RE: IMPOUND CAR LOT WITH SECURITY FENCE APPROVED TO~iC: ~5vn QC 'i~T h~ FENvF DCT.Tf'F RARNF.V*Tl. T_ ~ D. J. Barney was at the meeting. He has a business located at 410 West 1st North. He is going to build a fence 50' x 70'. He wants to build a secure fence,. 6' industrial chain link fence and he would like to put three strands of barb wire on the top of the chain link. He needs it for an Impound lot. In talking to the State Police, they prefer the barb wire or he would have to go to an 8 foot fence. The cost between the 6' and the. 8' chain link fence is considerably more plus at a future date he would like to get slates. to go through the chain link so you couldn't see inside of it. Stephen explained the City of Rexburg have gotten out of the business of impounding cars and rely on private enterprise to come tow and impound cars. He would use if for some other storage but mostly for the impound cars. He would have too much liability if he impounds cars and they are parked in an open storage area. He would do impound for the City, County, and State. Stephen told them part of the city's hesitation. in using him for impounded cars was that he did not have a secure parking lot. If the police request the impound and he impounds them in an open lot, his liability becomes the City's. The police department would endorse this type of fence if they use him for impound. This will be a fence within a fence. Stephen stated the law enforcement standard is it has to be a licensed garage capable. of securing the vehicle. There are different levels. For just a standard accident where this is not a potential investigation into the cause such as a D.U.I. anyone can tow the cars. If there is any possibility that we are going to want to come back at a later date for evidence extraction purpose then it has to go into the higher grade of storage so they have reasonable assurance it has not been tampered with. D.J. said he would not keep them in the lot very long.. A motion was made by Davawn Beattie and seconded by Doug Smith to allow the secure fence with barb wire on the top. Mike asked if we need to require screening. Stephen told him we have no authority to require screening. All Voting Aye to the motion. RE: REQUEST FOR ZONE CHANGE ON 3RD EAST REJECTED TOPIC: (500,86,,,ZONE CHANGE,3RD E.,2ND N.) Joe explained that Mary Carter has asked him about changing the zoning to a professional office overlay for 204 North 3rd East, on the corner of 2nd North and 3rd East. They are interested in acquiring that property. She knew there were doctor's offices on the east and they would like a professional office overlay to allow a dentist's office on that corner. John stated after the council had the Public Hearing last week to change the zoning in that area, he did not think the council would agree to this. Stephen stated the council's vote was more of a vote of support of Planning & Zoning rather than a vote of apprcval. Stephen stated it would be commercialization of something we defended narrowly of Medium Density Residential. Bruce did not feel that the council would approve it. Stephen told Joe to tell her it is too similar to the discussion that took place last week at the Public Hearing and the Planning & Zoning did not think it worthy of going to Public Hearing. A motion was made by Davawn Beattie and seconded by Jim to adjourn. All Aye
