A motion was made by Davawn Beattie to approve the minutes. All Aye RE: REQUEST FOR ZONE CHANGE FOR DOCTORS OFFICES AT 377 E 1ST N - GARY & BONNIE SKOY Gary and Bonnie Skoy, 177 North 2000 East - They would like to request a zone change at 377 East lst North to allow for professional doctor's offices. In the last couple of years they had realized there had been a need for Professional Doctor's offices. There have not been many places for Doctor's to lease or buy. The hospital is negotiating with several more doctors to come into the area next year. The doctors want a place as close to the hospital as possible and they felt that this piece of property would have good access to the hospital. They propose to build at least one building to start with and possibly another one later. It would be a small building with ample parking and landscaping. At present the home on the property is in poor shape as is the yard. Jim Long asked if they were aware that Dr Crouch has five lots available for doctor's offices and a little closer to the hospital. Mrs Skoy told the board that Dr Gates is presently in with Dr Crouch. There is a new doctor coming in to work with Dr. Crouch, so Dr Gates will have to find a different office. {discussion on Dr. Crouch's medical plaza) Several residents from that area were at the meeting. John Zirker- He lives on the corner of 4th East and 1st North. Through a pole of the homeowners in the area, without exception, every single homeowner is against this change. Years ago when that piece of property was rezoned by the original owner, Orson Smith, it was felt that this property needed to be protected as residential property. Every home owner signed the agreement to protect that particular area. When the street was put in on 4th East, it was reduced from what it was originally planned by the city, because they said it was not going to be a thoroughfare. If you go just south of our street, the street is 15 feet wider. Since then the park has become more popular, the high school has been put in, the church has been added and two medical • • • ' ~ ~1 offices have been added. The pressure on that street is tremendous. If you try to get down his street when the buses come down, it is a thoroughfare. If you go to the Medical Center anytime, cars are not only parked in the parking lot but also on both sides of the street. If you do the same thing on this corner at 4th East and 1st North, there would be cars parked there all the time. When there is a high school game there are cars parked all up and down the street and it becomes very narrow. If you have a bus or truck go down the street it is really narrow. The area was not designed to handle the kind of traffic it has right now. Mr Zirker had to pick up three little kids that had been hit in front of his house. There are no sidewalks and it forces them all into the street. What we have is a residential area that we keep adding to and putting more pressure on. We have homes we would like protected, and that is the reason we have a Planning & Zoning Commission. Since Orson died and his sons Lewis and George have the property they have had ample time to sell that property as residential, but they want to sell it as commercial so they can get more money-out of it. The residents would like to see it left as it is. Bonnie Skoy- Lewis and his wife indicated they represented a family trust and in fact they claim that Orson did not have the ability to change the zoning because he was not the owner at the time that the agreement was signed. There is a lot of traffic there, but a doctors office is not open until 9:00 A. M. Our city was named as one of the ,\~ 100 best little towns and that has caused people to come in and relocate. Part of that is going along with the hospital's intention to put on a new addition. That addition will be bringing in more physicians and they must have some place to locate. There should be an ordir~ar~ce to keep people from parking along a city street. Leigh Pond - If the zone is changed to R2, does that mean they have to build a medical center, or do you change the zone and then they can build what they want? John Millar said we can put some stipulations on a zone change. That is a very busy place for children. When there are ball games there is no place to park, so people park on both sides of the street. We are concerned with safety. Mr Skoy said that parking lot would be empty at night and would be available for parking for ball games. John stated that the next step is to take it to public hearing or table it. Jim stated, it has been a short time since we developed the new Zoning Ordinance and if it were appropriate for the zone to be changed to multiple units and professional offices, why didn't we make that change at that time? At that time after we went through a lot of thought and discussion, we zoned this property R1 property. He wondered if he could vote to change it now. Mary Ann stated we realized there was a need for medical and professional office and spent a lot of time to locate space for that and discussed it at such great length, she would be surprised if we want to change it. • Mary Ann stated that legally we can't refuse to take it to public hearing, but this would give them a feeling as to how we think the 0 ~~~` public hearing would go with what we have right now. Jim recommended that it be tabled because from his point of view and what he hears other people saying, he did not think it would get through a public hearing. Seconded by Mary Ann Mounts. All Aye. Bonnie Skoy stated .that she thought this was the time for the board to discuss it and was not aware they were to bring witnesses in their favor. They would prefer a public hearing, so they could present information from their side. A motion was made by Marsha Bjornn and seconded by Mary Ann Mounts to go to public hearing. All Aye. RE: PUBLIC HEARING: CONDITIONAL USE PERMIT FOR BRENCHLEY APARTMENTS GRANTED 7:30 P. M. Public Hearing for Greg Luce representing South Brenchley Partners requesting a Conditional Use Permit to develope an addition to Brenchley Apartment with 30 units of senior citizen housing on 5th South between 3rd West and 4th West, Lot 4 and Lot 3 of the Klingler Addition. Gregg Luce- Developer of proposed project, explained the project. There was no one at the meeting to discuss the issue or with any opposition. A motion was made by Mary Ann Mounts to issue the Conditional Use Permit to allow these apartments to be built. Seconded by Marsha Bjornn. All Aye RE: DISCUSSION OF DEVELOPMENT OF 5TH SOUTH , John Millar told Mr Luce that 5th South will have to be developed as a portion of this project with developer costs. Mr Luce asked for an explanation of the development of the street, would he be required to build half of the street and the property owners