Winston made a motion to table approval of the October 24, 2001, minutes until the next
meeting. Motion was seconded by Doug. All voted aye, none opposed.
Evergreen Subdivision
Ted declared a conflict of interest. Ted discussed a new home in the Evergreen Subdivision
which has a 3 car garage and a concrete pad which exceeds the 30% landscape requirement.
~ This is a more narrow and deeper lot than most in the subdivision and adding the concrete pad
made this exceed the 30% requirement. Ted ask the Board how to handle this, if the concrete
should be removed or if the Board would give permission.
Discussion.
John Watson made a motion to approve the site plan as presented, seconded by Winston. All
voted aye, none. opposed.
Public Hearing for Platinum Development for Annexation and Zone Change
John Millar read the Notice of Public Hearing after which he described the location of the
property. The nature of the request is for annexation with a zone change of the property north of
the river to Low Density Residential 1 (LDR1) and the property south of the river to remain
zoned Agriculture (A).
Glenn Walker declared a conflict of interest.
Discussion concerning the green space along the river, building homes along the river, any
concerns the City may have, the elevation of the ground and the flood plain area. John Millar
reviewed the flood plain map with the Board.

. Doug made a motion to recommend this request for pubic hearing to the City Council for
Annexation, seconded by Winston. All voted aye, none opposed.
Doug made a motion to recommend this request for public hearing to the City Council for zone
change an the property north of the river to LDR1 and property south of the river remain zoned
Agriculture (A) with a recommendation to reserve an area along the river for a green belt.
Motion was seconded by Winston. All voted aye. Glenn abstained from voting.
Randall Porter Public Hearing for Zone Change from LDRl to U
John Millar read the Notice of Public Hearing. John then described the location of the property
and the request for zone change to University (U) for use by BYU-Idaho for an alumni house.
Richard Smith representing BYU-Idaho stated this house will be used as an Alumni House with
2 full time employees, two secretaries and will be used ozlly for alumni business. Parking will
be in the rear of the house which wi111essen any impact to neighborhood.
Public hearing was opened, with no public comment the hearing was closed.
John Watson made a motion to approve the zone change, seconded by Bobbette. All voted aye,
none opposed.
Kay Burton Request for Conditional Use Permit and Zone Change
• John Millar described this property which is located on the corner of St'' West and 7`" South and
across the street from the Jeppesen property. This parcel is just under 1 acre in size. The
request is for the existing house to be made into a duplex under a Conditional Use Permit. The
second request is for a zone change on the property to Medium Density Residential (MDR} for
further apartment units. Discussion.
Winston made a motion to table the application for zone change until the zone change request
for the nearby Jeppesen property has been resolved, seconded by Bobbette. All voted aye, none
opposed.
The Conditional Use Permit request was discussed relative to property and parking. Kay Burton
explained he wanted to remodel the existing home for student housing. In the future he would
build another building in the back for married housing which would be approximately the same
size as the existing house. Discussion.
Ted recommended this request go to pubic hearing with a new drawing reflecting only the one
home. Glenn seconded the motion, all voted aye, none opposed.
NTCH of Idaho Public Hearing for Conditional Use Permit.
John read the Notice of Public Hearing. He also reviewed previous hearing for SBA Towers in
this same location. This is a new application from a different company, this tower would be

north of an existing tower. The old KR~~ tower was190" which was removed approximately 4
years ago, the existing cell tower is approximately 100' and this tower is requested to be 198`.
Discussion.
Public hearing was opened.
Richard Smith - 637 Millhollow
Richard owns property to the east and south and reminded the Board of the SBA tower request.
He reviewed an older letter from Air Link Idaho, operator of life flight stating a high tower
would be a hazard to life flight, which is a problem. At some point in time the City and this
Commission needs to address location of towers, they are being put all over the City; and this
would be an appropriate time to address this issue. Richard is not sure if this spot is a good or a
bad spot for towers, the problem with 200` tower is that it penetrates through the instrument
approach zone of the Rexburg Airport. The towers are lifting the minimum heights and making
the airport unusable for larger flights.
Richard suggested the Commission be consistent with what was done with the SBA Towers
request. This commission has an obligation to protect the airport for the City and towers should
not exceed the height of the water tower, and this particular request has the tower loo high. This
property is zoned LDR and there is an objection to the towers going in this area.
Discussion concerning the elevation of the tower with the height and the ground level, the
height of the water tower and intrusion into the air space approach to the airport.
Steven Cook, 2914 W. Hwy 33, Rexburg
There was a 190' tos~~er there in the past Yvl'~ich met FAA requirerrients. Steve contacted fAA
in Boise and they said there had never been a complaint filed about 190' the tower, this request is
only 8' taller. These people need a tower that tall so the beam will shoot into the City to give the
City coverage. The SBA Towers request was denied so they built two towers, one tower next to
the water tower and one tower on Barney Dairy-Road so this is the reason towers are popping
up all over.
Public hearing was closed.
Discussion concerning elevations of tr~e ground and other water towers in this location, the unlit
tower in this location, other towers located on Richard Smith's property, discussion of cost of
moving towers. the need of official word on changing the instrument approach zone to the
airport by Air Link, if conditional use permits are granted for towers they should all be lit.
Doug made a motion to refer this request to City Council for public hearing with the
recommendation the tower not exceed 198', that the proposed tower not jeopardize or create a
change in the inst-ument approach to the airport and that the tower be lit at a level acceptable to
City Engineering Department. Winston seconded the motion, all voted aye.
Public Hearing for Thueson Family Trust for Zone Change from MDRlPO to HDR2
John Millar read the Notice of Public Hearing then described the location of the property and the
nature of the request and its compliance with the Comprehensive Plan Change.
Public hearing was opened.
Ken Hart, 367 Salem Ave.
Ken lives approximately 1 block from this property, the area has single family residential homes.
This request would allow a three story building and more buildings, it would make a definite
change in the neighborhood and he opposes this change.
Mike Thueson, 581 Summerwood
Mike represents the family trust. This piece of ground seems to fit with the new zone of High.
Density Residential for housing for young couples and small apartments. It borders the canal, a
trailer park, Main Street and there are apartments on one side. He believes it does maintain the
residential look of the area, it does fit the Comprehensive Plan, and it is an acceptable use. The
family requests the change to HDR2.
Public Hearing was closed.
John Watson -felt this was a good use for the property. Discussion about safety of canal which
should be addressed on a site plan along with ingress and egress being away from 4t'` West
because of the canal.
Ted made a motion to send this request to City Council for public hearing with the
recommendation of a zone change to High Density Residential 2 (%~3R%). The motion was
seconded by John Watson, all voted aye, none opposed.
Public Hearing for Henderson Subdivision for Annexation and Zone Change.
Sohn Millar read the notice of public hearing, described the location of the property and the
areas and various zone change requests.
Kurt Roland, representing Henderson, explained the purpose for double frontage lots on the
subdivision. At some point in the future the plan is to rezone the LDR2 portion to a high density
for married student housing.
Jahn Millar referred to the ordinance which states double frontage Lots must be specifically
allowed by the City Council. Discussion concerning roads into the subdivision; impact on
church parking, dedicated City streets and Park Street traffic.

