County Commissioners: Dell Barney, Dave Rasmussen, Marlin Hill; County .Clerk: Beth Reese RE: IMPACT ZONE DISCUSSED John told the group the purpose of the meeting is a work session tc determine where we are and where we are going with the Impact Zone. He told the group, Bob Lee was present and will be appointed to the Planning & Zoning Commission. John discussed, after talking to some people he wondered if we were selling it short if we go the way we have planned. The way we have proposed is that everyone will come in under existing use. Any change from that will be a zone change or a Conditional Use Permit. He wondered if we would be looking at numerous zone changes, spot zoning and problems. He wondered if we should bite the bullet now and zone the Impact Area. We need some direction of planning. Jim Flamm- His feeling was to leave zoning as it is now being used, as the map shows, because the map shows the usage as it is. When things come up, then zone items as they come up. If we try to out guess what is going to happen, we will be making a lot of changes anyway. That would mean that anytime the usage is changed, all the people involved and affected by this will be notified to come to a hearing and get input on the project and then spot zone it. He was concerned about protecting those arterials so that we don't continue to build houses facing the farm to market roads and creating hazards. We need to consider that increased traffic on all the arterials is inevitable, so we need to plan for the increased traffic and make it safer. Davawn- Asked who was going to regulate this area? Anything in the Impact Area will come to this body. Richard stated that we have passed an ordinance in the City and County to that effect. Davawn- Who will issue the permits? The county will issue permits until the property is annexed in the Impact Zone. ~~~ Richard- He agreed with many things that Jim said. He had thought a lot in the last year and struggled a lot about what ordinance should be implemented in the Impact Zone. The statue is separate from the ordinance we have passed. A concern, if we go forward and develope new ordinances just for the Impact Zone., that when the Impact Areas are annexed into the city, then sub divisions have been built, homes have been built, that do not comply with the existing Rexburg ordinance. We will be facing the same problems that this body have faced in the past year, because all the building is going on in the Impact Zone yet the ordinances that apply in the Impact Zone are not city ordinances. It is his feeling, it wouldn't be a bad idea to draw the Impact area in and watch it very closely as to what areas will grow into residential areas, what areas will gro~.a into commercial and industrial areas. Then go ahead and make those the Impact Area and zone them according to Rexburg Zoning ordinances. He does not want to take anyone's use away, but if he decided up by his house to put a textile business in that boarders on all those residential homes up there, it probably should not be allowed even though he wanted to do it. If he wants to start raising animals that is right next to a residential area, maybe he should not be doing that. He was very aware of the concerns of the Archibalds with their cattle operation, because in all probability, it probably is not going to be annexed. It is not so much developing a new set of rules for a large Impact Area. He is saying we need to define a very meaningful Impact boundary and say this is the area the city is looking to annex within the next five to ten years. The city does not want strange growth all around the city so we need to inact all the city ordinances 'to that area. The mayor stated that the whole area around the cemetery will never be annexed to the city. There is no access across the river and there is no way you are going to get a road across with sewer lagoons and city property and that big lake. Richard- that is the area we got most of our opposition from, but the city and the county should have a legitimate interest in saying Walmart built their business out north of town and that area just north of there we are going to designate as commercial. We are not going to let who ever owns that property go in and put a trailer park. That will impose some zoning restrictions on property outside the city and in the county. In the same token if you refuse to recognize that these areas are going to come into the city and you say we are going to have a different set of rules for these areas, as the city annexes and grows, you will bring in sub divisions without curb and gutter with improperly built streets and continue to have a hodgepodge mess. You can't change a pre-existing use. Richard- In order to comply with the statue, we all need to agree on these issues. John Millar- It is important that we develope some similarity of planning with this corridor (speaking of North Highway between Rexburg and Sugar City). Zone it commercial or Highway Business District or Light Industrial. Zone residential areas and transition areas. It will give us long range planning so we can start planning roads and water and wastewater. If we are going to impose more strict regulations, we have got to pull our boundaries in. L~ t • Richard said he had a large portion of ground in the proposed Impact Zone and will continue to farm it. An Agriculture Zone would not be a bad idea. John suggested that we leave the Impact Zone as it is and leave a wide Agricultural Zone on the periphery areas. Richard said it would give control over the arterials, that is one reason we made the Impact Zone so big because we were so worried about the Arterials. Jerry- I don't know how we can restrict the Arterials, the real restrictions would be the setbacks and those kind of things. After discussion in the last County planning meeting, the people on the North don't want to be in the Impact Area. American Potato stated that under no condition do they want to be in the Impact Area. They built out of the city for a reason and plan to stay out of the city. They really do create a buffer an the north and don't see any reason to put them in the Impact Area. The mayor agreed and felt that the area around the Golf Course should be put in the Impact Area, so we could control it where there is going to be homes. Richard- if there is water and sewer running to the area on the north, they have a real interest to be in the Impact Area. If people request to build sub divisions and want city services, they should be willing to be annexed. Mayor Burton explained the sewer lines between Rexburg and Sugar City. He felt it should be included over to the Moody Road for both cities. Sugar City's Impact Area goes to the Moody Road on the north. Anything on the north of the Moody Road that hooks on the sewer line is Sugar City's and anything south is Rexburg's. Jerry- as long as the sewer line is there it creates a perfect additive for expansion. You would hate to see any sub division go into that area and then hook onto the sewer and water. Richard said if they are going to hook on to the sewer and water, they need to be annexed. Jerry- I think you have a lot of people wanting to come under a set of rules right now. If you go out into these different areas, you will have whole areas come in and say yes we want in or no we don't want in and there will be specific reasons for that. (discussion on drawing boundaries) Jerry- If you eliminate the area by the Cemetery the (Archibald Area) you will take away most of your opposition. Mayor Boyle- There is no reason to put that area in the Impact Area because it is almost inaccessible without going to the Cemetery and back. Discussion on putting in the area around the Cemetery road. Discussion on putting American Potato in the Impact Area. Mary Ann felt that area on the Cemetery road should be in the Impact Area, because that area could grow. We are close on the Arterial Ordinance. Dave- last night we covered a lot on the Sub division Ordinance and at the next meeting we will deal strictly with a Sub division Ordinance. ~~: Richard- if the county has a Sub division Ordinance and an Arterial • ordinance, he could see not including some of these areas if it is going to be regulated and if the sub divisions are built correctly. Dell Barney- there might be sub divisions built clear out and they are too far to hook onto sewer and water. John Millar- Health restricts will eliminate a lot of those sub divisions because the requirements on water testing are getting so expensive. Jerry- The city and county need to decide what are worthwhile projects and weed out the fly by night projects. Dell Barney- A year ago all we heard was negative but there have been enough things proposed that would affect enough people that was so negative, that they are not negative anymore. They are seeing reasons that they want some protection now. Some of the people that did not want anything to do with it, are crying for protection. Richard- There are many that are crying for the city zoning ordinance to be applied in their area. Dell- As he understood it, we would zone everything as it is with the existing use. To do anything different on that property, you have to request a zone change anyway. He asked about the new law about annexing? It wauld have to be contiguous and under 5 acres, they have to request annexation. You can't force annexation. (Discussion on American Potato in Impact Area} Jerry said he would personally go and talk to them about it. Richard and John said they would talk to them also. John Millar suggested that in some areas, before a Public Hearing they have an Informational Meeting, which will take care of a lot of problems before the Public Hearing. They set up a display in a room for two days and have someone there to answer questions. John suggested that we do the map with the zoning and mail it to the people in the Impact Zone. Dell suggested that they be hand delivered and explained to the people before the hearing. RE: MOTION PASSED TO ACCEPT THE PROPOSED IMPACT ZONE MAP A motion was made by Richard that we accept the map as drawn by John Millar according to the recommendations tonight to represent the proposed Impact Area and that the Rexburg Zoning Ordinance be enacted in it's entirety in the Impact Area, plus an Agriculture Zone. (map on file at City Hall) Seconded by Jeff Walters. All Aye except Marsha Bjornn voting nay. The next meeting will be held on December $ at 7:00 P. M. Meeting Adjourned. •
