RE: CGNDITIONAL USE PERMIT FOR DAVID BECKSTRAND
TOPIC: (500,104,,,C.U.P.,2ND W.,BECKSTRAND*DAVID)
Request for a Conditional Use Permit for David Beckstrand presented by
Ted Whyte. Ted also declared a conflict of interest. The property is
located at approximately 550 South 2nd West. It is boarded by Ricks
College on two sides. It is currently zoned H.D.R. This property was
owned by Bob Lee who is selling it to David Beckstrand. He wants to
build it in phases for student housing. He is planning on building 16
units for men and 16 units for women. He has hired an engineer, Jay
Rice from Idaho Falls to do the plans. They need to clean up the
right-a-way. The road will be surveyed and 2nd west will be deeded to
the city. There is student houses adjacent to it. It abuts the
baseball fields on the East. It is 5 1/3 acres. A motion was made by
Davawn Beattie and seconded by Jim Long to schedule it for Public
Hearing. Ted Whyte declared a conflict of interest. All Others Voting

RE: PUBLIC HEARING FOR RANDY BIRD APARTMENTS
TOPIC: (500,104,,,C.U.P.,APARTMENTS,2ND E.,BIRD*RANDY}
Public Hearing regarding proposed issuance of a Conditional Use Permit
to allow for 42 Apartments. The property is located at about 455 South
2nd East.
Randy Bird was at the meeting to present plans and ask for the
-- Conditional Use Permit. There are two parcels of property. This
includes the old K.R.X.K. Building and that will remain and be
remodeled for 6 units. They are proposing in the future three .
twelve-plea. They want to do it in two phases. The first one will be

', ~ a twelve-plex built on the front next to K.R.X.K. Apartment building.
He had talked to Joe Laird over the phone about the project because he
is from out of State. The parking if laid out and should be sufficient
according to the ordinance. This property boarders between Harvard and
2nd East and they felt it would be better to have all the entrances and
exits off of 2nd East which is across from the college so they did not
bother Harvard. They have the road easement off of Harvard and a 25
foot green belt on the Harvard side. He showed a picture of the
building, which is a two story building with a basement. The building
looks good on all sides and the side of the building facing the
residential side will look good. They are below the height
requirements. There is a common stairwell in the middle.
John Millar opened it for public comment.
Clyde Luke- 334 Harvard Ave- He stated that he was acting as spokesman
for the property owners. They realize that the property is zoned
H.D.R. and approved for apartments. The apartments are not their
concern. Mr Bird has addressed their concern about the cars not coming
onto Harvard from the complex. They have a very narrow street and it
is very congested with a lot of traffic. An option is to have parking
on only one side of the street and they don't want to lose any of the
existing parking. Harvard was not designed to be used as a main feeder
street. Their proposal was to ask that as part of the Conditional Use.
Permit to de..y entrance to Harvard from the complex which has been
addressed. Another condition was to have a greenbelt or fence around
`~ the complex which he has met. They also want to come to City Council
and ask that a 3-way stop be placed at the intersection of Harvard and
4th.
Rick Page- Director of Housing at Ricks College- (letter on file) He
had been asked by the administration to come to this meeting. Their
approach to student house is that they will approve it when it meets
the city building codes and meets the college minimum guidelines. Their
one concern is the safety for students. Adding another housing unit on
the other side of the street from the college on 2nd East brings it to
about 1000 crossing the street two or three times a day. Their concern
is the safety of those students crossing that street especially when
you consider the traffic coming in on 7th South down 2nd East. They
suggested a safe crosswalk and possibly a flasYiing yellow light there.
Scott Spaulding- 466 South 3rd East- He is also pleased that the only
entrances are from 2nd East. One of the concerns is even though there
is a greenbelt shown on the East side of the property, they would like
to see a fence or somekind of a barrier to make sure the residents
along there have privacy and protection against flying garbage and
those kinds of things. Discussion from the commission that they could
not require a fence all along Harvard and could not restrict pedestrian
traffic on Harvard. Mr Bird said he had some big rocks he planned on
using in the landscaping along Harvard which would discourage foot
~---- traffic from going through there..
Close public hearing and turned over to the Commission for discussion.

John Millar explained this is a Conditional Use Permit and the use is
by right but we can add conditions to the permit.