Joe Laird, 190 So. 1500 West
Joe commented about the zoning and the street pattern. The master plan indicates this area
should be single family dwellings, this request is for multi-family dwelling. He built in this area
with LDR1 zoning and he would request it stay LDRI. LDR2 zone is for small lot sizes, houses
would be built like a trailer court, houses would need to be built in a long direction which
creates more a trailer park atmosphere than single family.
He discussed the preliminary plat for his property and final plat for the church. The presented
pattern will definitely increase the traffic on Park Street, this addition needs to provide a street
access to 1500 West so the interior pattern does not overload streets. There needs to be a
through street to share amount of traffic generated in area.
Ted and Doug felt this should remain LDRI and the road access should be addressed.
Discussion.

Bobbette seconded motion, all voted aye, none opposed.
Final Plat Review Henderson Subdivision Phase 1
John. Millar presented the final plat for Henderson Subdivision Phase 1. The City Departments
have reviewed,. the Fire Department would request a road going to the west which would. not be
a direct effect of this plat. City Departments see nothing objectionable and recommend
approval. Discussion.
Kurt Roland reviewed the final plat with the rsaard.
Winston made a motion to approve the final plat as presented. Ted seconded the motion, all.
voted aye.
Preliminary Plat Review for. Henderson Subdivision Phase 2
John Millar reviewed the preliminary plat for Phase 2 of the Henderson Subdivision.
Discussion on roads, storm drainage, water lines, nearby Westates Development, Park Street and
1500 West, discussion for more accesses and that accesses should line up with future
developments in the area and with the church, east-west route versus north-south route, bridge
across canal and elimination of Lot 23 for road.
Winston made a motion to approve the Preliminary Plat for Henderson Subdivision Phase 2
subject to the following conditions:
There be provided an access south to align with Seagull Drive
An access to 1500 West to align with Johnson Ave.
An access to 1500 west be on the northern boundary and south of Joseph Laird property.

Ted seconded motion. Voting aye were, Davawn, Winston, Ted, John Watson, Bobbette,
Ladawn and Glenn. Doug voted nay.
Request for 4-plexes rather than townhouses on Vallinda Lane
John Millar explained this property is already zoned MDR which would allow 4-plexes be built
rather than townhouses and this issue does not need to be discussed.
Site Plan Review for Dr. Eric Barton at Madison Professional Plaza
John Millar explained the location of this property with other professional offices in the
Madison Professional Plaza. Adequate parking is provided and it appears to be a straight
forward site plan.
Discussion concerning parking lot stall sizes, review and approval by City Deparhnents.
Bobbette made a motion to approve the site plan as presented, seconded by Ladawn. All voted
aye, none opposed.
Site Plan Review for Dr. Brad Egbert at Rexburg Business Park
John Millar reviewed the site plan provided for Dr. Brad Egbert located adjacent to Farm Bureau
in the Rexburg Business Park. This site plan meets all City requirements. Discussion and
review of plans.
Winston moved to approve the site plan as presented, seconded by Ladawn. All voted aye, none
opposed.
Requests for Comprehensive Plan Changes
John read the list of requests for Comprehensive Plan Changes.
* Second- South between 1St East and 2"d East shown as single family residential Most
of these homes have transitioned to student housing.
* Main Street between 4th and 5th West which is zoned MDR, requests change to higher
density.
* An area on 5th West owned by Clinton Parkinson.
~` Henderson Subdivision.
* 7 East and 2°d North from Open Space to multi-family.
Discussion concerning Comprehensive Plan.

It was discussed by the Board a zone inventory be compiled along with the requests for
Comprehensive Plan changes. At this time there are many weighty matters on the agenda that
need taken care of and when construction slows down and the agenda is more open then the
Comprehensive Plan can be reviewed in more detail.
It was recommended this matter be inventoried for the nest 30 - b0 days, review in January or
February then move ahead with Comprehensive Plan change.
