Work Meeting
1/13/93
Those Present:
Planning Board: John Millar, Jim Long, Scott Mortensen, Dave Pincock,
Mary Ann Mounts, Marsha Bjornn, Richard Smith, Davawn Beattie. Excused:
Jeff Walters and Jerry Jeppesen.
Mayor and Council: Mayor-Nile Boyle, Council- Brad Liljenquist, Nyle
Fullmer, Jim Flamm, City Attorney- J. D. Hancock, City Clerk- Rose
Bagley.
County: Commissioners - Dell Barney, Dave Rasmussen, Marlin Hill,
County Clerk - Beth Reese.
John Millar told the group that this meeting was an informal work
session. No formal business would take place.
J. D. Hancock had drafted an Ordinance with rules for the Impact Zone.
The county will have to do something similar. Karen Rogers & J. D.
worked together on this ordinance. They had tried to incorporate what
had been discussed at previous meetings.
Dell Barney stated we should address the animal issue without naming
names, possibly put in legal descriptions of the property, because the
zoning goes with the property not the person. There were additional
names that need to be added to that list. We need to work to get it
right. Leave the number line for the amount of stock up to the
ranchers.
Dell Barney said people have told him they don't want to get permission
to designate when they are coming back in to cattle business.
John told him the intent is when they go out of business they need to
notify the Planning & Zoning so they will know how to protect the
property.
J. D. Hancock stated that they need to submit a written declaration of
abandonment filed with Planning & Zoning.
A discussion on Home Occupations- It should be more liberal. It should
be stricken. It should be stricken from Agricultural. It should be put
in Rural Residential.
Discussion on HBD.
Marlin Hill suggested that on the building permit they state the
intention for the property. We need to form a committee for a common
law court with 12 people to make the decisions as if it is right or
wrong.
Richard Smith - To make me subject to court, I would not like it. This
group is doing the same thing.

Dave Rasmussen thought the less rules and regulations the better. •
Could the county set a sub division ordinance and arterial rules on
building.
Dell Barney stated that planning is needed in Madison County for
Madison County by Madison County.
Suggestion that we need to shrink the Impact Zone down to the area that
we think will be annexed and progressively change it.
If the county would get some ordinances regulating the arterials and
sub divisions that would help.
Dave Rasmussen suggested that the county form a committee and discuss
it and put something together. This might work. He asked what time
frame the city would want. Dell Barney said it might take a year.
Dave suggested two or three months.
Jim Flamm suggested that we loosen up the conditional use requirements.
John Millar said if the county will look at that we will look at
bringing in the boundaries. He suggested that some city residents be
on the committee.
Jim Long felt there needed to be an interim ordinance to restrict
arterials on county roads.
Brad Liljenquist felt that sub divisions, arterials, business and
industry should be included.
John Millar said if this committee will happen, we will take no further
action for a three month period.
Richard Smith - Asked the county if they were willing to set up a
moratorium for requirements on sub divisions, arterials and what ever
that is not in the process yet. This really requires immediate action.
It should be that nothing can be done without the commissioners
permission.
John Millar stated that a total moratorium is not fair, but we need
assurance of progression in three months.
Dave Rasmussen said they would put together a committee and get some
feeling.
Dell Barney thought we would see a positive reaction.
Brad Liljenquist felt we could give them three or four months, but
could not drag it out for one year.
Dave Rasmussen asked if they could have until June 1, they would form a
committee and get a feeling. Richard said by 6 months we would need
firm rules set. The city will look at the boundaries of the Impact
Zone. A sub division ordinance should not be as restrictive as the

~~ i city sub division ordinance. J. D. Hancock suggested they could check
with other counties who might have a sub division ordinance.
John Millar polled the board members. If we give them a 90 day period
and the county would move on what they can and we will define the
Impact Zone.
Dave Pincock - We should give them 120 days.
Mary Ann Mounts - Yes it would be okay.
Davawn Beattie - Yes, give two dates - one date to .get back with us and
another date to finalize it.
Scott Mortensen- I'm in favor and agree with Davawn, we need to define
what the area of city impact is and include Industrial and Commercial
concerns.
Jim Long - I would like to see the committee communicate with the
Planning & Zoning. I would like to see some communication with the
people to let them know what if happening and organizing the positive
people.
Marsha Bjornn- Would like to see Richard and Jerry on the committee and
give them 90 days.
John Millar said we would put it on hold for 120 days. If nothing is
done then we will work toward passing this ordinance. We will bring in
the boundaries of the zone to a 15 year growth.
We hope they will invite one of us to attend the meeting.

Suggestion that we get a letter out to the county and in turn it be
sent to the paper to be published. We need to describe what is going
on in the paper.
Marsha suggested that we could have a question and answer format put in
the paper with the answers.

Gentlemen,
Oil behalf of the Rexburg Planning and Zoning Commission,
I would like to thank you for your discussion and input at our
recent work meeting concerning the proposed Area of City Impact
surrounding the City of Rexburg.
- Pursuant to discussions at the meeting, it is the
understanding of the the Planning and Zoning Commission that
no further action shall be taken by the City of Rexburg towards
implementation of the impact zone for a period of 120 days.
During such period of time the County Commission shall take
necessary action to study anc': investigate possible rules and
regulations which may be irnplemented to address rnany of the
problems which face our County because of increased growth and
development. Everyone agreed that the following problems should
be specifically addressed:
1. The building of homes or other structures on County
roads, especially arterial roads, which inhibit the use of such
roads for their original intended purpose of moving traffic
throughout the County.
2. The construction of residential subdivisions or
housing developments that are not constructed or planned in
a manner that provides for proper sewage disposal, drainage,
ingress and egress or other necessary residential housing
functions.
3. New development, whether residential, industrial
or commercial, should not be allowed to adversely effect existing
agricultural uses.
4. New development in the county should not be permitted
which will adversely effect existing uses of properties lying
within the city limits. of Rexburg which bound or are contiguous
to the City/County boundary.

Ladies and Gentlemens
I have been asked to respond to your letter directed
to the Madison County Commission dated January 18, 1993. Please
be advised that following the work meeting the Commission
discussed the issue of county planning with many residents of
the county to determine attitudes and and feelings regarding
planning generally. The Commission subsequently appointed a
County Planning Committee to make formal recomendations to the
Commission regarding county planning.
On the Committee's April 7, 1993 meeting the following
two rnotions were unanimously approved by the Committee:
1. The Committee agreed to go forward to develop a
Comprehensive Plan for Madison County and submitt the Plan to
the County Commissioners for approval.
2. As part of preparing the Comprehensive Plan, the
~ Committee has agreed to initially, and immediately, address
the problems and issues listed in your letter of January 18,
1 993.
The Committee shares your concerns regarding the problems
enumerated in your January 18, 1993 letter and wishes to express
its desire to work with the city of Rexburg in providing
solutions to those issues.
