A motion was made by Jerry Jeppesen and seconded by Davawn Beattie to

RE: IMPACT ZONE JURISDICTION DISCUSSED

Jerry stated that there was some issues in those minutes that need to
be discussed. A statement was made that city retain jurisdiction of the
Impact Zone. Jerry's understanding is the Planning & Zoning Board
would have say like a P&Z capacity and make recommendations and if
people don't like what we say they would go to the city council and
county commissioners. Under that form that does not take jurisdiction
away from county commissioners. We need to remind every commissioner
that they have signed off on that part of the process. He explained to
Eric once the Impact Zone goes in, those things that happen in the
Impact Area will be brought before this commission. This commission
will have discretion according to how the ordinance is written, but
when it is something different or something those people don't agree
with, then they have the opportunity to go to the city council or
county commissioners and ask them to reverse a decision. The two of
those have to agree or it goes to arbitration. Maybe we need to
educate people as to what our authority is. We talked about Farm to
Market roads and Millhollow can not be considered a Farm to Market Road
because it is too dangerous. John asked if we want to provide it some
protection from total frontage development? A Farm to Market road is
discouraged but it is used a lot. Jerry felt it was a matter left up
to the city at this point.
RE: PUBLIC HEARING FOR ANNEXATION OF VILLAGE GREEN TRAILER COURT;
ANNEXATION RECOMMENDED

Public Hearing at 7:15 P. M. pertaining to the annexation to the City
of the Village Green Trailer Court located at Airport Road. It will
come in zoned under the M.D.R. Classification.

No one was at the meeting to comment except the owner, Kay Baker, who
was at the meeting to answer any questions. (discussion on water and
sewer)
A motion was made by Jerry Jeppesen to recommend the annexation of this
property to the City Council. Seconded by Mary Ann Mounts. All Aye

RE: PLAN REVIEW OF BRECK BARYONS OFFICE - CENTER AND 1ST NORTH

Breck Barton office plans. John Watson declared a conflict of
interest, he explained he had field measured the property and then got
the measurements from the courthouse, and got the dimensions of the
property and it made a difference on the location of the building. He
showed the plans and explained all the other problems.
RE: SITE PLAN FOR THE LDS CHURCH OFF OF NORTH 5TH WEST AND A REQUEST
FOR A CONDITIONAL USE PERMIT.

Site plan for the Church off of North 5th West and a request for a
Conditional Use Permit. Scott Nielson, Call Nielson Bodily Architects
in Idaho Falls, presented the plans. Showing the plans. They have laid
\~ it out according to standard church policy in terms of the number of
parking places they would like to have. The Randall Corporation is the
developer and there is a development agreement between them and the
church. According to church policy, they develope approximately 5
acres for meeting house property. The recreation area is separate and
they will do some developing of that. We don't know exactly when it
will be, but they anticipate it will come along with the building. It
consists of a softball area and play field with no lighting involved at
this point and a picnic area. They are providing spaces for 289 cars
parking. It is anticipated that there will be three wards in the
building and then potentially four units in time. At this point they
have complied with the ordinances they are aware of. They are planning
on running a fence along the full perimeter of the north property line
and where ever they are in direct contact with residential lots, they
will put a fence, probably a cedar fence mounted on steel fence posts.
Discussion of handicapped accesses. Bruce told him we would require 5'
sidewalks. Mr Nielson stated that the church prefers 6' sidewalks. The
board told him it was a nice site plan.
A motion was made by Jim Long to proceed to a Public Hearing, seconded
by Davawn Beattie. All Aye.
John Millar told the board that Bob Lee had resigned. Mayor Boyle had
asked Eric Erickson to be on the Planning Board. The County
Commissioners will have to concur with this appointment. He welcomed
Mr Erickson to the board.

RE: DISCUSSION OF SIDEWALKS, CURB & GUTTER,PARKWAYS (LANDSCAPED
STRIPS),ETC.

John Millar stated that at the last meeting Mary Ann brought up that
she would like a park strip between curb gutter and sidewalk. At that
time he felt that in the middle of a subdivision we should not change
the rules. It is a good idea and we possibly need to pursue it
further, that we require a wider right-a-way and some dimension of park
strip between curb and gutter and sidewalk. (discussion on sidewalk
ordinance) We would have to amend our subdivision ordinance. Possibly
move the setback five feet.
Richard asked Joe about the enforcement of sidewalks for new homes?
Joe explained since the first of the year we have .required a letter
stating they will put a sidewalk in when the sidewalks are put in on
that street. The council did not see reasoning of making one person on
the street put sidewalk in when no one on the street had sidewalks.
The board did not think that was enough. John Millar said that we do'
need to address that we do provide enough parking length in the
driveway so you don't block the sidewalk. Bruce said he had complaints
from people that walk that there are cars parked on the sidewalk. The
board felt we need more enforcement.