John Millar indicated that this site plan had not been reviewed by any
department heads or the engineering department. He also told them there
would have to be a sidewalk put on Harvard.
A motion was made by Roger Muir to recommend to the City Council that
we approve the Conditional Use Permit with the conditions (1) That
they put landscaping on the east side in a manner that no vehicular
traffic can come out of the parking lot onto Harvard. (2) That he
screen the refuse collection area. (Approval be based on the
Departmental Approval.} Motion seconded by Davawn Beattie. All Aye
RE: PUBLIC HEARING FOR A VARIANCE FOR HOME ON SUBSTANDARD LOT
TOPIC: (500,106,,,PUBLIC HEARING,VARIANCE,WADSWORTH*LYLE)
Public Hearing regarding a proposed issuance of a variance for a
residential home to be built on .8 of an acre. The property is located
on the North 1/2 of the lot at 228 South 2000 West in the City of
Rexburg Impact Zone.
Lyle Wadsworth was at the hearing to present his proposal for the
variance. He wanted to build a house on .8 of an acre. The property
would be 139' x 250' on the north side of the property.
Paula Harris- 1903 West 190 South- Her property is adjacent to that
lot. Ten months ago she was here at a hearing after the fact. On the
east side of the subdivision a house was allowed to be built on less
than a one acre lot. When you start allowing a house to be built on
less than a one acre lot you are setting a precedence. There are
probably 5 lots in the subdivision that you would have enough frontage
to put another house on. She is concerned that when you build on less
than one acre, what are the plans for a well and septic tank and how
would that impact our community?
Mrs Harris complained that she had not received a notice, however her
name was on the list who were sent notices and Mr Wadsworth said her
husband was aware of the hearing.
Planning Commission discussed the lot and density. They also discussed
the plat for that subdivision.
A motion was made by Mary Ann Mounts to continue the hearing until Rose
researches and mails a copy of the minutes to the Commission from the
meeting the Browers were at after they put another house on their lot.
The commission also needs a copy of the plat to review before a
decision is made. Seconded by Doug Smith All Aye. The hearing would
be continued until August 26, 1998.

RE: TAGGERT DEVELOPMENT PUBLIC HEARING CONTINUED

Continuation of the Taggert Development with a Zone Change and
Conditional Use Permit. Val Christensen handed out a traffic report and
a report from the State Highway Department on accidents. These are the
most accurate figures we have now and there are other counts being done
as we speak.
Val explained the impact this development will have on traffic. Joe
felt it would not be a major impact and should not be a concern. These
figures from the Highway Department come from over a four year period
and he felt that was the best indication of the safety of the
intersection.
Jim stated that all of us would like to go back when there wasn't as
much growth or traffic. John Watson stated there a lot of safety
issues on other streets. He asked John Millar what is this street and
intersection designed for and is it at capacity? John stated that the
street is not even close to the capacity it is designed for.
Ted Whyte declared a conflict of interest.
Brenda Paredes - 63 r~h7eSt 1St South- Tho main road 1S SO busy and people
drive very fast. She is afraid when college kids will get in that part
of their park lot and will go through Tom Ricks" yard which is close to
her driveway. She asked if there was a way to keep them from going
through that way or if a stop light could be put: in there? She has
small children and is worried. John Millar told her a traffic light
might be nice but there isn't enough traffic to warrant a light. There
is a traffic light in the works on 1st West and Main. A traffic light
costs about $140,000. Jim asked about a 4-Way stop? John Millar told
him that was a council decision.

Pete Thompson- 135 South 1st West- He questioned the traffic figures
and maybe they are okay for the summer but not for the months that
college students are here. This does not tell you anything about the
traffic when college is in session. You have 11 huge apartments on
that street. These figures don't tell you anything as far as the
traffic flow on those blocks.
Ted Whyte stated that the study has been done over a 4 year period.
John Watson stated we can't hold up the project until college starts.
He felt comfortable relying on Joe Laird who is experienced with
traffic.
Kevin Taggart- Asked if the dance festival was on when the traffic
__ count was done? He explained why he chose this lot. This lot is in a
`, • location that you could walk to the store and to college. It is a
premium spot and an excellent location. You would not need to drive

anywhere. They will address the speed going in and out of the complex
with a speed bump or stop sign.
Brian Davidson- 57 West lst South- The traffic count has not taken into
account the college students. He stated he had nearly been hit three
times on Center and 1st South. Students will not walk even when they
are that close they will drive. .The driveway on 1st South would be
across from his house.
John Watson stated that we need to go by the criteria listed in our
ordinance and the concern he had was the traffic and he has heard from
the study and engineer that the road is not at capacity and will handle
more traffic. He made a motion to recommend to the city council that
this property be approved for a zone change as requested. Seconded by
Jim Long. Ted Whyte declared a conflict of interest and Mary Ann
Mounts abstained from voting because she was not at the last meeting to
hear the first part of the hearing. All Others Voting Aye
Jim Long stated that this is one of the better plans we have seen. Jim
then made a motion to recommend to the City Council to accept the plan
as drawn and approve the Conditional Use Permit contingent upon
departmental approval. Seconded by Davawn Beattie. Ted Whyte declared
a conflict of interest and Mary Ann Mounts abstained.
A motion was Wade by Mary Arn and seconded by Mike Thueson to adjourn.
