Work Meeting discussing Sign Ordinance. Discussion on size, height,
and restricting projecting over the right-a-way.

RE: REVIEW OF THE LANDSCAPING AT THE COMFORT INN
TOPIC: (300,109,,,LANDSCAPING,COMFORT INN,TREES,SCREENING)
Glen Halverson was at the meeting to review the landscaping at the
Comfort Inn. John Millar declared a conflict of interest and asked
Mary Ann to chair that issue. (he handed out copies of plan with
landscaping) There was an issue of screening. It would be difficult to
plant trees 30' high. They have planted 6 1/2 high arborvitae trees
on the south side and Colorado Blue Spruce on the east side. They were
planted at 30' spacing. As those trees get larger they will spread
out. Davawn & Jim told him the spruce are adequate. Glen said they had
thought about poplar or aspen for the South but they loose their leaves
in the winter and you won't have that screen. It also presents a
maintenance problem with all the leaves in the fall. The landscaper
suggested the arborvitae. Davawn told him that it has been his
experience that the arborvitae stays so narrow, but would need to be
planted closer. Jim Long stated that those arborvitae trees will never
grow together and there will always be open spaces. If they were
planted 5 feet apart they would be good screening but at 20 feet apart
they will never be a good screen. Davawn agreed. Jim suggested that
they plant some Austrian pines not in between them but as a double row
(off set), that would screen it very well. It would be more economical
that way. The committee agreed.

RE: PUBLIC HEARING FOR CONDITIONAL USE PERMIT FOR DUPLEXES FOR BRAD
LARSEN ON CORNELL AND 3RD SOUTH

7:15 P. M. -Public Hearing regarding the issuance of a conditional use
permit to allow the owner to put one duplex on each lot located at the
corner of Cornell and 3rd South streets which is zoned LDR1..
Brad Larsen showed his plans and explained the plans. They would put
a duplex on each lot. The only access would be off of 3rd South and
the alley to keep the traffic off of Cornell. Cornell will see grass
and landscaping, there .would be grass along 3rd South. There would be
17 parking places as called for in the city ordinance. The intention
is one unit will be family and the other three units would be
students. J. D. Hancock told him he could only have four students in
each apartment.
Jack Van Houten- It seems funny that you take our zoning away and put
this in. It does not seem to fit with what we want in our community.
Anita Williams- It is my understanding that every time you subdivide a
piece. of property, there is suppose to be a hearing on it. This was
not initially two lots it was one. John Millar told him splitting a
lot would not be subdividing. You can split a lot as long as it
complies with the minimum lot size.
Jack Van Houten- Because you split it, does that mean you can put twice
as much on it? You are trying to crowd something in that we don't want
in our community. John told him when it was divided it met the minimum
lot size in that zone. Jack asked, the very fact that they have a
subdivision that is set up for certain zoning doesn't mean a thing to
us if anyone can come in and change it to what they want? The very
thought that we bought in there for single family dwellings and all of
a sudden it is not good?
John Millar told him we are here to here comment only, this is strictly
a proposal.
Anita Williams- Where are you going to pile the snow when you clean
your parking lot out? Brad told her it requires 10~ for snow piling.
He realized that it is residential along Cornell, but there other side
is apartments and an university along the other side of the property.
Anita Williams- when the first Apartment Complex was put in there was
not a building permit obtained. He was told he could not get one, so
he put it in anyway and got away with it. John told her no one in this
group has any knowledge of that. Anita stated that the thing they are
fighting most is inadequate parking. She has parking in the back and
always has kids parking there, because most apartments don't have
enough parking. John told her it is not only apartments but kids that
drive from Sugar City and Rigby, that try to park as close to campus as
possible. Three or four years ago we increased parking requirements
for new developments.
~~ Jerry Hansen- There is a parking problem. There are cars parking in

