Because of John Millar's excused late arrival, Mary Ann Mounts took
charge of the meeting.
After discussion, a motion was made by Davawn Beattie to accept the
minutes of July 13, 1994 with corrections. Seconded by Jerry
Jeppesen. All Aye
A motion was made by Marsha Bjornn and seconded by .Davawn Beattie to
approve the minutes of 7/27/94. A11 Aye.
RE: PUBLIC HEARING FOR CONDITIONAL USE PERMIT FOR LDS CHURCH IN
SUMMERWOOD SUBDIVISION. C.U.P. GRANTED

Public Hearing at 7:15 P. M. for a proposed issuance of a conditional
use permit for the construction of a church building, parking lot and
recreation area with a softball diamond, to be used as a place of
worship and recreation. The property address is 590 West Summerwood
Drive. Mary Ann asked for any comments. Daryl Kofoed representing
Mountain River, Inc. presented the plans. (discussion on plans) A
motion was made by John Watson and seconded by Jerry Jeppesen to grant
the Conditional Use Permit. All Aye
RE: REQUEST FOR MORE PARKING AT CHARLES SMITH RENTAL - 7 N. 5TH W.

Charles Smith was at the meeting to request putting in more parking at
his rental property at 7 North 5th West. He showed a plan. He needed
more parking for student housing, he rents to 11 students. Discussion
if there would be a safety issue. Richard Smith told him to fill out
the forms and bring them back to this board to request a variance. The
board will go look at the property before the next meeting.

RE: PARKING ON SIDEWALK AT FOOD CENTER

Bob Carlson representing Food Center was at the meeting to discuss the
parking on the sidewalk at his business. Two weeks ago his builder
received a letter from the city, saying he had to put concrete blocks
on the sidewalk. If he put concrete blocks on the sidewalk, he would
have a law suit. He was willing to sand blast the stripes off the
sidewalk, but not willing to put concrete blocks on the sidewalk. (the
board did not know anything about the concrete blocks) Mary Ann
explained that when they first came in and wanted to build the
building, we talked about it with Mr Mickelsen and told him there was
no problem, but we want the parking to stop on the sidewalk and could
have suggested that a way to stop it was to put concrete blocks there,
but this board is not set on that. If they could sand blast off the
stripes, that would do a lot. Mary Ann suggested that the city needs
to poet a no parking sign there. The city can't give a ticket as long
as the stripes are there. John Watson asked how it was different to
Breck Barton's new office. Joe stated that this board required parking
bumpers to be put there to keep the cars off city sidewalk. The reason
for those bumpers is to keep the vehicles from hanging out over the
sidewalk at the Barton property. The difference at the Food Center is
they are parking on the sidewalk. Bob said he would do what ever it
takes without putting those concrete blocks on the sidewalk. John
,, • Watson suggested that they paint no parking on the sidewalk.
RE: PRELIMINARY PLAT FOR SAWTELLE SUBDIVISION (JOE LAIRD)

Joe Laird presented his preliminary plat for Sawtelle Subdivision. Joe
explained the sub division and explained there is a problem with
getting sanitary sewer service to the property at this time. He would
probably get the plat approval and wait for a lift station to be built
for that whole area. French drains will be developed. A motion was
made by Marsha Bjornn to accept the preliminary plat. Seconded by
Davawn Beattie. All Aye
Discussion on a new Master Plan.
RE: PLAN FOR TRI COUNTY EQUIPMENT

John Watson discussed the plan that he brought in for Tri County
Equipment. He was told that this group has to review any plans for
commercial developments or apartments.
RE: STONES TOWN AND COUNTY ADDITIONS - WHY HOT TAP REQUESTED

• John Watson also asked about Stones addition. They were required to do
a Hot Tap to a 14" line for the fire hydrant. The cost to Ray Loveland

was $10,000, which was mandated by the fire department. The cost for •
the Hot Tap was $2800. When they exposed the line it was not even hot
or charged. The city was the one that gave them the direction. J. D.
stated that he did not think they should have to pay the $2800 if it
did not have water in it. The equipment that it requires costs a lot.
RE: REPORT OF DISCUSSION OF IMPACT ZONE WITH COUNTY COMMISSIONERS

Richard Smith said they met with the Commissioners and they came close
to approving the map and he felt that in two more weeks they would
approve it. They went over exactly what they were going to do with
respect to the ordinances. They did agree to shift the October 1
deadline to November 1 which is authorized by the statue. He had
agreed to go through the zoning ordinance page by page, paragraph by
paragraph and make a preliminary suggestion to Planning & Zoning as to
what provisions would apply and would not apply in the Impact Zone.
The provisions that apply to all zones, such as variances and
conditional use permits would apply in the Impact Zone. (discussion)
All of the zones for the Impact Zone will be spelled out, the setbacks
and parking will not apply. Richard felt we should have a chapter for
the Impact Zone with the applicable zones in it. We are talking about
outside the city limits. Jerry felt if we had a separate chapter it
would be easier for people to understand. If it is more complicated
than that it is too hard for them to understand. J. D. felt even with
a separate chapter all of the zoning ordinance should apply to the .
Impact Zone where it applies.
John Millar arrived at 8:30 P. M.
Richard explained the discussion on the separate chapter to John. John
Millar said his concern was the Table 1 and Table 2 should be amended.
Richard suggested that we have a specific chapter for the Impact Zone,
stating the boundaries and establishing the new zones together with the
language of the zones and stating all the provisions of the ordinance
where applicable will apply. By placing Agl and Ag2, Rural Residential
in the tables, you will be imposing some additional requirements on the
zones. Where it is not applicable, just put N.A. in the table. We
could have land use schedules and a different table in the separate
chapter. Jerry felt that would make the county people feel better.
RE: MOBILE HOMES IN IMPACT ZONE

Discussion on Mobile Homes in the Impact Zone. Jerry suggested it
would be a conditional use and take it on a case by case basis. Trailer
courts will be controlled by ordinance.

Jerry discussed the definition of a feed lot. Meryers feed 12,000.
head, Skaar feed 6,000. The commissioners discussed 1000 head or more
for over a year in a concentrated area of five acres or less is a feed
lot (fenced in and feed like a feed lot - manger type feeding). The
commissioners felt comfortable with that. The only time you would have
to regulate it is when you have a complaint.
RE: RECOMMENDATION TO ADOPT THE UNIFORM SIGN CODE

Discussion on the new Uniform Sign code that is more abbreviated than
the old one. A motion was made by Davawn Beattie to recommend to the
City Council to adopt the Uniform Sign Code. Seconded by Richard Smith.
All Aye It is more for construction and safety issues.
Jerry said the commissioners asked that we strike Commercial Breeding
out of A2. (discussion)
