All Aye RE: R&B DRIVE-IN STORAGE SHEDS TOPIC: (500,203,,,C.U.P.,STORAGE SHEDS,2ND WEST) Request for C.U.P. for Storage Sheds behind R. & B Drive-Tnn John Millar explained the proposal is for construction of 10 individual -- storage units for commercial and household items. They will be 8' x 10' and located behind R & B Drive Inn at 115 South 2nd West. The property • is zoned H.B.D. To build storage units it would require a C.U.P.. John did not see any problem in proceeding to public hearing. It will have to have adequate access to the storage units. (discussion) A motion was made by Bobbette Carlson and seconded by Raymond Hill to go to Public Hearing for the C.U.P. All Aye RE: TEMPORARY UTILITY SHED AT BIRCH PLAZA TOPIC: (500,203,,,STORAGE SHEDS,D.E.Q.,BIRCH PLAZA,2ND WEST) Request for a temporary utility shed at Birch Plaza. John Millar explained the reason for the need for a shed at Birch Plaza. Before the apartments were built there was a service station there. In the change of ownership the new owner elected to do some research into possible fuel spills. They did find some fuel contamination and they are going to have to do some decontamination work. They will be drilling a series of shallow wells in the ground and will pump air or blow air into the ground into some of these wells and retrieve the air out of the other wells. That procedure will take the gasoline out of the soil. It will be a temporary shed about 16' x 8'. It may be there for 6 months to 2 years. John felt because it would be a temporary structure for a temporary use it would not need a C.U.P. Van Helm representing the project explained they have purchased Birch Plaza. He showed the plan and explained. He showed where the old . Service Station was which was torn down to build Birchwood Apartments. As part of their study as they were evaluating this they reviewed the building permit and found the fire chief had checked it with the ~~~ contractor and they did not note any contamination in the soil • visually. They covered it over and felt it was fine. Their lenders required more proof. They drilled more holes and took soil samples and did more extensive tests than the initial visual study. When they drilled holes and did tests they detected petroleum in the soil. This got D.E.Q. involved and they required them to go through a procedure to remove the petroleum from the soil. D.E.Q put an immediation plan on them. Rather than digging the asphalt up you pump holes in the soil with wells and they have vents with screens. He explained the system they were putting in. They take samples of the air until it meets to D.E.Q's satisfaction. The pumps have to go day in and day out. To quiet the noise of the pumps and equipment they want to put a temporary building with a double or triple wall with sound insulation and a double door with insulation. It will take up a couple of parking spots. This procedure is mandated with D.E.Q.'s requirements. The board and John felt there would not be a problem with the temporary building and told him to go ahead. RE: BRETT HASTINGS SITE PLAN REVIEW TOPIC: (500,204,,,SITE PLAN,HASTINGS*BRETT,NORTH HIGHWAY) Brett Hastings site plan review - John Millar explained and showed the plan. The building under consideration is in the N.E. corner bordered by Staples and Sears. It is going to be a furniture retail store. All the department heads have reviewed the plan. The fire department has ~ not been able to make a complete analysis because fire hydrants were `, • not shown on the plan and we will need some additional information on that. It fits in the H.B.D. zone. They have shown adequate parking. John stated it looked like they have not allowed for adequate landscaping to meet the requirements. Brett explained they would have about 130 of landscaping so it would meet the requirement. John .stated storm drainage will go into the existing storm drainage system. Brett explained the existing storm drainage and stated that Benton Engineering will design the storm drainage for this development. Brett told the board all the easements are in place except the utility easement and they are working with Bob and Sharon Orme to get that agreement. John told him that other than the review with the Fire Department, we have no problems with it. Brett said they did anticipate putting in a fire hydrant and would work with the fire department on that. Brett said they are working with Nyle Fullmer to put a duel sign out where he has his sign. (discussion) A motion was made by Mike Thueson and seconded by Bobbette Carlson to accept the site plan based upon the Fire Department approval. All Aye RE: BELINDA TOWNHOUSES AMENDED PLAT TOPIC: (500,204,,,PLATS,5TH WEST,6TH SOUTH,BELINDA TOWNHOUSES) Belinda Townhouse amended plat. John Millar said he had not seen this plat so Linda Eames explained it. This is on the corner of 5th West and 6th South and showed the plat that had been approved. She explained that Stella Chambers wanted to sell the back of her property which is -_-_- 89 1/2 feet so Linda purchased the back end of her property. It would • allow the end lots to have a 20' garage. It moves the hammer head back ~~~/ a few feet and instead of having 8 lots they could have 10 lots. They • are just extending it back and adding two lots. John Millar told her we would need the Department Heads approval. It is a private road and the city will not maintain it. John stated it .doesn't meet the requirements for a preliminary plat but with just this minor extension we could accept it as a preliminary plat pending Department Head approval. She will have to have an final amended plat .and if people have bought any of the lots they will have to sign the amended plat. A motion was made by Mike Thueson to approve the amended preliminary plat based on the Department Head approval. Seconded by Bobbette Carlson. All Aye RE: RANDY LANDON REQUEST FOR FENCE TOPIC: (500,205,,,FENCES,2ND WEST,LANDON*RANDY,PARKING,PARKING LOTS) Randy Landon request for fence. They have built a chain link fence behind Carousel Apartments at 345 South 2nd West. It is a parking lot owned by four complex. They would like approval to put barb wire on top of the fence. The parking problem in this town is bad and getting worse. College kids will climb the fence. It is their parking, they own it. They are hooked up with Barney Towing now and they are going to put signs on the parking lot and will tow when they tell them to. They have stickers to put on the cars that can park in that lot. (,di3CLSS1on) Davawn asked Stephen if this would be a liability problem for the city? Stephen stated that barb wire is for the purpose of security and public safety not to keep people from moving from property to property. The • concern he would have of allowing barb wire on this fence would be we have just accepted barb wire in a situation where we have precluded it in the past. Property separation is one area that most cities have done away with barb wire as a means of separating two parcels. The exception is for secured property that is stored within a fenced in area such as impound lots, dangerous type circumstances, swimming pools or ascent prevention devices. You would be cutting seriously into the existing standard that you have established city wide. Paul Pugmire stated he felt uncomfortable with it. If the board allowed this type of wire on the fence for this purpose he felt the council needed to revisit the ordinance.
