Bobbette made a motion to approve the minutes of June 27, 2001. Motion was seconded by
Ladawn, all voted aye, none opposed
• Public Bearing for Gary Lovell Zone Change to LDR with Professional Overlay
John Millar read the notice of public hearing then gave an explanation of the request and what it
means. If this property is changed to maintain a professional overlay it maintains the existing
zone but allows for either the transition of an existing building to a limited professional use or
the replacement of a building to perform `Ghat same purpose. Discussion of what is allowed in
professional overlay.
Public hearing was opened.

Myrl Willmore - 1340 E. Saxony Circle, Salt Lake City, IJT
Myrl questioned if the residents would be notified again for a hearing if this property were
turned into a parking lot and was informed they would be. For the record she stated that Dr.
Lovell does not own her mother's home on 2"d East nor is he considering buying it.
Terrell Arnold - 206 E. Main
Because he lives in the area of the proposed zone change he has an interest in the outcome.
There have been rumors of people selling their homes, he is neither here to approve or
disapprove but to hear testimony for the proposal. He recommends tabling this proposal for two
weeks which will give the most concerned residents time to discuss and make decisions on this
zoning change.

Ruth Martin - 232 E. Main
Ruth is representing her parents who live at 232 E. Main. If this professional overlay is
approved and if Main Street is actually a street going to the hospital can something be done
about the kids racing up and down that road because it is suppose to be a quiet zone. Discussion
concerning traffic pattern. Ruth is not opposed to the professional overlay but with a
professional overlay can the City take into consideration that the people who still live there are
under a residential- zoning and can we monitor what happens in their neighborhood. Another
concern is parking, if this. is changed to a professional overlay and those places. go professional
some of the property is going to have to go for parking. Neighbors are concerned about the lot
next door to their yard becoming a parking lot and what that does for noise and other things that
go along with this. She is not apposed as long as other problems can be fixed, this should be
maintained as a residential area as Long as there are residents still there. Discussion.
Gary Lovell - 36 Professional Plaza
Dr. Lovell originally requested the rezoning of three homes he had an interest in. The sale of the
Willmore home was contingent upon another party which sale fell through and the home is no
longer an issue. There is still an issue of the two homes which he has purchased for. possibly
expanding the parking lot into those back areas. In order to do that does he have to have another
hearing and was informed that a parking lot would be a conditional use. He stated he has no
immediate plans to do that.
- Carol Hokanson -Freedom, Wyoming
Carol was representing her mother, Hazel Willmore. Dr. Lovell specifically told them that if he
purchased her mother's house he would tear down the shed and the back would be used for a
parking Iot not snow removal or other things, a road would be made through to have access to
that parking lot.
Discussion with Dr. Lovell concerning sale and moving houses for parking lots and the impact
on the neighbors.
Tom Silvester e 24 So. 2nd East
Tom reiterates the things that have been said. There are a lot of rumors and no one is really sure
what exactly the plan is and that is a lot of the concern as adjacent property owners. It is the not
understanding and the devaluation of their property if the next property would become a parking
lot. It is hard to agree with a plan when you don't know what the plan is, how can a decision be
made until someone sees the whole plan. Parking lots are not run on an 8 hour shift, they are a
24 hour use when kids are driving around.
Dee Holly -Star Valley, Idaho
Dee is representing her mother, Ethel Topham who resides at 25 So. 2nd East. She questioned
how many doctors are involved, how much property do they want, and won't parking lots
devalue property of those around them. Before anyone can agree on what is to be done some
type of plan needs to be presented. Everyone needs to know exactly what Dr. Lovell is talking

about, how many lots, how much parking. Mrs. Topham has lived in her home over 40 years
and a change at this point in time would be very difficult on her and she would not want a
parking lot next door. Dr. Lovell needs to put together a complete plan.
Gary Lovell explained that he with two other doctors purchased the Porter home and their
parking lot already is zoned LDRl. Discussion concerning a parking Iot at that location. Other
than moving a shed on this property there is no plan for expansion. The intention for the- Brown
home is to rent indefinitely, it was never the intention to move that house.
Myrl Willmore -
She questioned if this request could be amended to just include the Porter property until there
are more immediate plans.
Doug Smith -
Doug owns part of the professional property as well as a home in this area, he is neighbors with
the Willmore property. His concern and plan is that he needs additional parking, he has a vacant
lot adjacent to his office to the south and would someday like to build an office on that lot but
parking restraints make it impossible to put in another building without additional parking.
He would like this overlay there also so he could expand the parking Iot into the backyard of the
little white house or remove the house for parking.
• Doug declared a conflict of interest.
Discussion that Dr. Lovell had originally requested just the three homes be included in this
request and at the Last hearing Planning 8~ Zoning included additional property just- for
simplification.
The public hearing was closed.
John Millar reviewed .and explained the Comprehensive Plan. At some point in the future the
Comprehensive Plan sees this location as commercial use. as the area transitions, it may be 5
years or 25 years. Discussion on the development of the corridor from the Courthouse to the
hospital, the hospital has a master plan to build in response to the growth to the community,
more medical professionals coming in, changes at the college, the circumstances of this request,
professional overlay protecting the area from commercial.
John made a motion to table the zone change request from Dr. Lovell. Motion was seconded by
Ted. All voted aye, none opposed, Doug abstained.
John Watson made a motion that the Planning & Zoning Commission develop an area that is felt
will naturally grow into professional overlay. Motion was seconded by Bobbette, all voted aye,
none opposed.-
Proposed expansion of Health & Welfare building

John Watson and Glenn Walker declared a conflict of interest.
This item was for informational purposes only. John Millar explained the first drawing of the
existing layout of the Health and Welfare building, there is a road on both the north and -south
side of the property, the south side being Walker Drive and the north side being East 4th North.
The next drawing shows an outline of a proposed expansion of the building to be made by John
Watson. There is an existing dedicated right-of way on the north side of both the Photo Lab and
the_Health & Welfare building, if anything differently is done it will require the abandonment of
that street. Long term the City sees this as a realignment of Barney Dairy Road, across the canal
and to come onto North 2°d East between CAL Stores and Forsgren & Associates, eliminating the
stop condition that currently exists. For long term City planning there would be an objection to
this change.
John Watson explained his position on this expansion. He distributed a letter from past Mayor
Nile Boyle addressing this situation dated September, 1998 addressed to the Walker family.
Discussion.
Glenn Pinder Preliminary Site Plan
John Millar explained the location of the property north of Arctic Circle on North 2°d East and
reviewed the diagram presented. Discussion about obtaining a Joint Use Agreement with Arctic
Circle.
John Watson discussed that Glenn Pinder wants to add to his existing building and possibly .
something in the rear of the property. He is proposing the addition will be built to the side and
keep the parking in the rear, he has discussed the need for a sidewalk across the front and a
landscaping strip, parking in the front is for compacts, the City has reviewed and approved.
Discussion concerning speed limit on 2°d East. The Deseret Industries plat is completely signed
off and recorded and for informational purposes a couple of the lots have already been sold. The
possibility of an expansion of the bowling alley, discussion of the professional overlay, and the
consideration for a Zions Bank to be located across the street from City Hall on property owned
by the Carlsons.