on the other side of the street have to develope the other half? John told him that was the legal requirement and would need to go to City Council, possibly it would be time for an LID and put in the whole street because we don't want to build half of a street. Jim Flamm said he would follow up on it and talk to the City Council. Mr Luce was told he would also be required to put in a sidewalk. RE: DISCUSSION OF ADDITION TO FARM BUREAU Dean Schwendiman, President of Farm Bureau, was at the meeting to discuss putting an addition on their building. The Farm Bureau Federation own the building and lease it to the Insurance Business. The Insurance Business has grown and they want more room or a new building. They would add the addition onto the west. They want to make sure they have enough parking. It appears they would have the parking. John told him it is zoned okay and as long as they meet the setback and parking. With that size of the addition they would need to develope a site plan showing the parking and the parking lot would have to be surfaced. They would have to have the per cent of landscaping required. Igo RE: DISCUSSION OF SHED OF DON GRAPPLES - 137 S 4TH W Don Chapple- 137 South 4th West- He had built a shed in his front yard, which is not in compliance with our ordinance. Mr Chapple stated that he is not familiar with the zoning ordinance and put the shed in the front yard because it fits the arrangement where his house is located. Most of his yard is in the front. The house sits back 75 feet from the road. John read out of the zoning ordinance "4.4 that accessory sheds are not allowed in the front yard". John told him the only option is a variance. It is hidden in the trees and no one lives across the street. It is across from the canal. It is built on a concrete pad. He could move it but it would be hard. He has had power to that spot for a long time. Jerry Jeppesen made a motion that we table it and give us a chance to look at it. Seconded by Mary Ann Mounts. All Aye RE: REPLACEMENT OF FENCE AT VILLAGE COMMUNITY GARDENS Mae Hawkins, manager of Village Community Gardens was at the meeting to discuss the replacement of the fence built on their South property line. She said they was not aware of any ordinance. They previously had a board fence and replaced it with a chain link fence. The old board fence was breaking down, it was 5 feet high and they went to a standard 6 foot chain link fence with vinal slats. John asked how long the board fence had been in? They told him it was built in 1978, when the complex was built. Mary Ann stated the wood fence was lower and ;~ this fence comes out a little bit further. When a fence is Grandfathered in, it is Grandfathered exactly like it is. You can't go up even one inch. If something is taken down, it can be put back exactly the same, but once it is taken down and put back different, they have lost the Grandfathering and they have to comply with the current zoning. That fence has to comply with the current zoning and will have to be only 3 feet high back to the setback. John explained where the property line would be which is about one foot behind the sidewalk. A motion was made by Mary Ann Mounts and seconded by Davawn Beattie that they would have to comply with the Zoning Ordinance. Those voting aye: Mary Ann Mounts, Jerry Jeppesen, Da Vawn Beattie, Marsha Bjornn, Jeff Walters. Those voting Nay: Jim Long, that we need to be consistent. The city was not in compliance with the fence they built around the old pump house. Motion passed. John stated that the old fence was in violation. RE: PARKING LOT ADDITION AT THE HOSPITAL The next item on the agenda was the parking lot addition at the hospital. We approved a site plan and we had public comment on it, but the price was so good they kept paving. John Watson and Keith Steiner were at the meeting to explain their plan. (showing a plan and pictures} The hospital will expand and a second level will be built. They had neighborhood meetings and community meetings and presented the plan. The various projects that have been done for the past two or three years have been consistent with the direction the hospital intends to go. When they came to P & Z before and got approval to bid and construct new asphalt, at that time they discussed site drainage, parking, and landscaping. When the hospital expands to the second level, John Watson's calculations are they will need two parking spaces per bed which is 192 spaces. Right now with the completion of the paving so far including the parking up front, they have 180 parking spaces. The hospital elected to put only one access onto Millhollow. They will put some catch basins in and a dry well. John Watson discussed the drainage, the landscaping strip, buffer and sidewalk. The ordinance requires a 7 foot buffer and a 4 foot sidewalk. There is no right-a-way for the sidewalk along Millhollow; it will have to go on the hospital property. John Millar told him if the drainage handles water adequately there will be no problem, but if you increase drainage off the property it is your responsibility. (discussion on the sidewalk) They had put in fire hydrants already. (Mary Ann left at 8:45 P. M.) The board told Mr Watson that they would be required to put sidewalks in as they develop it. They do need a building permit for putting that much asphalt in and the city needs a copy of the plans. The sidewalk could be brought back in a little ways, within reason. RE: GARAGE OF TERRY HENDRICKS AT 137 S 3RD WEST Terry Hendricks - 137 South 3rd West- Mr Hendricks is in the process of building a garage. He did not get a building permit. Terry explained, the garage is not attached to the house, but will match the house. The side of the garage is 5' 4" from the fence. The drip line is 16" too close to the fence, or 3' 6" from the fence. The lot next door is vacant. Possibly he could buy some property from the next lot. At this point he is stuck. (discussion) Davawn suggested that he try to buy property. J. D. stated that it should be the contractors responsibility to get the permit. He felt he should move the garage. John Millar read out of the Zoning Ordinance that he would need to have 6 feet from the property line. A motion was made by Jerry Jeppesen and seconded by Jeff Walters that we set it for Public Hearing for a variance. (discussion) Seconded by Marsha Bjornn. All Aye RE: DAVE PINCOCK RESIGNS - NEED NEW BOARD MEMBER John told the board we need to suggest some names for a new member on the Planning Board. Dave Pincock has resigned because of increased work at his job. Jim and Marsha recommended John Watson. The board felt that the city needed to do something to show recognition for all the work he had done on the Planning Board. A motion was made by Jim Long and seconded by Jeff Walters to adjourn.
