All Aye RE: REQUEST FOR. ZONE CHANGE, 5TH W. & 2ND S. - MIKE FERGUSON TOPIC: (400,113,,,ZONE CHANGE,FERGUSON*MIKE,5TH WEST,2ND SOUTH} Request for a zone change on 5th West and 2nd South. Val Dietrict was at the meeting representing Mike Ferguson. He ask for a zone change on • the east side of his property behind the old Block Plant. He would possibly like it rezoned to HDR. He is thinking about putting some homes in for young marrieds. That piece of property is 4 1/2 acres, it is in the South East corner of the block. He just wants to change the back part of the property. A motion was made by Mary Ann Mounts that it be set for Public Hearing, seconded by Jim Long. All Aye RE: SCHOOL DISTRICT C.U.P. APPLICATION FOR RESERVE BUILDING TOPIC: (400,113,,,MADISON SCHOOL DISTRICT,C.U.P.,CENTRAL HIGH SCHOOL) We have an application from the School District for a Conditional Use Permit for the old Reserve Building on South 2nd East for the Central High School. A motion was made by Mary Ann Mounts and seconded by Doug Smith to set this for public hearing. All Aye RE: ZONING ORDINANCE MODIFICATIONS TOPIC: (400,113,,,ZONING ORDINANCE,PARKING,NURSING HOMES,DRAINAGE, STORM DRAINAGE,ANIMALS,"O" LOT LINE,SIGN ORDINANCE) John Millar told the group we have some ordinance modifications we need to either discuss or act on. One item is the Parking Requirements for a nursing home. Another we need to address is developing a drainage ordinance. An ordinance that defines what developers have to do with their storm drainage. It would also set up fees, rules and regulations that govern how storm drainage is handled. That is probably something that would have to come from the council down to this group to work on, but is there a need to do this? John Watson stated that is a problem he runs into all the time. He has to use a french drain on site because he cannot get into the city system. John Watson felt there l <<f should be somekind of an ordinance on newly developed property. The • city needs to deal with existing problems another way. It is something that needs to be looked at as the area continues to grow up on the hill. The storm drainage system was put in as a result of the T.D.R.O. after the Teton Dam Flood. They put in a 14" line but it surcharges at least twice a year now. John Watson suggested that the city needs to find a way to upgrade their storm drainage system. (discussion) We need to let the council know of our concern and they can talk it over and see if they want Planning & Zoning to work on it or how they want this board to be involved. Jim suggested that we might check ordinances from other cities. The next item that needs to be changed in the Zoning Ordinance is the definition of animals you can have on site. At the meeting on July 10 we did not have a quorum but a recommendation was made "Household Pets- to allow 5 mammals and direct off spring which can't exceed that number for more than 3 months". Stephen also suggested changes in the "O' Lot line but had left that meeting prior to discussion so that needs to be addressed. The other recommendation was on the sign ordinance. Billboard- Non Accessory Signs- A recommendation to delete "Billboard" Non Accessory Signs Off Premise (Free Standing) add to 24 sq. ft. or None above building height except by C.U.P. There is an error on Copy Area, it needs to be 100. The other one is in all areas, adding to • allow all Non Commercial Directional Signs within the Public right-a-way. Instead of entering it in every table, to just enter it in as a line item. Just put a * behind Directional signs in all areas and bring it down and say, "Nor. Commercial Directional Signs allowed in the public right-a-way with a Conditional Use Permit" no more than 6 square feet. Sub referenced under Section 15.01. (footnote) Stephen suggested that we add to that these Directional Signs be allowed with the approval of adjacent property owners on the same side of the street. A motion was made by Jim Long to recommend to the City Council that we make these changes in the Zoning Ordinance and in the Sign Ordinance as addressed in the work meeting on July 10 which were listed above and add the recommendation by Stephen to have the approval of adjacent property owners on the same side of the street for Non Commercial directional signs, seconded by Davawn Beattie. A11 Aye RE: VARIANCE GRANTED TO HOMESTEAD - 5TH WEST & MAIN STREET TOPIC: {400,114,,,VARIANCES,HOMESTEAD CONSTRUCTION,MAIN STREET, 5TH WEST,FRONT YARD,PUBLIC HEARINGS) 7:30 P.M. Public Hearing for the issuance of a variance to provide that the owners of the property on 5th West and Main Street allowing for more than 30~ concrete in the front yard of the Townhouse properties. The property is currently within a MDR zone, and has been granted a "Zero Lot-Line" conditional use permit. Ted Whyte declared a conflict of interest. He acted as spokesman for the owners of the property on 5th West and Main. Ted