A special Planning & Zoning Meeting was called to check plans for
apartment site plans.
RE: JIM & CHERYL DAYLEY - APPROVAL OF A SIX PLEX APARTMENT COMPLEX

Jim and Cheryl Dayley were at the meeting for approval of a six plex
apartment complex. It was felt that there should be parallel parking
• on the East Side. John Millar asked if the south line was against
Rasmussen's property and wondered if it would require a retaining
wall. Dave Rasmussen said it was not.-They were told if they show so
many parking places, we will expect you to put that many in the parking
lot. There was no problem with the plans as long as there is enough
parking.
RE: DEAN BIRCH PLANS FOR APPROVAL OF A SIX PLEX - VARIANCE DISCUSSED

Dean Birch plans for approval of a six Alex. The plans showed this
phase and the existing phases. Prior to the new zoning ordinance the
property was zoned commercial and HDR could be built in that zone. One
problem is HDR requires a rear yard set back and commercial property
did not require the set back. He has a six foot rear yard and the
ordinance requires a 20 foot rear yard. He has complied with a side
yard. John said he did think there was justification for a variance,
but he did not see anyway to do it without a variance. A motion was
made by Jim Long and seconded by Mary Ann Mounts to recommend a
variance for Dean Birch's apartments. All Aye
He has filed an application for a variance. Dean asked the board
about building another building and they felt there wasn't any problem.
RE: PLANS FOR A SIX PLEX AT AUTUMN WINDS - DAVE RASMUSSEN

• Dave Rasmussen presented plans for a 6 plex at Autumn Winds. Showing
the existing plan. He submitted the plot plan last year when he got
his building permit. He showed on the plan parking along the street,

coming in off the street parking on the back side of his building.
With the 20 foot set back he would have to eliminate all the parking
across that end. Dave said he had eliminated a building last year to
put in more parking. John told him that parking for apartments he
built was different than on the old buildings. He needed to check his
parking to see if he needed all the parking he was planning to put in.
Dave had planned a planter and planted trees and shrubs in the
planter. The planters come out around the back. He did not plan to
park on city streets, he had 87 feet and 30 feet inside the property
line for parking. He already has a curb cut. John said it would be
parking in the set back. He wants to keep the curb cut and have
parking straight in. John told him our current ordinance and previous
ordinance prohibited parking in the set back. Dave said he would have
to eliminate one building if he did not use that parking. He was told
the only way he could use that for parking is if we gave him a
variance. It would not qualify for a variance. (discussion on
parking) If he did not put the last building in he could get a permit
for these apartments. A motion was made by Jim Long that we do not
accept the plan, it is not in compliance and does not comply. Seconded
by Mary Anne Mounts. Those voting aye: Mary Ann Mounts, Jim Long,
Davawn Beattie, Scott Mortensen, Dave Pincock. Voting nay: Jeff
Walters, abstaining: Marsha Bjornn. He was told he should pursue
checking his parking to see if he would have enough without using that
parking in the set back. He was told he could go ahead and build the
building he was planning to do this year, but could not do the final
building on his master plan. Terry Leishman would have to verify the
parking for this one building. When he builds the last building the
parking will have to be resolved, he could calculate the parking with
the new compact car formula.
RE: REQUEST TO BUILD ON PROPERTY ON BARNEY DAIRY ROAD - VAL GROVER

Val Grover representing Gallary Photo Lab. Request to build a photo lab
on the property on the Barney Dairy Road on the Walker Property near
the ASCS office, John Millar stated that our Subdivision Ordinance
passed in 1984 governs the sub dividing in the city. In the Sub
division ordinance under 1.3 on page 2 "The subdivision of land into
three (3) or more parcels for transfer of ownership. All of such lots
or parcels created pursuant to this ordinance shall front upon a
publicly maintained street unless specifically approved by the Council
after recommendation of the Commission." The situation we have is this
parcel was part to the original Willis Walker property. John said he
could count off six parcels that had been sold off that property. The
proposal tonight is to sell one more parcel, This is the same problem
we are having now on the north highway with Wendy's. John said before
we proceed a subdivision has to be done. The ASCS and Amdoll were sold
in violation of City and State Laws.
VaI protested that his business is seasonal - from September to
December the business doubles. If Rexburg has a business doling money
into the community we need to try to improve the situation.- John said
the law stated it will be subdivided. Jim stated that it is not the

P & Z's problem, any further sale has to be according to the
subdivision ordinance. John said we could not issue a building permit.
A question why they could get title insurance.
Val said he woi,~ld have 12 to 15 employees. The board told him their
hands are tied.. The Walker family will have to subdivide the property.
He was told to talk to the mayor and the city attorney.
