A motion was made by Davawn Beattie and seconded by Jim Long to approve the minutes of 3/13/96. A11 Aye RE: COMPREHENSIVE PLAN PROPOSAL OF RENEE MAGEE5 ACCEPTED BY P & Z TOPIC: (400,72,,,RENEE*MAGEE,COMPREHENSIVE PLAN) Renee Magee gave her proposal for the Comprehensive Plan. She talked to Terri Ottens and it appears that they both have the same problem in that neither one of them are available to do leg work. Renee's first priority is Idaho Fa11s. (gave members a handout) She went through her original proposal and came up with $200 more in costs. She would subcontract out to someone else the leg work. It would be to someone else that does data collection and analysis, who goes to the agencies from 8:00 A.M. to 5:00 P.M. and gets all the information and compiles the information and she takes that and does the plan. The other difference in her approach after talking to Terri is she could work with committees but she is not really close to the people in the community.. Committees are not always representative of the total populist. It is difficult with committees because the volunteers give their time and hours, and buy into this project at the end some things may have to be changed which is hard to do. For that aspect it is harder in the revision process. She likes to go out to the community as a whole because they give you their ideas but do not feel locked in because they did not give you 100 hours. In Idaho Falls people came back and said one of their top priorities was bike paths and jogging paths which is something she would not have put at the top, when the committee put together their priorities jogging paths and bike paths was number 16. In Alternative B, Terri told her anything they have for the County is ours to use. This will cut off some time, so she lowered the estimate about $2000. There are other planning consultants. She has a lady who might work with Terri for about $3000 or $4000 and that would make it less expensive. John Millar told her we are not price shopping. The cheapest plan we can get necessarily isn't the one we want. You can use some of the County data, but some you will need to supplement or change. Davawn asked her if she had an estimate of how many hours it would take to do the leg work? She told him it would take between 150 and 200 hours. Some cities have long plans, but the shorter the plan is usually the best. She always asks the P & Z board what goal they would like to reach. (discussion) Richard stated he was concerned about the detail and complexity of the Comprehensive Plan and how it will haunt this board for the next 20 years and tie its hands if the city does not head in the same direction as the community thinks it should go right now. Renee said she does not believe in Comprehensive Plans that look like Zoning Ordinances. If she did not have to put a land use map in the Comprehensive Plan she wouldn't. The important thing in the Comprehensive Plan is not so much the map but the policies. (discussion) A motion was made by Jim Long that we recommend to the council that we accept Renee's Alternate A Plan. Seconded by Mary Ann. All Aye. 73 RE: C.U.P. REQUEST FOR SIGNS OF RAILROAD RIGHT OF WAY BY IDAHO OUTDOOR ADVERTISING SIGN COMPANY - PUBLIC HEARING TOPIC: (400,73,,,C.U.P.,SIGNS,PUBLIC HEARINGS,AGRITEC,RAILROADS, TRAFFIC SAFETY COMMITTEE) Public Hearing for the Idaho Outdoor Advertising Sign Company to be granted a Conditional Use Permit for the erection of "billboard signs" approximately 24 feet 9 inches high and approximately 250 square feet, one at each location, and be allowed to place more than one sign upon a parcel of land owned by a single owner on the west side of South Yellowstone Highway along the Railroad Right-a-way between 5th South and 7th South. Rick Herdly, Director of Real Estate with Outdoor Advertising Sign Company, Boise, Idaho. They have a lease agreement with Eastern Idaho Railroad for off premises Billboard signs on their Right-a-way on the west side of Yellowstone Highway adjacent to some equipment operations. They requested two signs, because that was their agreement with Eastern Idaho Railroad. This is a unique situation because their property runs entirely through Rexburg. Additionally they have asked for a height variation 24 ft. 9 in, which would allow them a clearance to the bottom of their signs of 14 feet. They have done that primarily for safety reasons with all the farm equipment that is being moved in around that area. If it is the board's wish that they lower the sign, they have no problem with that. It won't impact their visibility but they do feel it would be a safety issue. It would be located in front of Agritec. There