All aye. RE: SILVERTREE BUILDERS PLAN REVIEW FOR A OUTLET NORTH OF WALMART TOPIC: (500,94,,,WALMART,SILVERTREE,LANDSCAPE,HANDICAPPED,FIRE DEPT.) Troy Hastings of Silvertree Builders was present for plan review for a retail outlet north of Walmart. Joe indicated some changes such as landscape, handicapped ramp, manhole, and sprinkler in the building. Fire department indicated that a fire hydrant is required. RE: ERICKSON PUBLIC HEARING TOPIC: (500,94,,,IMPACT ZONE,PUBLIC HEARING,POLE LINE RD., COMPREHENSIVE PLAN,MINOR ARTERIAL) Public Hearing for a variance. .John Millar read the public hearing notice. Notice is hereby given that a Public Hearing was held before the Planning and Zoning Commission of the City of Rexburg, Idaho, Wednesday, July 8, 1998, at 7:15 P.M. in the City Council Chambers of the City Building at 12 North Center, Rexburg, Idaho, regarding proposed issuance of a Variance to provide as follows: It is being requested the following described property be granted a Variance for the setback required for minor arterial within the City Impact Zone to allow for the construction of an agricultural building. The property is located at 873 West 2000 South, Rexburg, in Madison County, Idaho which is located in the City Impact Zone, and legally described as follows. At such hearing the Planning and Zoning Commission will hear all persons and all abjections and recommendations relative to such proposed issuance of a Variance. • John Bagley of Teton West was representing Guy and Keith Erickson. He showed and explained a map of the purposed variance. He indicated that the surrounding homes and buildings are within the same distance or closer to the road than the proposed cellar.They would like to build 75' from the center line. (Discussion) Pole Line Road is on the Comprehensive Plan as a minor arterial. John Millar closed the Public Hearing for public discussion. Discussion by the commission on the widening of Pole Line Road for a minor arterial. The existing houses have set the existing setbacks at an average of about 60'. Motion was made by Doug Smith and seconded by Gary Steiner to pass the variance as requested. All Aye. Reasons for justification will be the existing established setbacks and existing houses & buildings. RE: LINDA EAMES FINAL PLOT PLAN FOR VALINDA TOWNHOUSES TOPIC: (500,95,,,6TH S.,EAMES*LINDA,FIRE DEPT.,PARKING,STREET DEPT.) Linda Eames final plot plan review for Vallinda Townhouses located on 6th South, Planned Development Unit. Linda showed the final plans for the purposed townhouse development. The department heads have reviewed the plans. Linda has talked to the Fire Marshall about the parking and he indicated that there cannot be any parking on the street, so signs will have to be installed indicating that, they also indicated that they would need a 28' wide radius at the end of the street to turn the fire trucks around. Jim Long asked about the enforcement of the parking regulations. {Discussion) The area will be includ~ad on the Local Improvement District for 1999, which includes sidewalks, curb and gutters. (Discussion on snow storage and removal) Snow removal will be taken care of by the owners of the property. Ted Whyte made the motion and Davawn seconded to approve the plans with the :indicated changes by the department heads, to include the sign for no on street parking. All Aye. RE: GENE PALMER/MARCEL BLUNK SUBDIVISION IN IMPACT ZONE TOPIC: (500,95,,,PALMER*GENE,MINOR ARTERIAL,SUBDIVISION, COMPREHENSIVE PLAN) Gene Palmer/ Marcel Blunk, presented a plan to change the minor arterial and reroute the road on North Hill Road. .john Millar declared a conflict of interest, Davawn Beattie acting chairman. John showed a photo of the route that Gene would like the road to take, the plans for the lots that would be used for residential dwellings. He explained the options that Gene and he put together on the map shown (on file). John explained the process for building the in the tow different locations, including the grade, excavation and difference in the effect. Gene indicated that would like the road to take the south route and for it to be changed to a residential collector road, rather than a minor arterial road. He feels that if this change was made then it would not impact the residents in that area as much and that it ,____ would be safer. (Discussion on drainage and moving the ditch) If the commission would permit Gene & Marcel to go ahead with the requested option, then they could develop a plan for the original subdivision. ~t~ The subdivision would have to meet all of the subdivision ordinance requirements. The road on the comprehensive plan map looks like it is almost the same as the one that Gene has purposed. (discussion) Stephen indicated that the procedure to change the purposed location on the road would be to have the finding of facts show that the south road alignment is not a significant change from the comprehensive plan map, then the comprehensive plan would not have to be amended. However to change it from a minor arterial to residential collector the commission would have to amend the comprehensive plan, which is a four hearing process, two at planning and zoning and two at county planning and zoning. Which the public hearing would be to address the change from minor arterial to a residential collector. So Gene / Marcel can go ahead with the original subdivision. Motion was made by John Watson and seconded by Jim Long the location of the southerly road alignment is not a significant change from the road shown on the comprehensive plan map therefore the comprehensive plan does not need to be amended and Gene & Marcel can proceed with the subdivision. All Aye. John Millar abstained due to conflict. Stephen explained that to proceed with their plans, Gene / Marcel will have to submit a request to change the minor arterial to a residential collector to down grade that road. That will start the hearing process. While in that hearing process, you will have to have plans showing the lot which you will want to sell. The committee then will have to vote to accept or reject the plans. The subdivision has to be lasted, it Can be plattcrl 1n phases. RE: APPROVAL OF A PLOT PLAN FOR THE AMBULANCE BUILDING TOPIC: (500,96,,,FIRE DEPT.,LANDSCAPING,CENTER ST.,AMBULANCE,PARKING) Approval of a plot plan for the ambulance building nenext to the fire department. John Watson declared conflict of interest. John showed the plot plan for the purposed building. The area is zoned C.B.D . This zone does not require landscaping or parking. Doug Smith moved Mike Thueson seconded to approve the plans as is. All Aye. RE: LARRY BEESLEY APPROVAL OF FINAL PLOT PLAN TOPIC: (500,96,,,BEESLEY*LARRY,5TH W.) Larry Beesley returned for his final plot plan approval for property on 5th West. Motion was made by Davawn Beattie and seconded by Doug Smith to accept the plot as shown. All Aye.