<" Joe asked if he could have a committee work with him to set up the curb
l to curb widths on the various streets that would go along with the
addition of the landscaping strip. Jim Long felt there should be
wording in the ordinance requiring maintenance of the landscaped strip.
RE: MOTION PASSED TO HAVE SIDEWALK COMMITTEE LOOK AT THE ADDITION OF
PARKWAYS

A motion was made by Davawn Beattie that we recommend that the sidewalk
committee look at the addition of parkways with the appropriate
regulations and that they coordinate it with the Forestry Committee.
Seconded by Mary Ann Mounts. All Aye
Richard suggested that Joe bring a recommendation to this committee on
what he would like to see as to the width of streets curb to curb.
Bruce suggested that he should work with the Traffic Safety Committee
on this.
RE: REGULATIONS REGARDING MANUFACTURED HOMES

John discussed the modified H.B 669 about Manufactured Housing. That
on or before July 1, 1996 the each governing board will amend their
Comprehensive Plan and Land Use regulations for all residential zones
to allow Manufactured homes. It can be governed by Restrictive
Covenants or by restrictions that would also apply to stick built homes
such as square footage, roof slope, or eve over hang. We will have to
look at amending our ordinance.

'~ RE: DISCUSSION OF CURB & GUTTER BY WAL MART AND HORKLEY INTERSECTION

John Millar explained the proposed project on North Highway to continue
the curb and gutter where it ends by Walmart and Horkleys clear to
Railroad and widen that street to four lanes clear to the railroad with
a turn lane in the middle and signalized intersection at the road where
the Sugar City road ties in. The state said they would coordinate that
signal so where the road goes into American Potato they will have easy
access out of that road and it will be tied in with the railroad
crossing.
RE: DISCUSSION OF BEEHIVE CREDIT UNION & ISSUING OCCUPANCY FERMITS

Questions on what happened to the Beehive Credit Union. He is coming
to the next meeting to request a variance. The board felt Occupancy
Permits should not be given until they comply with all restrictions put
on the site plan by this board. What good is a site review and plan
review, if we are just going to approve it and not follow up? After we
approve a site plan, it should be subject to that before they get an
occupancy Permit.
A motion was made by Mary Ann Mounts to recommend to the city council
that we deny an Occupancy Permit until they meet requirements made by
this board. Richard stated that we are not having our Zoning Ordinance
enforced and we need to come up with a way to enforce it. It might be
a good idea to have it spelled out on the permit that these things need
to be done before they get an Occupancy Permit.
Mary Ann changed her motion to state that the Planning & Zoning
recommend to the city council to deny a Certificate of Occupancy until
certain criteria is met and that the people are told about it when they
get their building permit, so they are forewarned and they sign a paper
saying they will meet this criteria. Seconded by Jim Long. All Aye
RE: DISCUSSION OF GRANDFATHER CLAUSE IN THE IMPACT ZONE

Jerry mentioned that they wanted a clear definition added about what is
a Grandfather Clause. Richard stated he felt it important that we
preclude any language regarding pre-existing used in the ordinance its
self. Pre-existing use sort of stands by itself. If we inventory a
certain parcel of property that would be great but don't talk about it
being Grandfathered or a Pre-existing use.
RE: DISCUSSION OF AGRICULTURAL ZONES IN THE THE IMPACT ZONE

Jerry asked how do you determine which is Al and which is A2? Sakota's
are an example, they are asking to come in under A2, when they really
don't have an A2 operation. The only property on the map A2 is Dell
Barney, the map has not been revised since Archibalds have decided to
come in. Archibalds want to come in at A2.

~~ The board felt these definitions as they stand do no show where we are
now after our discussions. Discussion on the zone that Shiro
Fujimoto's property should be. They talked about abandonment.
Discussion on all Agricultural Zones.
RE: DEFINITION OF RURAL RESIDENTIAL ZONE IN THE IMPACT ZONE

A motion was made by Jerry Jeppesen that in the Rural Residential, any
person who has one or more acres over his building lot size be
permitted to have two head of livestock per acre. Lots that exceed 1
1/2 acres be allowed two head of livestock per acre over the 1 1/2
acre. Seconded by Jim Long. All Aye
Rural Residential only applies up to 5 acres.
Discussion to inventory property for pre-existing use and if not
abandoned for 5 years if exists, if the use does not change.

RE: AGRICULTURAL 1 ZONE
TOPIC: (300,80,,,AGRICULTURAL 1 ZONE,IMPACT ZONE)
A motion was made by Richard Smith that the land to be zoned Al in the
Impact Zone be inventoried to determine existing use with regard to
livestock. We grant to the land owners with livestock existing uses
based upon ranges, that would be defined by the committee and that we
will recognize those ranges as existing uses on the particular parcel
of property. The existing uses will be subject to abandonment of non
use for a period of five years. As a parcel decreases, the recognized
existing use reduces in number proportionately. Seconded by Jerry
Jeppesen. All Aye.

RE: AGRICULTURAL 2 ZONE

Leave A2 as it is. Somewhere we need to get a range as to what is a
cow calf operation or a feed yard. Richard suggested that instead of
looking at feed lots, poultry and egg farms, hog farms, dog kennels
etc, why not take all that and say maximum livestock per acre is (X).
John Millar stated that a feed lot has more potential for odor than a
cow calf operation. Richard said it is a density issue on per acre
basis. We will develope a definition for a feed lot.
RE: CHANGE IN THE RURAL RESIDENTIAL REQUIREMENTS

A motion was made by Richard Smith that we change the requirement in
R.R. from 5 acres 1.5 acres. Seconded by Jim Long. All Aye
Discussion on controlled access onto major arterials. Steve was asked •
to review the cor<trolled access restrictions.
