A motion was made by Mary Ann Mounts and seconded by Doug Smith to
approve the minutes of 8/12/98. A11 Aye
RE: ROSS FARMER REQUEST FOR PARKING VARIANCE

Ross Farmer was at the meeting to request a Variance for parking for a
home he was purchasing. They now own the Carriage House Apartments
which boarders this home. They have some students living in the home.
They rented it to students who don't have any cars because there isn't
any parking. There is a garage on his house and a driveway. They are
requesting a variance for parking in exchange for renting to students
who have no cars. This is south of the Carriage House. It is the old
Webster house. The only way they could get off street parking would be
to somehow come in from the back from the Carriage House Parking lot.
They have chose to make a condition of rental that they not have cars.
They would rather not have to tear cut the landscaping in the back
yard. They just recently bought the house. At sometime in the future
they may develop that lot. The driveway could be a loading zone. The
zoning is H.D.R. There was an existing apartment in the basement that
was rented to a married couple. (discussion) A concern is it would set
a precedence. Mr Farmer said he would police it because he requires
all vehicles to have stickers and if they don't have a sticker. He has
a contract with a towing company to tow the cars without a sticker.
This house is surrounded by apartments and would not be sold as prime
property. Bruce was concerned what kind of penalties we have if they
do bring cars.
A motion was made by Doug Smith that we set it for Public Hearing for a
Variance with the stipulation that it is a one year variance and that
he come back yearly to have it renewed. Seconded by John Watson. All

RE: CONTINUANCE OF LYLE WADSWORTH PUBLIC HEARING FOR A VARIANCE •

Continuance of Lyle Wadsworth Public Hearing for a Variance. Mr
Wadsworth said he checked and the property does go to the middle of the
road. John Millar explained and showed a copy of the subdivision
plat. The property was plated in 1973 and Mr Wadsworth bought his
property in 1975. The actual property that Mr Wadsworth has is plated
1.38 acres which is almost identical to that of the Browers. The deed
that he has of 1.9 acres goes to the center of the Widdison road.
There are a lot of those lots that are not one acre. Several of the
lots actual deeded property are .9 acres and some of them are less than
that. There two lots across the street lot 22 and 23 that are .75
acres. The road is a dedicated county road.
Paula Harris stated the lots that are 139 feet wide by 283.5 feet are
deeded to the middle of the road because when that subdivision was
plated that road was not a county road it was maintained by the
property owners so she has a deed for lot #7 and they are all deeded as
one acre lots and then each of the property owners dedicated the road
to the county to have it maintained. John Millar stated that there is
on the plat their dedication of the road signed by all the property
owners. Paula read from the Ordinance stating that the Rural
Residential Zoning is to protect stable neighborhoods of detached
family dwellings on one acre lots up to five acres. John Millar told
her this ordinance was set up for new developments that is why Mr
Wadsworth is here for a variance. Mr Wadsworth said he talked to the
neighbors and all but Mrs Harris are in agreement. (Discussion on
ordinance, lot size, and the Brawer situation.)
John Watson told Mrs Harris the reason we had Mr Wadsworth come back
was so we could gather the facts and make a decision on the facts.
John Watson stated that some lots in the neighborhood that are smaller
and some larger. He could not see that it would tear .down the
neighborhood. There are other lots that are less than an acre. Mary
Ann Mounts stated that the integrity of one acre lots was done away
with when they dedicated the road. (discussion) John Millar stated the
concept was they were one acre lots and the smallest lot is .4 of an
acre.
A motion was made by John Watson to approve the Variance because it is
consistent with the neighborhood. Seconded by Mary Ann Mounts. She
felt that the Impact Zone was not to create a hardship. This is not in
conflict at all because it is not the smallest lot. If we denied this
it would deprive him of his property rights. (discussion) All Voting
Aye to Motion. John Millar told him he needs to make sure he met the
setbacks and suggested that he split the lot in half.
RE: BOWEN SUBDIVISION

Bowen. They have been discussing purchasing a piece of property but

` • feel there is a problem as to the road position and the easement for
the water line. They are not sure what they are going to do yet. The
property is zoned H.D.R. It is north of the Nursing home, east of 2nd
West and in the vicinity of 6th South. John Millar suggested a
possibility which would be to work with the Nursing Home and extend the
road on out to .7th or possibly shift the road which would mean it would
have to be replated, Joe agreed. When this was plated there a lot of
discussion of the location of the street but the people were not able
to get permission from the adjoining property owner to locate the
street different and this was the compromise to locate the street as it
shown. Mr Ellis stated the property is dead to them with a 30' easement
and a road running through the property. They would need to either
move the road or the water line. (discussion) John Millar told them
this board is willing to work with them but it is important to have a
road in.
John Millar har_ded out a Site Plan Approval list that is needed to help
the engineering department. This would speed up the approval process.
The board agreed to requiring this.
Bruce told the Planning & Zoning he had enjoyed working with them and
that the city council appreciated all the work they do.
A motion was made by Davawn Beattie and seconded by Mike Thueson to
