic on Highway 20. Mary Haley -Concerned with the first: impression of Rexburg as presented by this property. Ted Whyte - Requested a green strip buffer along the property. Ted Whyte made a motion to approve the site plan for Pioneer Equipment with the following conditions: • E 1) A 15 foot grass area with sprinklers behind the sidewalk on the Airport Road 2) Adjacent to the access ramp on Highway 20, provide a IS foot green grass area with low landscaping watered by a sprinkler system 3} Trees every 50 feet or 6 trees with a minimum tree size of 1.5 inch calipers. 4) Consistent with Ericksons landscaping and watered with a sprinkler system Jacob Fullmer seconded the motion. Site Plan Review - 347 S. 4t'` W. -Rick Wadholm Kurt Hibbert - Reviewed the site plan and the City Staff requested a corrected plan for this meeting. The new site plan has been reviewed by the Fire Department. Staff is resolving some concerns with the developer. Winston Dyer - Storn drains are regulated by the Idaha Department of Enviornmental Quality. There is a permitting process with fees. Size and depth are controlled by this permit process. John Millar -Has some new techniques for storm drainage installations. The Fire Department has requested a new design for the fire lane to provide an additional exit. That makes a total of 13 twelve plexes or 156 units. Kurt Rowland is working on the fire lane design, to comply with the Fire Departments concerns. Discussion on the loss of parking stalls with the new fire lane requirements. Parking will be modified to use some of the garbage pickup area which has been streamlined. Dave Montgomery -The site plan is being rushed through the approval process to be ready for construction when the financing is approved in two to three weeks. Completion of phase one is planned for December, 2002 and completion of phase two is August, 2003. The four 1 acre apartment sites wiL1 be ready in August of 2003. The site plan check list was reviewed with concerns about the type of landscaping ghat would be placed on the property. The motion carried. Winston Dyer - Reviewed the need for the Commissioners to take extra precaution when working with Planning and Zoning Commission matters. The discussions need to remain open and availa'ole to the public. The Commission must follow the correct protocol to avoid any public concerns of impropriety. This will protect the Community, Commissioners and the City's interests. Annexation & Zoning assignment far the new annexation Lamoreaux - Muhlestein Kurt Hibbert -Reviewed the site on the overhead screen. The new impact zone includes this project. The New Idaho Code prohibits annexing any property outside the Impact Zone. The Public Works department is working with the developers to obtain City services. This effort will avoid additional septic systems being located near ar adjacent to City limits. Winston Dyer -The applicants have reviewed this project with Winston. Although the developers have reviewed their situation with Winston, there is not a contractual arrangement. Stephen Zollinger -Commented on the Counties desire to have this project on City services. City services for this project were reviewed on the overhead screen. Winston Dyer -The City is paying for this project in the near term, however prorated front footage fees will be assessed to new developments as they are developed in the building permit process. Discussion on the timing for the completion of the City Services project for these units. Mike Ricks made a motion to send the annexation request and the MDR zoning request to public hearing before Planning and Zoning, the motion was seconded by Doug Smith, all voted aye, none opposed. The motion carried. Stephen Zollinger -Reviewed additional properties that needed to be annexed upon the City's request. These properties should he aJlnexed with the Lamoreaux request. These parcels are East of Highway 20 and North of Erickson Pontiac to and including the County sheds. The City is the requestor for the zone change on the Lamoreaux request. Pioneer Equipment, Mr. Barney, and Mr. Porter would also like to be annexed. Ted Whyte and Winston Dyer stepped away from the table due to a conflict with respective properties under consideration for annexation mto the City of Rexburg. The remaining properties as currently designated and the North section of the Golf course as open space. Stephen Zollir~ger - Discussed the process for changing the zoning classification of properties in the Impact Zone. Reviewed recent annexations into the City of Rexbnzg. These additional parcels need to be annexed to clean up Zoning issues on the West side of Rexburg. Winston Dyer took charge of the meeting. Discussion of proposed amendments to the Zoning Ordinance Winston Dyer - Reviewed the economy and the direction of the area. How does this Commission want to proceed with Zoning Ordinances in a more proactive positior_. • Kurt Hibbert - Proposed a work meeting to address prospect?ve zoning ordinance changes. He reviewed possible items to be addressed in the work meeting. The following discussion was to compile information and ideas to be reviewed in a work meeting. Doug Smith -Reviewed the County zoning in his area of the County and the one acre requirement. He suggested looking at smaller sized lots in the Impact Zone. Robert Schwartz -Concerned with integrating different zoning types into an area to enhance beautification ofthe City through zoning integration. Winston Dyer - Suggested a Zoning Plan that would be flexible. Doug Smith -Discussed the different areas of Rexburg that interact. Doctors are great neighbors, their patients go ii0uic at night. Mary Haley -Discussed neighborhood concerns with zoning changes. Property owners in residential locations purchased their homes believing that their neighborhoods would remain residential. Winston Dyer -Rural Residential properties need to be added to our work meeting discussion. Kurt Hibbert -Compiling information from other Cities to be discussed at a work meeting for the Planning and Zoning Commission. 11 • ' • DaVawn Beattie -Requested reviewing lighting for Streets and trees for beautification. Steve McGary -Discussed the policing of Ordinances. Kurt Hibbert has enforcement responsibilities for Ordinance compliance in his job description. Winston Dyer -Review the Subdivision Ordinance that John Millar is rewriting. Kurt Hibbert -The City is wozking on redoing new forms for the application process. Ted Whyte -Requested flexibility for MDR zoning. Maybe MDR - A., MDR - B, MDR - C. Winston Dyer -The following areas could be incorporated into a Zoning Classification: 1) Special uses 2} Tune limits 3} Site specific requirements 4) Percentage of green space Jerry Hastings -The Commission needs to take the economic needs of the Developer and the City into consideration. Mary Haley -The Commission wants to help people plan for a nice looking Community. Doug Smith -Community minded with open back yards for bike and walk paths. The river green belt in Boise was mentioned as an example. Discussion on having open areas for recreations exercise through the subdivisions. Ted Whyte -Dead end parking lots do not lend themselves to open areas. `` • Doug Smith -Fences around apartments may be part of the problem. Winston Dyer -Discussion an the University Housing's impact on private developments. Eric Early -The adoption of the International Fire code will add to the cost of apartments. Sprinklers in apartments cost $24,000 fora 24 unit complex. Private developments in Provo have been put out of business due to University housing competing with the private sector. Winston Dyer - He discussed the private home owners trend to convert basements to housing for students. Competition from the University will depress the market and limit the opportunities for private developers. Discussion on apartment rents in Rexburg being below the market causing depressed expansion of family housing. The financing on new developments is not possible without the developer limiting amenities to lower building costs. Mary Haley-She has been in an apartment complex in Rexburg that is in very poor condition because of the low rents and the inability of the owner to maintain the complex.
