A motion was made by Dave Pincock and seconded by Dan Hess to approve

RE: PARKING FOR APARTMENT COMPLEX ON 2ND E. - BILL HENDERSON
Bill Henderson - Presenting plans for parking for an apartment
complex. The complex would be on 2nd East between the Reserve Center
and the old Radio Station, the parking would be off of Harvard in the
Sherwood Hills Subdivision which is zoned LDR1. It would be a 57 unit
apartment complex for 342 students. (showing plans of the parking) He
said he had six extra parking places. John Millar told him because of
the size of an apartment complex having over 24 units it would have to
go though a Conditional Use Permit and have public hearings. Bill said
he was asking the board's opinion if the parking was allowed in a LDR1
Zone. John said his only concern was the traffic onto the two streets.
It would come onto Harvard and it is a narrow street. Bill said the
parking lot would take five building lots. John said after reading in
the ordinance it is not specifically allowed by the ordinance but is
not precluded by our ordinance. Because they are required to have a
Conditional Use Permit we can put some constrains on it. Jim Long
asked if one of the constraints could be to widen Harvard. John told
him it is set up for Harvard to meet city standards, below that Harvard
is sub-standard. Jim told Bill the ordinance says the parking has to
be screened with a landscaped buffer. John stated that we can add that
to a conditional use permit. Bill said they could move it over and put
a row of trees or a hedge. Jim asked the impact all this asphalt would
be to the storm system. John said it would be a significant impact.
There is storm drainage to that site which is already over loaded and
we might have to work with Bill to get some detention in the lot. Bill
said he would put curb and gutter, sidewalks and the buffer zone. Mary
Ann said she thought it was a good buffer between apartments and
housing. Jim said he thought it was a good buffer if it was landscaped
correct. John told them they could not utilize the set back area for
parking, so there would be a 25 foot buffer from the property line not
curb. Bill thought that was a waste to have that much set back.

(discussion) Jim said we are involved in a new ordinance because we are
trying to make Rexburg a better place. John said last year we were the
bad guys because we required so much parking and set back and where the
bottom line is maybe developers are trying to put too many apartments
on the land they have; maybe our position is, if there isn't enough
land then the developer needs to back down the number of apartments.
The board members agreed, that he will have to work within the
ordinance. John told him the city would require two entrances for a
parking lot that big. Bill felt 25 feet was too much; he would not
complain with 15 or 20 feet for a set back. This would make it a 40
foot street. John said there is no reason to put more than a 40 foot
street in because there isn't anything that ties into it except a 30
foot street down below. On the street master plan it shows a 40 foot
street. John said there is a possibility that the city would quick
claim ten feet on the east back to Mr Henderson or abandon it. The west
side has not been dedicated, and so there is no dedicated right-a-way
on that side. It would allow them to move their property line closer
to the road and thus put their parking closer to the road. It was then
established that the parking would be allowed in this zone if the set
backs were met. He could then maintain the property line on the west
if the city would abandon 10 feet of the right-a-way on the east and on
the north he would have to put a 7 foot buffer and on 3rd south he
would have to go into the set the parking lot in to gain the set back.
On the west the set back would have to be moved back a little even if
the city would agree to abandon 10 feet. He would need a conditional
use permit for the apartments. •
RE: COMPLAINTS ABOUT DUMPSTERS AT SNOWVIEW
The Planning Board complained about tre dumpsters at Snowview and other
apartments being right out on the street.
RE: DISCUSSION OF ZONING IMPACT AGREEMENT
Zoning Impact Agreement with the county was discussed. This would give
the city control over development within a specified boundary around
the city. The mayor had asked the Planning & Zoning to define the
boundary or the area of impact. J. D. said the state law says we have
one mile if we want it. We would control the impact area.
Discussing boundary as a recommendation- going west to U.S. 20 except
for the area within the Teton Lakes Golf Course - the sub division
interior to the golf course should be in the impact area - going to
the Hibbard highway, and a quarter mile south Pole road to protect the
frontage - east line of sections 20, 29, 30, 32 - go north east corner
of section 20 and the north quarter corner between 17 - parallel the
highway from that point out to the Moody highway - west along the moody
highway to the Egan Parker highway - come back down the highway back
over to highway 20 back down the highway where it intercepts the north
line of the golf course and back over to 2000. The goal is to not end
up with sub divisions like we did up on the hill that are build out of
compliance with city ordinance and the city had to go back in and put •
sewer to them and they are on city water. They are still out of the
city limits. This would give the city control over sub divisions. The

county commissioners will probably have a public hearing before they do
this and it might be shot down. John said he would draw a map with the
outline.
John suggests, as part of this down the road, we might look at another
class of residential area and call it a rural residential or an
agriculture zone.
Discussion on amending the comprehensive plan. We need to wait until
we get the property description for the mall and get the impact area
settled.
RE: APPROVING ON ADOPTION OF THE PARK LAND ORDINANCE
A motion was made by Mary Ann Mounts to recommend approving an adoption
of the park land ordinance. Seconded by Jim Long. All Aye
RE: RECOMMENDATION OF A STORM WATER CONTROL ORDINANCE
John Millar suggested that we need to recommend a storm drainage of
storm drain run off ordinance. We need to look at selling it as a
separate utility. A motion was made by Jim Long to recommend a storm
water control ordinance. Seconded by Mary Ann Mounts. All Aye.
RE: DISCUSSION ON CHANGING NAMES OF 350 SOUTH & 450 SOUTH
'• A discussion on changing the names of 350 South and 450 South streets
as requested by the Post Office. This is the way our street naming
system is unless in a sub division. (discussion) A motion was made by
Mary Ann Mounts to keep the names the way they are and not change it,
seconded by Chris Mix. All Aye
