Excused: John Millar & Chuck Frost Also Present: Rose Bagley, City Clerk Glen Pond J.D. Hancock, Attorney John Millar had asked Glen Pond to preside over the meeting in his absence. RE: APPROVAL OF THE MINUTES A motion was made by Dan Hess and seconded by Mary Ann Mounts to approve the minutes. All Aye. RE: ZONE CHANGE FOR CAR WASH ON WEST MAIN ;~ Dee Thueson was at the meeting to request putting a car wash on West Main just west of the canal on the south side of the street. Dee said they felt there is room for another car wash. They would like to change the zone from R3 to commercial. Jim Long stated that he thought there was a traffic hazard at the crossing by the canal because of the change of the grade in the street. Dee said he thought it would make the area look good, and we need something on that side of town. Glen said in the new ordinance we are working on the canal will divide the commercial and residential. Jim Long said if we change it to commercial it would change the neighborhood, Chris Mix said she thought we should support Ra Nae Mc Gee's ideas on the zoning. Jim thought the people would object to the change in character of the neighborhood. Dan Hess said it is on the highway going out of town and think we should support him. It is unique there and has been a long time without anything. Jim Long also stated he felt the best use for that property would be multiple housing. Dan said he felt it was compatible with the traffic and highway. Mary Ann Mounts felt because it was against the canal it would not be compatible with for young married housing with small children. A motion was made by Scott Mortensen to recommend a zone change to Limited Commercial. Seconded by Dan Hess. Those Voting Aye: Chris Mix, Mary Ann Mounts, Scott Mortensen, Chris Mix. Those Voting Nay: Jim Long RE: REQUEST FOR A HISTORICAL CAFE ON 2ND SOUTH Ronn Ashliman was at the meeting to request a Historical Cafe at Rock House Cafe at 5 East 2nd South. Ronn said his family owns the Mc Culloch home on the North of Harmony House. He requested to put a sandwich shop in the house that is on the property. There is a lot of foot traffic. They are going to put Historical Photographs of Rexburg '7' (d on the walls. It will be a Historical Spot, it qualifies with the i Historical Society Register. The house is old and built out of stone like the tabernacle. It would be unique and the owners have agreed to sell it to him to make it a landmark. They would cater to only walk in traffic. They discussed parking requirements. He stated they could put 14 parking spaces in. There would be a beautification area on 2nd South. He did not think it would present a traffic problem. The zoning is R2 so the zoning would have to be changed to commercial. Jim Long told him the parking he had on the drawing would not work out according our ordinance, there isn't enough room for the required parking. He planned to put a fence up between him and Harmony House. Mr Ashliman said he wanted to have landscaping in the front yard like a park. Jim Long said he would vote for a restaurant if the open space and landscaping is left there. He asked J. D. Hancock if we could wave the parking and make sure it is a walk in restaurant. Jim Long made a motion that we recommend that he be granted the approval to use the property for a walk in restaurant with the provision that all the open space is maintained as open space and landscaping is left there and it would require the waving of the present and existing parking requirement. Seconded by Dan Hess. Chris Mix recommended that he be required to meet all building permit regulations. All Aye J. D. Hancock was ask to check and see if it was legal to wave the parking. r A motion was made by Dan Hess to recommend that the zoning be changed to Commercial. Seconded by Mary Ann Mounts. Those voting aye: Mary Ann Mounts, Dan Hess, Scott Mortensen, Jim Long. Those voting nay: Chris Mix. Jim Long told him that if the motion isn't conceivable he would not be able to put it in, because there isn't enough parking. He said he would come back if needed with an engineer drawing of parking. RE: REQUEST FOR ADDITION TO FOOTHILL MANOR Lorin Harris was at the meeting to request an addition to Foothill Manor at 106 East 2nd South. Mr Harris stated that at the present time we are set up for 17 girls. The college have required that we have managers next door to the apartment. He has just purchased the house owned by Hills next door on the East for the managers. He wanted to build on the south of the house 40 feet for another apartment. He would like to put 6 students in the addition plus the managers. Jim Long looked at his drawing and said it looked like he was taking out the front yard for parking. Mary Ann asked him if he had enough parking for the girls he has now. He only has 3 parking places. J. D. Hancock read from the zoning ordinance and told him he would not have enough property to build the addition on, so he would not be able to get a building permit based on the size of the property. Jim Long said he did not think he was meeting the code for parking on the house on the corner. Dan Hess left at 8:50 P. M. a~7 (~ /, i• RE: REQUEST FOR ADDITION ON SNOWVIEW APARTMENT Neal Brown was at the meeting to request putting an addition on Snowview Apartment at 12 West 2nd South. He has bought Max Brown's house next to Snowview Apartment and the white house next to Brown's owned by Dixons. He wanted to add on 6 more units. The white house would stay for managers. Jim Long told him he was unhappy because he had not left any landscaping and put all asphalt in front of Snowview, so he would vote against it if he planned to do the same. Chris Mix told him we need a drawing of the parking. J. D. Hancock asked him the square footage of the lots. We would need that to make sure it met the requirements of the zoning ordinance. The ordinance also requires 10~ of the lot to be landscaped. The zoning would have to be changed from R2 to R3. Jim Long suggested that he put parking in the back and landscape the front. A motion was made by Scott Mortensen to recommend that the zone be changed to R3. Seconded by Mary Ann Mounts. Those voting aye: Mary Ann Mounts, Scott Mortensen, Chris Mix. Glen Pond said Dan Hess voted aye for the motion before he left. Those voting nay Jim Long. He was told we would pass a petition but he would have to come back with a drawing of the parking and footage. RE: DISCUSSION OF A LANDSCAPING ORDINANCE Jim Long told the board that when Mayor Porter was in office he had asked him to work on a landscaping ordinance. We have a need for one. Jim had asked Beck and Baird Landscaping out of Boise to send a proposal for a landscaping ordinance. He would like to recommend that the council consider it. J. D. Hancock suggested that we might get a copy of an ordinance from Boise or Moscow. Scott Mortensen said he did not like to be too restrictive. (discussion) Chris Mix suggested that we need a happy medium. Jim suggested that each landscaping ordinance is unique for each city. RE: NEED TO AMEND MASTER PLAN TO ACCOMMODATE NEW PARK Glen Pond told the committee we need to amend the Master Plan to accommodate the new park. He and the mayor talked to the commissioners about amending the Master Plan. He suggested that after we get the feeling tonight on amending it, Rose could call and pole the others. We need to amend it so we can get a grant for the park. There was no opposition from the board and they recommended that the council proceed. There would have to be a public hearing. RE: STUDENT PARKING ON 1ST WEST A discussion on student parking on South lst West. J. D. Hancock told them it was against the ordinance for them to park on the lawn even if it was paved.