would be 700 feet apart with the two signs. Bruce Neiborg, owner of Agritec, he has some real concerns to have those billboards right in front of my business. He just made a major expenditure there and had he known this was coming, he might have changed his mind on it. If they .put the signs there, he wouldn't be very happy. He called all the businesses around in the area and they ~~ are opposed to the signs. That is a pretty good size sign in the area and it is already very congested. There is a power line, a school and a lot of traffic. This would add to that congestion and create more problems. It would distract people from the other businesses and what they have to offer and then they may or may not come in and see. With the big signs sitting there and his business sitting back in people would not even know that Agritec exists. It possibly would cover up the other businesses signs on their buildings. There could be some economic losses there too because when people drive by they are looking at a billboard and not at the what the businesses have to offer. John Millar read a letter from Stones Town and Country. (attached) Clint Hansen- manager of Nebraska Irrigation West, they rent one of Bruce's buildings and they are opposed to the signs being placed there. They feel like it will clutter things up. Hearing closed. Jim- Under our present ordinance the only protection these citizens have is the only thing we could do is limit it to one on premise sign and the height of the sign. Richard stated that he was sure there was already one sign. Steven stated that if there is a sign on the property they were there illegally. In talking to the railroad they have never granted signs along the easement. (discussion) Roger questioned having a sign on the railroad right-a-way. They have had the 100 foot right-a-way for a reason. He felt it was a safety issue for vision for the trains. Ted agreed that it is very congested. John Millar suggested that he would be concerned about having the sign very law, the engineer in the train sits up fairly high if the sign is below his field of view, it could block the crossings and could be a safety issue. Fourteen feet off the ground could have a real benefit. Roger pointed out that it would be higher than any buildings by 3 foot 9 inches, but safety wise with the railroad is probably better. Richard said he would drive along the railroad right-a-way and see if there are any other signs. If there is already a sign on the right-a-way then they can't put another one on the property. John Millar suggested that we get input from the Traffic Safety Committee on placement and height of the sign where it is the least possible impact for safety issues. A motion that we deny the Conditional Use Permit for two signs. Seconded by John Watson. All Aye Mary Ann said she was not ready to make the judgement herself for the height of the sign but would like the Safety Committee to see if it is a safety issue. John Millar suggested that we have 60 days to act on the Conditional Use Permit and he recommended that we ask the Traffic Safety Commission to give us their recommendation. Our ordinance allows them one sign but if it is a safety issue the safety committee should have a say on it. A motion was made by Richard Smith that we table the Conditional Use ~ , Permit for the change in the height of the sign until we hear from the Traffic Safety Committee. Seconded by Davawn Beattie. (Discussion on 75 if there is already a sign on the property of if there was one on a building, Richard wanted to see if there was a sign on the right-a-way). John Millar told him if he builds in conformance with the ordinance it becomes a building permit issue not a zoning issue. Stephen explained the one problem he would have if he got a building permit and started to build the sign and the Safety Committee looks at it and says it creates a safety issue, they can require him to move it. RE: NEW PARKING LOT AT COLLEGE DISCUSSED TOPIC: (400,75,,,RICKS COLLEGE,PARKING LOTS,3RD SOUTH,CORNELL AVENUE) Davawn Beattie declared a conflict of interest. He showed the parking plans for the new parking lot for the college. It has a nice landscaped area with picnic tables and a barbecue pit and they will do a real nice job. It is a realistic area. He discussed the drainage. He stated they have planned to terrace the parking lot. Part of the parking is on the street right-a-way, they would need a variance. John Millar stated it would also need a special agreement worked out with the City Council. A motion was made by Jim Long that we recommend that they apply for a variance. All Aye except Davawn and Mike who abstained. RE: