All Aye RE: C.U.P. FOR LAMONT MERRILL PROPERTY 249 W 3RD N, DISCUSSED TOPIC: (400,118,,,C.U.P.,MERRILL*LAMONT,3RD NORTH,LOT SIZE) • Lamont Merrill was at the meeting to discuss property on 249 West 3rd North. He had made an application for a Conditional Use Permit. John Millar declared a conflict of interest. He showed map of the property • which is 165' x 165'. Joe asked him if he had acquired the Gough property next to his? Lamont explained where the property is, which he bought in 1986 and planned to put four plex on the property, but now the zoning has been changed so he lost out on building them. A few years ago he built a little house on half of this property. Against this house the property is 82 1/2' x 165'. He needed now to do something with the rest of the property. He could build another house on the property, but he has asked for a Conditional Use Permit to put a duplex in the LDR 1 Zoning. There is a 30' easement along that street. When he does something with the property it will land lock all of the property in the back of the block. This is the last existing entrance into that property. If he bought the property from Gough which is 41' he could incorporate it into his property and see if he could build two duplex on the property. He had talked to Rick Birch and asked him if he owned the property adjacent to his and he said he did. Lamont asked Mr Birch about buying the property. If he bought the Birch property, he would put a private roadway into that property which is 82 1/2' x 165'. Donald Jensen owns some property back in the block also and Lamont asked him what he is planning to do with that property. Mr Jensen told him he would like to do something with it but he does not have any access to the property. Bigler's also owns property back in the lot, however Lamont has not talked to him. Bigler's property is before you get to Donal Jensens. Donald said he did not want to sell it, he wanted to develo e it himself. If Lamont doesn't make somekind of an access to the ba k of the block then all the development will be dead. (discussion) T e lot sizes would be 82 • 1/2' x 82 1/2' with a private road right out of the middle of them. Joe said it would not be big enough to meet he requirements. Birch's ~r property is 82 1/2' x 165' and there is a lot 82 1/2' x 82 1/2' behind the rental home Lamont has built. He would like to buy Gough property and put two duplex on those two lots, one behind his rental house, and two on the Birch's property, if there is enough property. They would be rental units. He also stated that would get us out of a lot size and into living unit density. John Millar stated the property is zoned LDR1, which allows a duplex under a conditional use permit. The question is can you do more than one duplex on one piece of property or does it have to go a zone change to M.D.R. which would allow them more than one duplex on a piece of property as a development? Stephen stated that you can't be categorized by both, you have to be a duplex or an apartment. You can't take advantage of the backyard and sideyard setbacks without an apartment. John stated that an M.D.R. would allow five and six units under a conditional permit. You could build three buildings under M.D.R. (discussion) RE: RECOMMENDATION FOR PUBLIC HEARING FOR REZONING BLOCK 12; LAMONT MERRILL PROPERTY TOPIC: (400,119,,,PUBLIC HEARINGS,MERRILL*LAMONT,ZONE CHANGE, 3RD NORTH) A motion was made by Doug Smith to recommend that we go to a Public Hearing for a rezone of the entire block to M.D.R. for block 12. (after discussion) motion was made by Mike Thueson. Those voting nay, Mary Ann and Jim, all others voting aye except John Millar who abstained. Motion carried. RE: RECOMMENDATION FOR PUBLIC HEARING FOR C.U.P. FOR LAMONT MERRILL FROPERTY TOPIC: (400,119,,,PUBLIC HEARINGS,C.U.P.,MERRILL*LAMONT) A motion was made by Mary Ann to recommend going to Public Hearing for a Conditional Use Permit, seconded by Jim Long. All Aye except John Millar who abstained. Motion carried. At 8:00 P. M. Mary Ann and Doug left the meeting for other obligations. RE: UPDATED PLAN FOR THE DONEGAL APARTMENTS ON 5TH S. TOPIC:. (400,119,,,DONEGAL APARTMENTS,5TH SOUTH,5TH WEST,4TH WEST) Joe showed the board an updated plan for the Donegal Apartments on 5th South between 5th West and 4th West. It is the block west of Brenchley Apartments, south of 5th south. Planning & Zoning approved the layout plan about two years ago. They will have two phases of this complex. This is the first phase on the West side. He explained and showed the plans. It is for a 32 unit non subsidized housing unit. All department heads have approve the plan. Roger asked about the Bagelby Sign? He asked about the propane tank at the car wash. It looked like it was on the property line. Dee Owen from the fire department explained what inspections the Fire Department had done. He came to City Council about this and was told to talk to_ the Highway Department because it is a state highway. If it is on the Highway right-a-way, it is up to them.
