A motion was made by Ted Whyte and seconded by Mary Ann Mounts to approve the minutes of May 14, 1997. All Aye RE: DR. CRAIG HEINER PARKING PLAN TOPIC: (400,207,,,HEINER*DR. CRAIG,PARKING,RIGHT-OF-WAY) Dr Craig Heiner parking plan. Dr Heiner was not at the meeting, Joe explained the plan. He showed the existing parking. He is proposing to expand the parking lot to the east side and bringing parking stalls over closer to the sidewalk along Harvard. The right-a-way line should be right on the back of the sidewalk on Harvard. The right-a-way on Main Street is about 7 feet behind the sidewalk. He will leave the big trees there. There is a 25 foot set back in this LDR1 Zone with a Professional Office overlay and it would bring it over to where he shows the backs of the parking spots. He would need a variance for the parking on the East both off of Main Street and Harvard. He would also exceed the 30~ asphalt in a Residential Zone. This would not conform with the ordinance so it would require a variance. (discussion) A motion was made by Richard Smith and Seconded by Doug Smith that we go to Public Hearing to address the parking in the set back and using more than 30~ of the front yard for parking. He could draw his plans to meet the requires set in the ordinance. All Aye RE: WESTERN RECYCLING WAREHOUSE TOPIC: (400,207,,,WESTERN RECYCLING WAREHOUSE,RECYCYLING,IST EAST) Stan May representing Western Recycling Warehouse on Lot 1 Block 15 at about 345 North 1st East. It is zoned Industrial. There is one building on the property that sets low, but the property he wants to build the building on has been raised up 5' to 6' elevation. The building would be 100' x 60' and would have a drive through entrance. (showing entrance and exit to the street on plan and explaining) There would be a loading dock. He wants to expand his operation and do the processing at this location. There will be enough room for parking and at least 20' minimum front yard or in line with other buildings. John s n ~J !~~ o Millar told him he would need to bring in a site plan and a copy of the easements. RE: EDWARD E JONES TOPIC: (400,208,,,EDWARD E JONES,HART*STEVEN,SIGN) Edward E Jones Sign- Steve Hart was at the meeting to explain that they want to put two signs on the property instead of one. The property is zoned Residential, but the building has been on the property for a long time and what is there is grandfathered. They had let Edward E Jones put his sign up until the owner Steve Hart wanted to put up a sign. Mr Hart needed to put up a sign now which would make two signs on the property. .One sign would be a monument sign. A motion was made by Davawn Beattie and seconded by Mary Ann Mounts to set a public hearing for a Variance to allow another sign on this property. RE: DR ROBERT WALKER MADISON PROFESSIONAL PARK TOPIC: (400,208,,,WALKER*DR. ROBERT,STEVENS*BART, MADISON PROFESSIONAL PARK) Bart Stevens was at the meeting to show the revised plans for Dr Robert Walker in the Madison Professional Park that had previously been approved. It has an unfinished basement and he wants to finish it and rent it to a Physical Therapist. He wants to put parking down the side of the building; with eight parking stalls. There is an overhead power line so because of that Dr Crouch had to make the lot next to it really small. Bart explained the parking. He handed out copies of plan and showed pictures. Dr Walker's building has 3500 square feet on the main floor and 1800 feet in the basement which will be finished for the therapist. Jim questioned the paving, saying there is too much asphalt. (discussion) Jim wanted to see copies of the minutes and a copy of the plan for Madison Professional Park (also any protective covenants). Bart explained that there is 9000 square feet of landscaping. Jim stated he sold the concept of this to the neighborhood on the concept that it would not be a massive parking lot and that is what it is becoming. Mary Ann stated he remembered that it was to be a nice residential area with a professional office overlay and there was suppose to be low volume traffic type businesses, not necessarily all Doctors. This was important to that neighborhood to maintain the residential atmosphere and all of a sudden we are putting in some huge buildings and that is how you determine how much parking you need. (discussion) John Millar stated that the idea was to have low volume and low use. A motion was made by Jim Long that we need to go to an informal Public Hearing for the neighborhood. Seconded by Richard Smith. Dr Crouch needs to know we are concerned about this development. All Aye (After meeting Dr Walker came to city hall and told Rose he was not going to put the extra parking in but instead put lawn in.) RE: FENCES TOPIC: (400,208,,,FENCES) Discussion on fences and amending the ordinance. It was recommended that we