Janet Williamson was present to take minutes.
John Millar welcomed Jahn Watson to the planning committee.
Jim Long made a motion to approve the minutes. Marsha Bjornn seconded
the motion. All aye.
RE: BUFFER ZONE BY C & L BODY SHOP DISCUSSED
Mrs. Hanson - 279-West Main: She has the property just west of where
C & L is building their addition. She is concerned about the buffer
strip and how it will look. They didn't even know that the house was
gone and that C & L were building there. They came back Memorial Day
and the house was gone and the fence they had built had been torn
down. Rose told her the Zoning Ordinance does say that C & L does have
to put in a 7 foot buffer zone between the properties. In talking to
the owners of C & L they were wondering if she was going to put in a
fence. Since they tore it down she doesn't think she should have to
put one back up. In looking at the property between them she can see
that if they have to put in a 7 foot buffer zone they are not going to
have very much room between the buffer zone and the building. If they
would prefer to put a fence - a fence that we could not see through -
then we would be willing to settle for that. The original fence that
we put in was a see-thru one but at that time the property next to us
was residential. Now C & L has moved the house and is building on that
property and we feel that the fence needs to be one that we cannot see
through. Some discussion:
- he has to do the buffer
- a 6' fence would not hide the building but would hide the cars.
- Gary told us if he had to put in a buffer cars would just drive
over it.
- must hold tight on buffer zone.
- He has to do trees in the buffer zone.
- Page 32 of the Zoning Ordinance says they have to plant and
maintain the buffer.
John Millar explained to her that the buffer zone is required.
Gary Lewis knows that. That will be monitored by the City. In regards

to the fence she will need to contact Mr. Lewis and have him put it
back.
RE: VARIANCE FOR DON CHAPPLE - SHED IN FRONT YARD
Don Chapple - 137 S. 4th W. was at the meeting to see if he qualified
to apply for a variance for a shed in his front yard. Some of the
board had had a chance to look at it. After some discussion it was
felt that he could qualify for a variance because it is such an
exceptional situation - his front yard is a canal and there will never
be another house looking in to it (no neighbor whose property rights
you are trying to protect} and his house sits so far back from the
front road. He only has about 35 feet for a back yard. Mary Ann made a
motion to take it to public hearing. Jim Long seconded the motion.
All aye.
RE: QUESTION ON WHETHER A VARIANCE IS NEEDED FOR A GARAGE/STORAGE SHED
AT GREENBRIAR APARTMENTS
Ross Farmer was present applying for a variance for a garage/storage
shed to be built at Greenbrier Apartments (129 Princeton Court). He
passed out drawings (copy at end of minutes) and explained and
discussed the apartment complex set up:
- Not sure if it is a back yard or side yard because of the way
the apartment buildings are situated.
;' - If it is a back yard it needs to meet the 20 foot requirement
~ from the back property line.
- Building Inspector said he needs to be 10 feet away from the
nearest building.
- If you look to the properties to the east of it it is their back
yard. F
- That area is grass and sidewalk now.
- There was concern about emergency vehicles getting around there.
- Their request is to be 5 feet away from the property line -
pretty much in line with the rest of the buildings.
The feeling of the board was that they need to go look at it again. If
it is decided that it is a side yard and he builds 6 feet from the
property line he could just go ahead and start, he would not need a
variance.
Jim Long made a motion that they look at it and be polled by tomorrow.
Mary Ann seconded the motion. A11 Aye.
John Watson moved that if they do decide that it requires a variance
that they proceed to a public hearing at the next meeting. Jerry
seconded the motion. All Aye.
RE: REQUEST FOR A ZONE CHANGE FOR BRUCE SUTHERLAND WITHDRAWN
Bruce Sutherland has withdrawn his request .for a zone change and
conditional use permit at 165 N. Center.

r • RE: PUBLIC HEARING FOR A VARIANCE FOR A GARAGE FOR TERRY HENDRICKS
8:OOp.m - Public Hearing for a variance for a garage for Terry
Hendricks at 142 S. 3rd W. John Millar read a letter from Helaman and
Madge Stone objecting to the variance on the grounds that the fire
hazard would be greater. (copy of letter attached}. Mr. Stone owns the
property adjacent to it and it is a vacant lot. Terry said all his
other neighbors do not have a problem with the garage. Mary Ann felt
there is no hardship here. It is not even attached to the house so it
wouldn't qualify. Richard said that fire code required 10 foot
separation between buildings. John said if he removes the eaves he
could request a 6" variance. Terry said the size of the garage is 5'4"
and the drip line is another 18" out. When asked if he could situate
the building more to the north he said the problem he has with that is
he would have to go back another 4-5 feet. and come over 3 feet and it
would be off-set from the existing driveway. He has already poured the
cement to match the existing driveway and built on that. He thought
the builder had gotten the permit and the builder thought he had. He
would like to avoid the expense of having the builder move the
structure, pour another 5 yards of concrete, etc. Jim said they would
be restricting what the adjacent property owners could do with their
property by granting him a variance.
Jim Long moved to deny the variance. John Watson seconded the motion.
Voting aye were: Jim Long, Mary Ann Mounts, John Watson, Jerry
Jeppesen, Richard Smith, Devawn Beattie. Voting nay: Marsha Bjornn.
John Millar recommended to the City that they give him 6 months to
rectify the problem.
RE: RICKS COLLEGE HEALTH CENTER ADDITION
Ricks College was on the agenda for a plan check on the plans for an
1800 square foot addition to the health center. It was decided that it
was not necessary for them to come before planning & zoning. When it
makes an impact on parking and drainage they need to come.
RE: SIGN ORDINANCE
Devawn Beattie is drafting 2 sign ordinances for planning & zoning to
look at in the September meeting. Jim Flamm asked that they keep it
meaningful but lean. Have clear definitions of what your talking
about. Jim Long said that the towns that are the richest and the most
successful business-wise are the ones with the least amount of or no
signs. He suggested that they go to the Chamber of Commerce and the
business people and have an educational process. Some of the things
they would like to see in a sign ordinance are:
- restrictions on height
- restrictions in residential area on size and location
(check out sign by 4th Ward church)
. - total square footage
- Murals?
- what signs are made of

John Watson said a lot of people are simply not aware of signs. He .
likes the idea of educating the people. He has seen a film called
"Visual Pollution". John Watson or Devawn will try to get a hold of
the film and see if something can be done about educating the people.
RE: DISCUSSION OF SIDEWALKS
Sidewalks discussed. The City is getting more in. The City Council
has approved a Citizens Sidewalk Committee to resolve the problem of
areas that do not have sidewalks. They would like planning & zoning to
give them some suggestions of people for the committee. Names
suggested: Geri Zerker,Carmen Sutherland, Nancy Tingey, Jom Long,
Frank Daniels, Curtis Hawkins, Dick Dyer, Lauana Boyle, Wes Lawrence,
Rick Davis, Kevin Call, Marty Croasman, Vaughn Price, Steve Hadlock.
Jim Long asked for names for people to be on a committee to develop a
City/County Master Plan for bike paths. Some suggestions: Dusty
Cureton, Dean Peterson, Doug Smith, Marsha Bjornn.
John Millar moved to adjourn. Jim Flamm seconded the motion. All Aye.
