RE: APPROVAL OF THE MINUTES
A motion was made by Scott Mortensen and seconded by Chris Mix to
approve the minutes. All Aye.
RE: DISCUSSION OF AN ADDITIONAL MEMBER ON THE PLANNING & ZONING BOARD

John Millar stated that we are short one member on the Planning &
Zoning Board and the mayor has ask that they make a recommendation.
Chuck Frost recommended that we choose who represents the local
business. Scott Mortensen recommend a builder. The names recommended
were: Terry Leishman, Bart Stevens, Charles Zollinger, Rod Hughs, Ken
Benfield, Steve Herdti, Jerome Barrick and Var Manwaring.
RE: DISCUSSION OF A VARIANCE REQUESTED BY HOOPES ESTATE
Dr La Var Withers was at the meeting on behalf of the Hoopes Estate.
It consists of two residents at 242 and 252 East 2nd North. This was
discussed at the last meeting. On the property there are two houses,
an older rock home and a red brick home. There are two sheds on the
property. Dr Withers would like to split the property and establish
the property lines and draw up two deeds. John Millar said the only
thing we had come up with in a previous meeting is in doing so it puts
the property in a variance situation so you can't comply with the set
backs with buildings that are already there. They wanted to draw the
line two feet from one of the buildings. Dr Withers said it seemed
logical to them to let the line go as close to the shed as possible.
From the advantage of the people living in the red house, you couldn't
even see that small piece of property from the house and the concern of
owing the small house is if there is two or five feet of property by
the shed will turn into a junk collector. Between the two buildings in
the back is a piece of grass with a sprinkling system.. He would like
to see that all in tact with the sprinkling system, because obviously
the person in the little house would take care of the property by the
building.

~ ~ John Millar told him that at the last meeting they had came to the
conclusion that it needed a variance, but we assured them that a
variance would be given, but it would have to go through the process.
Chuck Frost told him to have the lines drawn up on a plot plan and
bring it back to the Planning & Zoning. He told him they would need to
define the feet between the building and the property line, like 2 feet
for a drip line. This needs to be done before the deeds are drawn up
so there isn't any surprises. Glen Pond suggested that the members
of the Planning & Zoning go look at the property before the next
meeting.
RE: MOTION PASSED FOR DRAINAGE EASEMENT FOR THE RUN OFF WATER FROM
THE CRESTHAVEN STORM
Chuck Frost talked to the board about the Cresthaven storm run off
being a concern of the college. The college has the run off coming on
to the College property. The city has engaged Forsgren and Associates
to draw a proposed ditch. In talking with the people who farm the
college property, they would like to request an underground ditch or
pipe all the way along. John Walker, who is farming it, feels that
because of the steepness of the slope that we will have a high degree
of erosion. Another reason is if they ever decide to farm other areas
up there, which the college may do, then the ditch would cut the
. property and they would have to cross the ditch. The feeling of the
f campus planning and zoning is they would be amenable to granting
` easements to putting in an underground pipe if the city wanted to
pursue that, which would be along the south side of the property and on
the west side grant an easement for a retention pond. Scott Mortensen
stated that you are talking about a lot of money. Jim Long ask where
the funding would come from. Mary Ann Mounts suggested the only way
you could do it was with a Cresthave LID. John Millar stated that he
felt the city needed a storm drain Ordiannce. Evanston Wyoming has
a good storm drain ordinance. Chuck Frost said the further development
of that area would make the problem worse. Jim suggested building a
retention pond at the point of entrance from Cresthaven. There is
only one lot left and probably not large enough unless we got some
property from the college for a combination. Chuck said the property
that John was willing to give up he was not able to farm. He also said
someday there was going to be a street go through there.
John Millar said it is really a planning problem on the hill. Ninth
South will go along the back of those houses. Dan Hess said he thought
the cost would be too high. Chuck said the college feels it is a
community problem.
A motion was made by Scott Mortensen to recommend that they allow a
ditch be built to handle the run off either covered or not covered
depending on the funding. After discussion Scott amended his motion to
state that there be a drainage easement for the run off water.
Seconded by Mary Ann Mounts. Those voting aye: Mary Ann Mounts, Scott
~ ~ Mortensen, Dan Hess, Jim Long, Chris Mix. Abstaining: Chuck Frost.

A motion was made by Chris Mix to recommend that a Drainage Ordinance
be drawn up and passed. Seconded by Jim Long. All Aye. Jim Long
recommended that it should also cover flood control during construction.
RE: DISCUSSION OF HOME OCCUPATIONS
Brad Liljenquist was at the meeting. He said he was there to listen in
on the new ordinance. His main interest was. Home Occupations. His
wife teaches dance in her home but does not charge for it, so it is not
considered a home occupation. He would like to see her get paid for
it. He said he didn't know whether to apply for a Special Use Permit
or wait for the ordinance. Glen Pond suggested that he check the
Protective Covenants in that sub division to make sure they would allow
it. Home occupations was discussed.
RE: DISCUSSION OF A BASEMENT APARTMENT IN A HOME ON REED STREET
There is a home on Reed Street that has an apartment in the basement.
They would like to know if it is sold if the basement could still be
rented. It meets the City Ordinance The clerk was instructed to
write a letter telling them it meets the ordinance, but may not be
within the restrictive covenants which the city has no control over.
They would have to provide enough off street parking.
RE: A REPRESENTATION OF A PART OF THE DRAFT OF THE. NEW ZONING
ORDINANCE .
Re Nae Mc Gee presented part of the draft of the new Zoning Ordinance.
The next work meeting on the zoning ordinance would be held February
13, at 7:00 P. M.
