A motion was made by Ted Whyte and seconded by Bobbette Carlson to

RE: BART STEVENS VALLEY VIEW ESTATES

Bart Stevens Valley View Estates Division Number 4 Final Plat review.
John Millar reviewed the plat with the board. He stated he believed
they had the details fairly well worked out on the plat. They are still
having some problems locating where water lines are laid out. It still
needs to have departmental review and go through the necessary checks
but as far as details go the only question he wanted to present today
is when you look on our Transportation Plan 2nd East is shown as a
Minor Arterial. That road is about eight or nine years old. Through the
rest of the town where it is curb and guttered it has a 44' section. If
we build this to the Minor Arterial, it would require this section be
widen 14' John stated that his feeling is that he was not sure we
would benefit any in doing that. He suggested that the city had a hard
time when they widened the road as much as it is and he didn't know how
it would be accepted to widen it more. (discussion) There is an
existing 100 foot right-a-way through there. Part of it was dedicated
when the subdivision John Watson is in was built. The other part was
when 2nd East was widened so there is sufficient right-a-way through
there. This will require sidewalks to be placed along there. All the
sidewalks along 2nd East are contiguous to the curb however his
recommendation is that this sidewalk be moved back with a 7' planting
strip and a 5' sidewalk. Other than that and the departmental approval
he would recommend approval of this final plat. Bart discussed that he
had been trying to contact someone to talk about the church procuring
the lot on the south of the church. John Watson said he had sent
information and a letter about it. Discussion on location of fire
hydrants and sewer line. Discussion on width of the road and if it
needed to be widened and also storm drainage. Bart told them the lots
will have a 35' set back.

A motion was made by John Watson that the plat be approved. as drawn
pending departmental approval and that the road be constructed as a per
a Collector Criteria with the provision that Bart put a requirement in
the Protective Covenants that there will be no trees planted within 14'
of back of curb. (This would make it easier for a Minor Arterial to be
built if needed in future years.) Motion seconded by Roger Muir. All Aye
RE: PROFESSIONAL PLAZA STREET ABANDONMENT

Possible Abandonment of Part of the Street in Professional Plaza. John
Watson and Doug Smith declared a conflict of interest. John Watson
presented a drawing and explained that the drawing shows the change in
the road in Professional Plaza. Professional Plaza was originally put
together by a private development and at some point in time they turned
the street over to the city and it has always been an odd dimension.
The issue is right now the property line is behind the sidewalk in
front of Archibalds and comes down to Smiths. The property line stays
in the same plane and so you develop a landscape area that is
technically right-a-way or city property. By having it that way what
that means is none of the property owners can put signage out in the
right-a-way. He had reviewed it with John Millar and asked him what
could be done about it because it made sense that the property line
stay behind the sidewalk and John Millar suggested a possible
abandonment of the property. John Millar said he could not see a
problem in doing that. A motion was made by Mike Thueson and seconded
by Raymond Hill to send it to the council with the recommendation that
they proceed with the abandonment. All Aye

Doug Smith made a motion that the Planning & Zoning Meetings be changed
back to Wednesday nights instead of Thursday starting the first meeting
in January. (discussion) All Aye There will also be only one meeting in
November because of Thanksgiving and one meeting in December because of
Christmas
RE: PARKING LOT LAYOUT FOR HILLCREST

Parking Lot Layout for Hillcrest - John showed a plan for a parking lot
for Hillcrest Apartments located at 5th South and Harvard. As near as
they can find there was no right-a-way acquired from Hillcrest when
Harvard was put in. There are two or three issues, even if we say
right-a-way is at back of curb the ordinance prohibits parking in
setback area which would make the parking lot not in compliance.
Another condition is this parking lot has been unpaved for over 20
years which predates our current ordinance. He has been trying to work
with a solution with this non compliance issue that will get this
parking lot paved which is needed and still be what we want. What John
would like to propose to them is we allow a 7' setback, a 5' sidewalk,
and build the parking lot to the sidewalk. This would fit in under
previous rules and would match up with the development north of them

and should be a workable solution but it does need review by Planning &
Zoning. A motion was made by Mike Thueson to approve the recommendation
made by John for the parking lot. Seconded by Bobbette Carlson. All Aye
RE: ANNEXATION OF PROPERTY ON SOUTH 5TH WEST

Annexation of Property on South 5th West- John Millar discussed with
the Planning Board where the city limits extends to on 5th West. It
goes out to 7th South. There are two pieces of property one owned by
Jeppesens and one owned by Davis that are in excess of 5 acres and
would need the owners approval. The city is seeking annexation down to
the Moffet property. The city can annex property under 5 acres that is
not agriculture without the property owners permission. A motion was
made by Roger Muir and seconded by Mike Thueson to recommend to the
City Council to proceed with annexation and possible to approach the
property owners farther south for possible annexation. All Aye
