John Millar introduced the new member of Planning & Zoning,
representing the Impact Zone, Brad Archibald.
A motion was made by Davawn Beattie and seconded by Jerry Jeppesen to

RE: PLAN REVIEW FOR NEW NURSING HOME ON 2ND S & 4TH E - REQUEST FOR
A CONDITIONAL USE PERMIT

R. Joseph Rude, President of Health & Marketing West, was at the
meeting to show plans for a Nursing Home at Lot 4 Block 7 of the Rigby
Addition, and to request a Conditional Use permit. The property is
zoned LDR1 with a Professional Office Overlay. It is to be located on
the property directly across from Lincoln School. Mr Rude stated that
they had just purchased the property. He explained and showed the
plans. The main entrance will be on 2nd South Street and it will have
visitor parking above, the employee and support parking will be down
below. The project requires 21 parking spaces, and they are planning
67 parking places. They are going to create a special care unit which
would be an Alzheimers Special Care unit. The kitchen activities will
be in the lower level, and also will create a transitional care unit.
People would go into the Transitional care unit for a short visit of
possibly two weeks to a month and receive physical therapy or special
care for their needs.

Davawn Beattie asked about the storm drainage? John Millar explained
that the drainage isn't too much of a problem, there is a 30" line on
the east side of the property and that line goes down into the park.
The one side of the property would not be built on at this time but •
would be kept green until such time as they decided to build on it.
The north edge of this property abuts up against Dr Crouch's

• development. There would be no connecting road between the property.
They would address a buffer between the property. They don't generate
very much traffic. The labor force will be about 85 people and they
won't all be on site at once. They will be working three shifts, with
about 35 people coming during the day shift. There are 45 employee
parking places and on top there are 17 visitors parking places plus 2
handicapped. A Nursing Home would be allowed in LDR1 under a
Conditional Use Permit. The parking lot will need to be screened.
Because they have employees coming and going night and day, they will
be lighting their parking lot for security. They will try to use
directed lights to minimize the effect on the residential
neighborhoods. The development will need to be buffered. Davawn
recommended that the Traffic people have a chance to look at the
plans. They would fence around the outside of the Alzheimers wing. A
motion was made by Mary Ann and seconded by Jim Long to proceed to
Public Hearing for one month from tonight at 7:30 P. M.
John Millar recommended that the board go up and look at the site
before the Public Hearing.

PARKING LOT DISCUSSED)

Joe Romney and Brad Hastings of Silvertree Builders were at the meeting
• with the plans for Millhollow Yogurt on the property north of Deseret
Industries currently used as a parking lot. They explained the plans.
It will be a Rustic Type of Old Mill Style. They will take out some
existing driveways and replace them according to the specs of a
commercial driveway. The entire parking area will be asphalted and it
does drain down to the back area where there is an existing drain.
They will change the drainage system, because the existing drain is
under the building site. They have an agreement so D. I. can use the
door. There is an easement that starts on the south property line and
extends 20 feet to the north. There will be one way traffic around the
building for a drive through. There are also pedestrian easements out
of the Beauty College. It is zoned C.B.D. and does not require off
street parking, but there are 17 parking places.
John Millar stated that there is a requirement in our ordinance page
44- 5.9 "Existing parking and loading facilities shall not be reduced
or removed from the C.B.D. by new or existing uses unless a variance is
obtained from the Planning Commission or substitute off-street parking
is provided within two hundred feet (200) of the main entrance of the
use." The property has been used for parking for many years and by
design or default it is a C.B.D. parking lot. He and Joe had discussed
it and felt that a variance or substitute off-street parking should be
required. Mr Romney stated that they have been looking at this since
November and the only parking on the lot was students and faculty from
the beauty college.. Mary Ann said she was involved in the L.I.D. and
the only establishment that did not agree to pay the assessment was the
• fitness center, so she checked it out and the fitness center was using
that parking lot. Mr Romney stated that Taylors paid their assessment
for the city parking lots. Jim Long asked if he owned a piece of
property and the public used it to park on without his permission and •
suddenly he wanted to develope it what rights does the public have and
why does he have to worry about replacing the parking they were
illegally using? (discussion) Mary Ann stated that it was private
property and used for Taylor Chevrolet car parking lot and paved by
Taylor Chevrolet. She interpreted the ordinance to mean that if someone
wanted to build on a city owned parking lot and because this is private
property she did not see how we could include this. <discussion)
Jeff Walters stated that he wondered if because it had been used for a
parking lot, there might be a prescriptive use and if it has been
perceived by the community at large that it is a city parking lot. He
felt that it was a border line thing. (discussion) Joe Laird said he
had no problem with the site plan, he just had a question with that
section of the ordinance. Jim Long felt we would be imposing
regulations on them that we really don't need to. Mary Ann stated that
when we did this zoning ordinance, she did not think we had that in
mind.
A motion was made by Jim Long and seconded by Jerry Jeppesen to approve
the plan as it is. All Aye except Jeff Walters voting nay in
opposition.
There will be a meeting on the 2nd Tuesday in September to work on the
Impact Zone.
