Hancock Joe Laird (7:55 - Arterials) Rose Bagley, excused Janet Williamson was present to take minutes for Rose Bagley. John Millar called the meeting to order. Mary Ann Mounts moved to approve the minutes of 3/8/95. Richard Smith seconded the motion. All aye. RE: LAND EXCHANGE & ABANDONMENT FOR DAVID CROFTS TOPIC: (300,175,,,ROADS,2ND EAST,CROFTS*DAVID,ABANDONMENT) The first item on the agenda was the land exchange for David Crofts. Richard Smith declared a conflict because he owns some of the adjacent property. He has no problem with abandoning the road from 2nd East to the well site, but understands it is going be open and continue from that point south and then opening a road from the well site to 2nd East. David said the well sits 80 feet from the fence line. Everything south of Mr. Heinz shop to Poleline Road will remain open. Joe said they will still have to keep an easement because of water and utility lines. Joe felt it would be better to make the new road come to an "L" shape rather then a "T". The City owns the property south. A 50 foot new road would be adequate. Eric moved that we recommend the abandonment of the road North of the Heinz' Shed to 2nd East and any land exchanges necessary. Also that the new road be built, 50 feet wide, graveled and dedicated to the City with easements along the existing road. Marsha seconded the motion. All aye except Richard Smith who abstained. David will need to meet with Rose to see what he needs to do next. He needs to get all of the legal descriptions and quit claim deeds necessary of all property involved. RE: GARAGE ADDITION TO HOME FOR DALLES BRADLEY DISCUSSED TOPIC: (300,175,,,GARAGES,ADDITIONS,SETBACKS,VARIANCES,BRADLEY*DALLES) _~ r ~ t` Mr. and Mrs. Dalles Bradley - 707 West Main, were at the meeting to • discuss a proposed garage to their home. They have a parking pad next to their garage and would like to enclose that and make it in to a second garage. It would be within 2 feet of the property line and they would not meet the 6 foot setback requirement. John explained the requirements for a variance which is what they would need. Mr. Laird has given them those papers and they just wanted to know tonight if they had a chance of getting a variance. John said they have granted very few variances because of the strict requirements to obtain one and their chances were very slim. Joe drew a plot plan showing the arrangement of their home and their neighbors home, etc. They could not make this 4 feet smaller because it is only 11 feet wide .now. It was suggested that they try to buy 4 feet of property from their neighbor and then they would be in compliance with the 6 foot setback and would not need a variance. Richard felt if situations like this keep coming up, maybe Planning & Zoning will need to reconsider some of the provisions. RE: DESIGNATED ARTERIALS IN THE IMPACT ZONE DECIDED UPON TOPIC: {300,176,,,DESIGNATED ARTERIALS,ARTERIALS,IMPACT ZONE,D.A.R.R.) Next item discussed was designated arterials. (Direct Access • Restricted Roads - DARR)We will designate the portion of these roads that is in the Impact Zone and recommend that the County go even further on them. 1. Salem Highway: Yes - it is a given. 2. Hibbard Highway: Yes - it is a given 3. Moody Road - from Salem Highway East: Yes. 4. Millhollow Road from 1/4 of a mile North of the south section line of Section 29: Yes. Joe suggested at this point in the process of this transportation planning, they might want to define some right of way widths for various streets and roads. There was some discussion of the sizes of various existing roads. 5. Barney Dairy Road: There is a lot of building that has gone on out there. It is a subdivision with a major trucking company that owns 17 trucks that go right in front of those homes every day. That was a road that brought traffic in and out of Rexburg for the last 100 years. Walkers have sold plots and allowed homes to be built there. It has been platted. Joe said this is a good example of why we need to have a plan for a wider right of way. You have all those houses now, the large majority of which some day someone is going to have to buy all that front yard landscaping to widen out the road. Richard said now is a good ? ~" ~ i • time to do it because all of the new homes on the south there isn't any. He firmly believes that Barney Dairyought to be designated restricted. If they want to come in and receive permission to put a house in there and if this body or the county or the commission down the road feel that road has been lost they certainly can lift the restriction. Eric asked how can you restrict access if it has already been platted? If it is platted nothing can be done. Richard felt with those homes set back like that you could certainly widen that road. It would be a prime candidate road to widen if you ever felt that you had to do it. When you look at the number of East-West roads that you have coming into the City from the East you have very few. Right now trucks are going down and turning by Adams School. Richard moved that Barney Dairy Road be designated, in its entirety, in the Impact Zone, as a direct access restricted road. Mary Ann seconded the motion. Eric asked what this designation actually provides for? Richard said you can't build a house that directly accesses on to these roads. Eric and Brad felt this was not made clear at any public hearing to the people that own property along these roads because we had not designated them until now. Richard and Mary Ann said it was made very clear at every public hearing and they were told which roads would probably be designated restricted access. Voting on the motion: Ayes - John, Richard, Mary Ann, Eric, Davawn. Nays - Marsha, Brad. Motion passed. 6. Poleline: Yes - it is a given. (Part of it is lost already) 7. Highway 33 North to Sugar City: It is zoned Highway Business District. You have a railroad on the one side. Mary Ann moved to designate Highway 33 North to Sugar City as a direct access restricted road. Marsha seconded the motion. All aye. 8. Highway 33 West (West Main St. by Mother Hibbard's): There are a lot of homes already there and it is a very busy road. Eric moved that they. designate Highway 33 West as a direct access restricted road. Richard seconded the motion. All Aye. 9. Old Highway 191 (U.S. 20) from Poleline Road on the West side North to City Limits (to Taylor's Chevrolet): Brad moved that they designate this road a direct access restricted road. Mary Ann seconded the motion. All Aye. There was concern expressed about the reaction of those who have already built on Barney Dairy Road. Richard said that 5 years from now we are all going to be wondering why we don't have an East-West road into this town. This is the only location for it. Look at Sunnyside in Idaho Falls. It has a lot of homes on it and it moves a lot of traffic and that is just the way it has to be because there wasn't enough fore site to deal with it. Right now we have the opportunity to • make a corridor and prepare for a road to come in there even though there are some homes on it already. ~ '`~ `'r. { ( ~ i Davawn moved that we adopt this list of Direct Access Restricted Roads as our recommendation to go to the City Council and County Commissioners. Richard seconded the motion. All Aye. John asked that they make another recommendation to the council, that either by ordinance or by what ever means available, that on these roads that any future developments have a minimum of 100 foot right of way designated. Joe felt it should be increased to 115 feet. After some discussion of the various roads, their uses and existing sizes they decided to have Joe look at each of the individual roads and their use and size and come back with his recommendations. They asked that he include future roads such as 7th South, 9th South, 11th South, etc. (Discussion of the value of a Future Acquisition Map. Gives them a "planning feeling", where developments are going to happen and where streets are going to go.) RE: SIGN ORDINANCE TOPIC: (300,178,,,SIGN ORDINANCE,SIGNS} Davawn recommended adopting the Uniform Sign Code and provide square footages to designated signs. The U.S.C. addresses all of those in a very generic way and still allows them to assign square footage. Richard agreed with him. He felt the others didn't have the merit of the U.S.C. or the flexibility. The definition of signs in the U.S.C. is good. We still need to decide on size, penalties and fees. Everyone decided to set aside their meeting on April 12th to devote entirely to working on and finishing the Sign Code Ordinance. Davawn will come with a completed, recommended list to review. Richard moved that they adjourn. Mary Ann seconded the motion. Meeting adjourned. ~J
