HANCOCK REQUEST FOR C.U.P. AND VARIANCE TOPIC: (500,64,,,C.U.P.,VARIANCE,HANCOCK*J.D.,1ST N.,SETBACKS, PUBLIC HEARING) A motion was made by Davawn Beattie and seconded by Jim Long to approve the minutes of March 25, 1998. All Aye (~~ J. D. Hancock was at the meeting to request a Conditional Use Permit and a Variance for some property at about 58 1/2 West 1st North. He passed some photos around (on file). He has purchased the property next to Brittney Apartments formally owned by Helen Higley and a piece owned by Cora Nelson. He wanted to put a Duplex in the back to match with the four plex he has on the adjoining lot. He had checked and some houses and sheds on the block do not meet the setback requirement. The lot formally .owned by Cora Nelson had a small .house on it before the flood. After the flood she put a small single wide trailer on the lot, which has been moved off. He would like to put the Duplex on the back lot where the Nelson trailer was and extend over to part of his lot that was owned by Higley and the lot he owns behind Brittney apartments. The lots in the back would be 82' X_ 165'. (discussion) Discussion on lot sizes. The Nelson trailer was on a substandard lot size and there would be a grandfathering condition with this lot. John Millar stated that we are required to allow a single family structure to go on that lot. (discussion) J. D. said he would re-figure the lots and the committee could discuss it further later in the meeting. RE: VALERIE HULL REQUEST FOR ZONE CHANGE TOPIC: (500,64,,,PUBLIC HEARING,4TH W.,1ST N.,2ND N., ZONING CHANGE,SUBDIVISION,SEWER) • • Valerie Hull, Century 21- Was at the meeting to discuss an Initial Sketch plat on North 4th West between 1st North and 2nd North. (copy on file) She would like to have the property rezoned to LDR2 to allow ,`,~; ~`~ for 6000 foot lots. Ted Whyte declared a conflict of interest. They would like to be able to put in a 30 foot wide private drive into the lots. Ted stated that when the new zoning ordinance was done it had been zoned R3 and was changed to LDR1 and he felt it had been down-zoned. (discussion) It would require curb, gutter and sidewalk across 4th West. Joe explained they would have to run sewer to the property. It would also require a subdivision plat where they would be breaking it into three or more lots. This would be a spot zone. A motion was made by Mary Ann Mounts to go to Public Hearing to change the zone from LDR1 to LDR2. Seconded by Mike Thueson. All Aye except Ted Whyte who abstained from voting. RE: PLAN REVIEW FOR ALAN BATT APARTMENTS TOPIC: (500,65,,,PLAN REVIEW,APARTMENTS,BATT*ALAN,PARKING,5TH S.,2ND W.,3RD W.) A plat for Alan Batt Apartments Site Plan was presented by Joe. The apartment would be located on 5th south between 2nd and 3rd West. There would be three apartment buildings with 28 to 30 students in each apartment. They will need 61 parking places and have a total of 70. He showed the places set aside for garbage containers. They are back the 25' from the right-a-way line. They will put in a 6' high, either solid wood, concrete block, or new plastic covered steel fence that is solid at the back of the parking lot. This would take care of the screening requirement in our ordinance. Joe said he could not see any t\• problems with the plan, it meets all of the ordinance requirements. A motion was made by Davawn Beattie to accept the final site plan as drawn contingent upon the signatures of the department heads. Seconded by Ted Whyte. All aye RE: J.D. HANCOCK CONTINUED TOPIC: (500,65,,,HANCOCK*J.D.,SETBACK,PUBLIC HEARING) J. D. Hancock stated he had done some modifications on his plan. He showed the plan. Showing the substandard lot, going back 15 feet, the front lot would be 8062 feet and the back substandard lot would be 5050 feet. He would need a conditional use permit for a duplex. The setbacks and substandard lot would be grandfathered. The lots would not change except to increase the substandard lot. A motion was made by Jim Long and seconded by Davawn Beattie to go to Public Hearing for a C.U.P. fcr a duplex in L.D.R.1. All Aye RE: JOE LAIRD REQUEST FOR C.U.P. FOR DUPLEX TOPIC: (500,65,,,1ST N,SIDEWALK,LAIRD*JOE,PARKING,C.U.P.) Conditional Use Permit for Joe Laird for a Duplex at 514 East 1st North. We have had one request from the neighbors. (copy attached) Roger Muir and Ted Whyte declared a conflict of interest. Discussion on the conditions recommended by the neighbors. John Millar'stated that there would need to be sidewalks put in. A motion was made by Jim • Long (1) That they be required to put sidewalk, curb & gutter in as far as practically useful as determined by John Millar and Stephen. (They will go to the site and determine a reasonable amount of curb & gutter and sidewalk would be.) (2) That they have not more than 4 visible cars r ~~~~ parked in the allowed parking. (3) That-they will not be allowed to add or build any expansion onto the house. (4) That they will not be allowed to build any accessory storage building any larger than 10' x 10'. Motion seconded by John Watson. All Aye except Ted Whyte and Roger Muir who abstained. A motion was made by Mike Thueson that we issue the Conditional Use Permit with the above listed conditions. Seconded by Doug Smith. All Aye RE: TED GARNER REQUEST FOR ZONE CHANGE TOPIC: (500,66,,,ZONE CHANGE,GARNER*TED,PUBLIC HEARING,3RD E.) Ted and Edna Garner were at the meeting to discuss the zoning of their property South of the Canal on North 3rd East and extending back into the block. The zoning of that property was changed to L.D.R.1 when we adopted our ordinance in 1991. The old ordinance showed it was zoned R2. It was felt that this property is landlocked as it is zoned. (discussion) A motion was made by Dough Smith and seconded by Jim Long that we go to public hearing to changed the zoning from L.D.R.1 to M.D.R. Seconded by Jim Long. All Aye Meeting Adjourned. •