FINAL PLAT FOR RAY WALKER PROPERTY ON BARNEY DAIRY ROAD ACCEPTED TOPIC: (400,75,,,FINAL PLATS,PLATS,WALKER*RAY,BARNEY DAIRY ROAD) John Millar declared a conflict of interest and asked Mary Ann to chair this issue. He presented a final plat on Barney Dairy Road for Ray Walker. All but one lot has houses an it. The new lot is "I". This plat would allow Ray to sell additional lots. This takes in to consideration realigning the road. Suggestion of dedicated. right-a-way. (discussion) A motion was made by Davawn Beattie to accept the plat for the Ray Walker's addition on the Barney Dairy Road. Seconded by John Watson. All Aye. John Millar abstaining. RE: BRAD LARSEN PLAT FOR APARTMENT COMPLEX ON 2ND EAST PHASE 1 APPROVED WITH CONDITIONS TOPIC: (400,75,,,LARSEN*BRAD,APARTMENTS,2ND EAST,PLATS,PARKING LOTS) Brad Larson plat for apartment complex. John Millar stated that it appears that he has not maintained the setback on the east side. Joe explained that he is proposing a driveway coming off of 2nd East to an interior parking lot. There would not be any connections or driveways onto Harvard out of the parking lot. It would be a circular or U shaped parking lot. He showed the first building they wanted to build also the proposed phase 2 and phase 3 buildings. Showing the storm drain. Discuss the screening of the parking lot. John Millar stated that the only thing we will grant approval for is phase 1. He does not show enough parking for the 1st phase. Joe said if he does all the -phases he would need 60 parking spaces. (discussion) A motion was made by Mary Ann to approve phase 1 of the plan with the condition that he get the appropriate number of parking spaces and that he meets all the requirements of screening as required by our ordinance and that he have • department head approval. Seconded by Mike. All Aye 76 A motion was made by Richard to authorize Joe to write a letter to advise Brad Larson that we are in receipt of phase 2 and phase 3 proposals but they do not appear to comply with the current ordinance requirements and make sure we keep a copy on file. Seconded by Ted. All aye. RE: QUESTIONS ON DENIAL OF C.U.P. FOR GOUGHS TOPIC: (400,76,,,C.U.P.,GOUGH*CLIFFORD) Stephen questions what the conditions were on the Conditional Use Permit for Mrs. Gough's house for the finding of fact. Ted said she had called him and said she no longer wanted to put the apartment in. The conditions were they could only rent to a one car family and they had to meet the parking regulations for the house and the apartment. Stephen quoted to the board from the Zoning Ordinance Section 4.8-B Parking of Automobiles "No person shall park or allow the parking of any automobile, van, pickup truck, or motorcycle in any front yard located in a residential zone except in designated driveway." RE: ARTERIAL ROADS DISCUSSED TOPIC: (400,76,,,ARTERIALS) Joe went over maps that he had prepared with arterial roads drawn on the map. We need an overall plan for accesses for a long range plan. We have main street and 1st North that looks like it will need to be extended to the east. Explaining how it would go on up to Sugar City. A road that would come straight south and connect into Pole Line Road. It could curve around and come into 7th South, how it could come over and connect into lst north. Explaining the connection into 1000 East and 2000 East and Barney Dairy Road. Controlled accesses and direct arterials and explained we need to discuss which ones are limited access and which ones are direct access. There will be long range planning to obtain right-a-ways. Richard discussed staying on section lines instead of dissecting fields, you would get more cooperation from land owners. Joe suggested that you also have to look at how many homes have already been built there. John said the advantage of this plan for Planning & Zoning is when a sub division comes in we can say this is where our alignment is. Richard suggested that if someone wants to build a building on their property unless there is an easement, they can go ahead unless the city or county comes up with the money to buy the land within 120 days. A lot of this is way down the road. If roads are put on property it enhances the property. (discussion on the roads with Joe pointing out each road) Richard suggested that we set up a committee to work on this and participate with the county. John Millar suggested that everyone on the Planning Board be involved in the committee and the road planning. I feel it would be a Major error to allow the entrance of Rexburg be cluttered with 25' signs. This could block off the existing buildings to the west. If I atn allowed to vote, I vote NO.
