D. Hancock The mayor and other councilmembers arrived during the meeting. RE: PUBLIC HEARING FOR ZONE CHANGE - WALKER SUB DIVISION Public Hearing 7:00 P. M. John Millar read the notice of the hearing. NOTICE IS HEREBY GIVEN that a public hearing will be held and conducted by and before the Rexburg City Planning and Zoning Commission of ~ • Rexburg, Idaho, on Wednesday, the 25th day of July, 1992, at 7:00 p.m., in the Council Chambers of the City Building at 23 North Center, Rexburg, Idaho, regarding a proposed amendment and change of City of Rexburg, Idaho, Zoning Ordinance No. 725, to provide as follows: That the following described property be zoned H.B.D. rather than Industrial as it is presently zoned. That said property is located in Madison County, Idaho, and is described as follows: An area bounded on the east by North 3rd East, south of the Teton River, north of the Rexburg Canal, and west of east City Limit line. At such hearing the Rexburg City Planning and Zoning Commission will hear all persons and all objections and recommendations relative to such proposed amendment and change. John Millar asked if there was any public comment. Dale Walker was at the meeting and stated that he was for the zone change. Jim Long asked about the other part that is zoned industrial in back of Wendya and north of the river and east of the railroad tracks. Do we really want that left zoned industrial? John said his personal feeling is that it will never develop as industrial. John told him it could not be done at this hearing. The mayor said he thought we should start now • and get that zone changed. Jim recommended that it be zoned Highway Business District also. John said it would have to be a separate issue. IDS A motion was made by Jim Long and seconded by Scott Mortensen to • recommend changing the zone on the Walker Property from Industrial to Highway Business District. All Aye RE: MOTION MADE TO PROCEED TO MAKE ZONE CHANGE ON THE PROPERTY BETWEEN THE RAILROAD TRACKS AND 2ND EAST A motion was made by Jim Long that we proceed to make change on the property between the railroad tracks and 2nd East and north of the river from Industrial to Highway Business District. Seconded by Davawn Beattie. All Aye. Glen Pond said we will need to check with the property owners. John said the property is owned by the church and Tri County. A motion was made by Marsha Bjornn and seconded by Dave Pincock to adjourn. RE: R.V. PARKING DISCUSSED Jim Flamm told the board that he had been working with the people about their R.V. Parking. Mr Palmer will put in a pad in the back of his house next summer. Mr Perkins will do what ever he needs to do. He understood that was the rule when he moved in. Jim said he would like to see us put a time limit on it and say we would back off for one year and give everyone in town a year to get a pad or find another • alternative. We could get it in the newspapers and then enforce it. John Millar said he thought it would be a good idea especially if we could get the news coverage. (discussion) Jim Flamm said he wanted the ordinance clarified that it is 16 days and you can't move it and put it right back. The issue would be tabled for the next meeting. Jim Flamm asked if we could talk about sidewalks at the next meeting. He thought we should give a time limit on sidewalks and then put them on an LID. RE: DISCUSSION OF SIDEWALKS AND LID'S John Millar said in the 20 years he had worked for the city he had never seen them force an LID. Nile Boyle asked J. D. when the sidewalk was not put in before the Sub division ordinance, can we force the people to put them in now. J. D. said if it is on the city right-a-way we can force it through an LID, if you want to. (discussion on enforcing sidewalks). Jim Long said if you are creative with sidewalks and not make people put them in straight that would be different. RE: ZONING OF JACK COVINGTON PROPERTY - 125 1/2 E. 1ST N. Nyle Fullmer said he was contacted by Jack Covington. He owns some property at 125 1/2 East 1st North. His property had been zoned commercial for 30 years and has a welding shop on the property. He is 68 years old and getting ready to retire. He has felt that his business and property has been his retirement. It has now been zoned • LDR1 and he feels that when he gets ready to sell his property he won't be able to sell it for a business. He has invested a lot of money in %~9 ~'~ his business. Nyle felt he had a valid point. The property will be grandfathered. He might-want to sell the property for a different kind of business. Dave Pincock said if he wants to change the use of the property, the zone would have to be changed. Jim Long stated that we can't guarantee the depreciation of a piece of property. Nyle stated that we need to be flexible. John asked for a vote on the motion to adjourn. All Aye. i• •