table it to another meeting. ~~~ RE: APPROVAL OF ALL DEPARTMENT HEADS FOR COMMERICAL DEVELOPMENT TOPIC: (400,209,,,DEPARTMENT HEADS,PLAN APPROVAL,SITE PLANS) Discussion on having signatures of all department heads on all plans to sign off on them. Discussion on the method and time frame of other cities. We have a stamp for approval of all department heads already. A motion was made by Richard Smith that we adopt a policy that all site plans be required to be approved by all departments as well as the engineer and the approval be stamped on the plan prior to submission to the Planning & Zoning. Seconded by Davawn Beattie. They can bring the plans to Planning and Zoning for recommendations of the plan but not a final approval without it being signed off on by department heads and the engineer. All aye to the motion. RE: WILCOX FRESH PACK TOPIC: (400,209,,,WILCOX*LYNN,WILCOX FRESH PACK,SIDDOWAY*THANE, COMPREHENSIVE PLAN, ANNEXATIONS,REZONING) Continuance of Public Hearing for the Zone Change for Wilcox. John Millar declared a conflict of interest and asked Mary Ann Mounts to chair the issue. Mary Ann reopened the Hearing and asked all those speaking to limit their comments to 4 minutes. Mary Ann asked Mr Wilcox to speak first and limit his comments to 4 minutes and then we would give him a chance to rebut. Lynn Wilcox- They are planning a buffer zone on the south side of the property. They have tried to meet the concerns of Idaho Potato Seed and would like to meet an agreement with Mr Siddaway and protect his interest. They feel like the traffic problems have been addressed and they feel that the type of business along that interchange has also been addressed. They have tried to address the concerns of anyone who had a reasonable objection. Commissioner Smith had objected because we have too many of this type of facility already, but we also have too many convient store and other like facilities. They feel it is a good project and will add to the economic base to the community. They feel they have addressed all the economic and environmental concerns. They have done the best with this council's and engineers guidance. It has been designed to meet all of D.E.Q. requirements.- Because D.E.Q. has requested a site plan and recommends that it be annexed and be hooked onto city water and sewer, we are requesting annexation and that the front four lots be zoned H.B.D. and the back of the property be zoned light Industrial. (Everyone had received another letter from Mr Siddaway prior to the meeting which will be entered as testimony.) Mr Siddaway- He appreciated Mr Wilcox being willing to put a buffer zone in between his property and Mr Siddaway's property. He also appreciated his willingness to work with him. That is his second choice, his first choice is that it not be there at all. 2~b ` ~ Chuck Homer., Attorney - He stated that he was representing High Country Potato. They had some questions about .the procedure that has been followed.. As near as he can determine is that it is in the Impact Zone. This means that the county have turned over all the issues pertaining to the Comprehensive Plan. As near as he can tell in the City's comprehensive plan it does not deal with this problem. The Idaho Land Use Plan specifically says you can't do zoning until you first have a plan. In his opinion before this board or the city council can go forward with the rezoning request, they have to be sure the Comprehensive Plan covers the property and the rezoning request is in compliance with the plan. John Millar asked if we annexed the property first if it would take care of that issue? Mr Homer stated only if you amend the plan prior to the annexation and zoning. He explained finding the direction the city wants to go in zoning this property and procedures that need to be followed. He stated that the city would have more control of the development if it were annexed and other procedure issues. He explained how High Country Potato is concerned about the area and have tried to make their operation nice with a buffer zone. In there opinion they don't want Light Industrial out there because that is one of the main entrances into the city. That is the first thing people see and will affect how people access your city depending on what you have there. It is his understanding there is already a severe traffic problem there. If you put in Light Industrial you will have more and more truck traffic. Truck traffic is a bigger problem than passenger cars. There is no place for trucks to turn around on that small piece of road unless they turn into High Country Potato parking lot and turn around. It should be a concern of all the businesses coming into town and along the old highway. They will bypass that part of town. Again talking about procedures. Mary Ann told him we are in the process of doing a new Comprehensive