front of his house every day. He suggested that there still would be
more cars than spaces and there still might not be enough space for
snow.
Jack Van Houten- We are already so over crowded with people parking on
our block, they are parking in no parking zones. John suggested that
one thing we could do is enact a 2 hour parking limit between certain
hours. Jack said there is already no parking on one side of the
street, so they all park on his side of the street. He did not think
that they were considering how much of a snow problem they have on that
street.
Jerry Hansen- In the winter time there is not much plowing of that
street and if you have cars parked there and you slip and slide it
becomes a huge problem. The more parking we have the more problems on
the street.
Jim Long- You are living within two blocks of the college campus, and
in every town that has a college has the same problem. There is going
to be cars and student parking. We need to ask if his complex is going
to contribute to the problem? According to the code he is adding more
of a problem? You are talking about a problem that is already there.
As Jim could see it he did not think he was adding to the problem.
~~ Jack Van Houten- Are the parking places they have open to the public?
~-~ They will still add to our parking problem, because he will have more
cars than allowed for. John told him we have monitored the .7 parking
places and it is on the high side.
Mary Ann- One thing we could do with a conditional use permit is to
limit the number of students he could rent to with cars. Brad said he
was planning 6 students per apartment.
J. D. read from the ordinance the definition of a family which would be
allowed in the apartments. "One or more persons occupying a dwelling
unit and living as a single, nonprofit housekeeping unit, provided that
a group of five or more persons who are not within the second degree of
kinship shall not be deemed to constitute a family unless such five or
more persons are handicapped persons as defined by the Idaho Code
67-6531 or as defined in Title VII of the Civil Rights Act of 1968, as
amended by the Fair Housing Act Amendments of 1988."
Jack Van Houten- We object to anymore student housing in our
neighborhood. The people with cars coming to visit would add to the
problem.
Terry Wilcox- They own some property on Cornell. He did not know what
Brad had invested in the property. They are not happy to see it come
in. Among the people that are affected, there are a number of them
that would be willing to try to help him get out of it by putting a
park or parking lot there.

Anita- I challenge you to live there and keep up with the garbage that
blows down the alley and dread of having two more dumpsters blowing
down the alley.
Jerry Hansen- What will it do to the values of the property in the
area?
John- Discussion on family size. If he is not mistaken, the intent of
the ordinance for allowing a conditional use permit for a duplex in
LDR1 was for basically two single families, not to develope student
housing in LDR1. A family unit is defined in our ordinance as four.
Mary Ann- Told the group that we are sympathize with them, but we
cannot discriminate against student housing. That can't be the basis
that we make our decision on.
Miriam Van Houten- She thought the committee should uphold the
covenants.
Mary Ann- Explained the federal definition of a family.
John- told them if a Conditional Use Permit is issued, we can put any
stipulations on it that we deem necessary that is reasonable.
Brad Larson- Ask how the four for a family came about? Page 19 in our
ordinance explains two are families are allowed with a conditional use
permit.
Jerry Hansen- Asked about the fence and entrance?
J. D. Hancock- Read from the old ordinance the square footage required
for a lot in R1. He bought the lots when the old ordinance was in
effect and it was split under the old ordinance.
Davawn- Asked Brad if he was still interested to just have four in an
apartment? He said he was still interested and was not interested in
Mr Wilcox's suggestion.
Jack Van Houten- When the city closed the street up west of Cornell, 20
or more vehicles started parking on Cornell. If you put in these
units, it will double the cars parking on that street.
Jeff- He stated that it looks like there is a problem with the minimum
lot requirements. Joe said he did not look at the lot size. J. D.
stated that in the old ordinance it did not meet the lot size.
Mary Ann- Stated that we need to consider issuing the conditional use
permit for the duplex not the issue of student housing. John stated we
can allow it with additional restrictions or make it more restrictive.
We have 60 days to make a decision.
Kathleen Peterson- If this does not meet the minimum requirements then
why are we considering it? They had always understood that was one
lot.

;'~~ A motion was made by Jerry Jeppesen that we table it until we research
it to see if it really did qualify as a division of lots under the old
ordinance. Seconded by Jeff Walters. All Aye
John told him we will table it, we have 60 days to make a decision on
this. We will let the residents know when the decision will be made.
We will continue it at the next regularly scheduled meeting.
RE: SIGN ORDINANCE DISCUSSED

Discussion the height and size of signs. A motion was made by Mary Ann
that we take time to look at the signs for height and size and do it as
a group. Seconded by Davawn Beattie. All Aye
It was decided that we would go look at the signs November 4 during
lunch. Davawn Beattie will provide a van. The city will provide
sandwiches.
