Davawn called the meeting to order. Gary made a ~~~oticn to approve the minutes, seconded by
Bobbette. All voted aye, none opposed.
RE: JASON AND RENEE.DYE CONDITIONAL USE PERMIT •
TOPIC: (550,263,,,DYE*RENEE,C.U.P.,1 ST WEST,APARTMENTS,DAY CARE)
Jason and Renee Dye appeared with a request for a Conditional Use Permit for an apartment and
a Conditional Use Permit for a daycare center at 75 N. 1St West.
Jason explained they would like to purchase this home, the basement of which is set up for two
apartments which they have since learned were not zoned for apartments. The Dyes have
determined that rather than requesting two apartments they would settle for one apartment, they
know the windows in the basement need to be compliant with egress windows which are in their
plans. Adequate parking, the need for 4 spots was discussed. There is a two car garage with a
driveway which would make the parking in compliance with one apartment.
The Conditional Use Permit for a daycare center was discussed at length. Several safety issues
were a major concern including the need for two exits, additional parking and the problem with
three uses in this one property.
Ted made a motion that the request for a Conditional Use Kermit for one apartment be approved
to send to public hearing. Motion was seconded by Bobbette, all voted aye, none opposed.

Ted made a motion that the request for a Conditional Use Permit for a second apartment and a
daycare center be denied. Motion was seconded by Gary.. All voted aye, none opposed.
RE: GLEN REED ZONE CHANGE FROM HBD TO HDR

Glen_Reed proposal for a zone change from. HBD to HDR was presented by John. He distributed
maps and explained the location of the property on 4t'' South and 4~' West. This proposal meets
all the requirements and is contiguous with HDR zoning and the City has no problems with the
change.
Ted made a motion to approve this zone change for public hearing, motion was seconded by
Gary. All vote aye, none opposed.
RE: APARTMENT PARKING RATIO

John reviewed the issue of the parking ordinance which had been discussed at the last meeting.
The Council requested Planning & Zoning make a recommendation. Several college cities have
been contacted regarding their requirements for parking which were reviewed. Sharon Tuckett,
Director of Ricks College Housing Director was present for the discussion.
``• There was considerable discussion concerning the growth of Ricks Colle e, the need for

adequate parking which is presently not adequate, zone change issues, parking requirements for
entities other than student apartments, the time frame for a new ordinance to take effect as well
as parking requirements for other entities. The time frame for change of the ordinance was
discussed..The ordinance can be effective immediately upon approval and a developer must
show substantial steps toward a complex to be exempt from the new requirements. Two
proposed complexes were a concern, Randy Bird, that had modified his plan on several
occasions to comply with Planning & Zoning, the other property to be located behind the old
Broulims store has only been before P&Z once but there has not been significant progress on
that project.
Motion was made by Ted and seconded by Ladawn to revise the parking Ordinance and send to
Public Hearing, all voted aye, none opposed. The revision is as follows:

RE: LITTLE CAESARS DRIVE THROUGH

John informed the Board that Little Caesar's Pizza will be moving to Main Street in the Old
Kentucky Fried Chicken building. He presented a diagram of the property showing where they
propose to put in a drive-up window in the alley. Discussion was on ingress, egress, diagonal
parking and parallel parking. Stephen will check through the public records to be certain there is
an egress and ingress. easement at that location.
