Muir Mary Ann Mounts City Clerk: Rose Bagley Attorney: Stephen Zollinger Engineer: Joe Laird A motion was made by Doug Smith and seconded by Mike Thueson to approve the minutes of May 22. All Aye RE: PARK PLACE VARIANCE PAVING - MOTION PASSED WITH RECOMMENDATIONS TOPIC: (400,94,,,PARK PLACE APARTMENTS,PAVING,LANDSCAPING,VARIANCES) Discussion on the Park Place variance paving. Marsha stated that he would be willing to put landscaping between the sidewalk and the curb. She also told the board, she was aver by there recently and saw that they don't have room to pull out of the parking area they have paved especially with the sign that is there. (discussion) Stephen suggested that if the board requires the landscaping to go in, that they require it to be put in so they can't drive over the curb. Randy's biggest frustration at this point is he tried to do something which cured an eyesore. No one was willing to maintain that front area and they thought paving was a good solution to an unmaintainable eyesore. (discussion) Stephen stated that legally he could justify leaving the parking or taking the parking out and just putting in landscaping between the curb and sidewalk without setting a precedence. A motion was made by Davawn Beattie that we recommend they remove the blacktop from the curb to the sidewalk and replace it with a green area of lawn and trees and suggest that they move the sign to allow easier access to the parking area. (discussion) Seconded by Ted Whyte. All Aye A motion was made by Davawn to direct Stephen to draw up a Finding of Fact for the variance. Seconded by Mike. All Aye RE: CAL RANCH FENCE - BARBED WIRE APPROVED TOPIC: (400,94,,,CAL RANCH,FENCES) Greg Hostert representing Ormond Builders was at the meeting to discuss the fence at Cai Stores. Currently their compound has fenced storage all to the east of the building. They have property to the north and are extending the fence. Some of the storage on the east is being removed and made into a parking lot and that fence is coming down and. will be relocated around the north part of the store. The existing ~~` ~'` fence is an industrial chain link fence with three barb wire prongs on the top. They want to keep the barb wire across the top for security reasons on the north part that has been added. John reminded the board that barb wire fence has to be approved by Planning & Zoning. A motion was made by Mike Thueson and seconded by Doug Smith to approve the fence. {Mary Ann arrived part way through this discussion so she abstained) All others voting aye RE: SIGN ORDINANCE - RANDY LANDON LAUNDRY 2ND EAST TOPIC: (400,95,,,SIGN ORDINANCE,SIGNS,LANDON*RANDY,2ND EAST,AWNINGS) Sign Ordinance. Discussion on the sign at Bagelbys. They then discussed the sign for the new laundry that Randy Landon is putting in. Rose told them Randy had decided not to come in to P&Z because he would be in compliance with the ordinance. This Laundry will be put in the old Birch Building which is existing and next to the Porter Building on 2nd East. He also has an existing awning. Joe said he can't put the sign there because his building overhangs over the right-a-way. Stephen. explained he has not increased his over hang. Joe told him it would be a new sign and a bigger sign on the building and he wants to put it on the awning. Stephen disagreed, he did not believe that painting an advertisement on the side of your building when the structure exists, is in conflict with the ordinance. Joe stated the awning is up higher. Stephen told him it still complies with our ordinance and his awning is grandfathered. The awning is legal because it is grandfathered. Does the sign itself conflict with the ordinance? The purpose of the sign is for advertisement. The primary purpose of the awning is not to advertise this business. It serves as a new roof. The fact that it gives them more surface on which to advertise, is a grave consequence for them. Signs painted on a building are not a structural item. (Stephen explained further to Joe.) After much discussion John Millar suggested that everyone read through the Sign Ordinance and make any recommendation on their ordinance and give them to Rose to give to Stephen for him to revise the ordinance and table it to the work meeting on July 10. Ted asked if we could do anything about the Pawn Shop cleaning up their property. Meeting adjourned. •