Plan. Stephen told him if the Comprehensive Plan does not address this parcel of property it probably did not address his client's property. Mr Homer again addressed procedures. Stephen told him if our Comprehensive Plan does not cover this, the County's Comprehensive Plan would. We are the administrative body but it makes us subject to the county approval. Mr Wilcox is no longer interested in just rezoning the property, he has requested annexation. It has been the policy of the city to -amend the Comprehensive Plan and rezone the property when they annex it into the city when the Public Hearing is held. Tonight we are looking for some direction on the annexation and possible zoning it should be brought in under. Dan Bowen- He is in favor of anything to enhance the entrance and beauty of the city or any other place in the city. He questioned, as he drove by the site tonight, he noticed that there was big equipment .there and a lot of excavation had been done. He wondered if that was 9normal and acceptable procedure prior to receiving approval? Stephen told him we have no control of excavation and site preparation. If they start to do any construction of a building then they have to have a building permit. Mr Bowen stated that there probably has been a fair amount of money spent and would that have any affect on the decision in favor or in opposition? Mary Ann told him it would not. He explained that he had a concern about 1500 South road exit. When they put in the ~,~ ~ ," Chevron One Stop, they had an approval of another cut into the property and then it was withdrawn, so they don't have room in there to turn big trucks around, so they can't facilitate them. There are times when the cross arms are down at the railway crossing, and the traffic will be backed up to the highway so people can't get in or out of their facility. Their concern is with another entrance in with heavy trucks we may have some difficulty keeping people flowing in and out of their business. He asked this board to consider that. Val Dietrich- Speaking as a concerned citizen for making the city beautiful. Rexburg is a growing community. He had no problem with a Fresh Pack Plant. He would like to see something go in there that would be an asset as an entrance way for Ricks College and the City. A Fresh Pack is not that much of a drawing card. He asked that they make a decision for the future and future growth and make the entrance of the city beautiful. He felt there was a better use of the property. He would like to stand up against this. We need to bring people in and not stop them. Lynn Wilcox- He found the position of High Country Potato somewhat amusing. Richard discussed the property and annexation and holding a Public Hearing and if we wanted the entrance to the city zoned Industrial. John Millar stated that we could have an annexation hearing at the second meeting in June. Discussion on the voting for annexation and zoning. Richard asked if we make a recommendation to go to public hearing for annexation, does everyone feel comfortable annexing, amending the Comprehensive Plan and zoning all together? Stephen stated that certain parcels can demand annexation. This parcel would be large enough. Anything under 5 acres can demand annexation if they are contiguous. We have to show a cause why we won't annex them. Mary Ann closed the hearing. A motion was made by Jim Long to recommend a Public Hearing for Annexation, modify the Comprehensive Plan and rezone the property. Seconded by John Watson. John Millar declared a conflict of interest. All Others Voting Aye RE: FENCE FOR WATER DEPARTMENT TOPIC: (400,211,,,WATER DEPT.,WATER TANKS,FENCES) Fence for Water Department- Stephen explained. The water department have several water facilities located through out the city. Recently we have been having problems with individuals getting inside those facilities and vandalizing those facilities. Because of the high impact of the vandalism to the water supply in Rexburg could have on the over all community, the City of Rexburg is requesting that you give them permission to allow them to put barbwire around the top of all the fences around the city water facilities similar to the one at the jail. This request is for public safety. We have three tanks the elevated tank, the green tank and the one by Walmart. A motion was ~" made by Davawn and seconded by Mary Ann to allow this wire to be put on top of the fences. All Aye. RE: BEAUTIFY THE ENTRANCE TO THE CITY TOPIC: (400,212, „ MERRILL~GLADE,CITY ENTRANCES,EXITS,CITY WATER, RICKS COLLEGE,LANDSCAPING) Marsha reported that Glade Merrill has taken it upon himself to organize to beautify the entrance to the entrances and exits to the city. The College will supervise the landscaping and churches and civic groups will help. The city will supply the water access to them. Meeting adjourned. [7 •