stated that they have a conditional use permit to build the units but they exceed the • front yard minimums for concrete and hard surface driveways and what they have to do now is have an hour glass shape and cut it down to to 10 or 12 feet wide coming in from a 20 foot garage door. They have to narrow down and come into a 10 foot. There are two or three things that are a problem, that is an extremely busy street and you will have people backing out 50 feet onto 5th West in order to get out of their driveways. By narrowing the driveways down you create a traffic and a safety problem rather allowing them to go straight on out as this plan shows. It is also hard to match up with the three big power poles out in front because of site problems. Because of safety and esthetics, it makes more sense to get a variance than to come in with a ten foot driveway and then into a 20 foot garage which is approved on an alternate plan. (discussion) Public comment. Loretta Whitworth- She is in favor of granting the variance. She plans on purchasing one of the units. Gerald Nyborg- They are interested in this property. They are in favor of a variance. In listening to the discussion, when you drive out of the garage you will have to cut over to miss the sprinkling system plus you will. have to watch the on street parking. The school is just down the street making it quite congested. They would like the opportunity to pass through cars in the driveway without having to back out into ,.' • the street. It seems impractical to have a two car garage with a one car driveway. Stephen Zollinger- He has a one car driveway that flares to a two car driveway at the house and it is hard to not miss it. The adjustment is not easy coming backwards out of the garage. (discussion) Richard stated that we did approve the town houses there and one thing we possibly did over look if we are going to allow this type of building, maybe we should look at changing the 30~ requirement for paving for those type of buildings. Discussion on the twin homes in Summerwood are worse because of the cul-de-sac. Jim stated that these homes on 5th West & Main have more open space than the single lot homes in a subdivision because of the public right-a-way. He felt that if they build in an area like this with a wide parkway, we could accept a lessor percentage. Ted pointed out that it is a safety problem all the way around. They will be con concentrating on staying on the driveway and not see the kids going to school. A motion was made by Jim Long that we grant the variance and accept this plan based upon a safety issue with the children walking to school. Seconded by Davawn. Those voting aye, all except Ted who abstained. is i• //l~ • RE: FRONT YARDS FOR TWIN HOMES ADDRESSED TOPIC: (400,116,,,FRONT YARD,TWIN HOMES,"O" LOT LINES) Ted suggested we still need to address the front yard situation for the twin home construction. Davawn felt the 30~ number is a good number to work from, but we need some leadway to work out a situation like this. John Millar suggested that instead of putting it so they have to do it as a variance tie it to a conditional use so that can be with the approval of the zero lot line. Most lots don't have that setback. Richard suggested that we could include the language that 30~ of that being the front yard plus the public right-a-way that is landscaped. (discussion) Stephen explained what it would take is to amend the Zero Lot Line to allow that front yard configuration can vary with conditional use approval of Planning & Zoning. A motion was made by Mike to have Stephen draft an amendment to this ordinance for the review of this board at the next meeting regarding the 30~ of concrete in the front yard for "0" lot lines affecting townhouses. (Stephen also explained that the driveways to the town houses in the Summerwood Addition are in violation. There is never anything in the minutes saying they could do it that way, they just went ahead and did it that way). All Aye except Davawn was gone from the room when the voting was done.. ~ RE: DISCUSSION ON TOWNHOUSE IN SUMMERWOOD SUBDIVISION • ~' TOPIC: (400,116,,,TOWNHOUSES,SUMMERWOOD SUBDIVISION) Discussion on townhouses in Summerwood subdivision & withholding Certificate of Occupancy on unclear matters that are in the ordinance. Stephen stated if the ordinance is unclear legally it would be hard to withhold the Certificate of Occupancy.) Richard stated two years ago we were going to put right on the face of the building permit, "You will comply with every one of the .building and zoning ordinances irrespective.". RE: COMPREHENSIVE PLAN TOPIC: (400,116,,,COMPREHENSIVE PLAN) ReNee discussed the Comprehensive Plan. Citizens participation program. Commissions ideas. Goal for citizen participation program. Ideas- Goals - Program. Back ground studies. Design Citizens participation process. Focus Question- What do you want the new Comprehensive plan to tell you?
