Hancock Glen Bean John Millar called the meeting to Order and explained the purpose. • RE: MAPPING OF THE SOUTH EAST QUADRANT OF THE CITY SOUTH, OF EAST MAIN AND EAST OF CENTER Re Nae Mc Gee explained the maps and what she had done. This is for the South East Quadrant of the city, south of east main and east of • center. The zoning in this area is primarily zoned for single family and also include duplex. RE: SINGLE FAMILY HOMES AND DUPLEX HOIsiE5 DISCUSSED Re Nae discussed the mixed use in some areas and buffering that from the single family homes. She ask if they wanted limitations on single family homes and if they wanted to be able to put a basement in and rent it. They indicated that if there was a duplex these would have to have enough parking. We would need to grandfather the duplexes and any commercial use in and just limit it to the ones that are there now. New commercial could be required to have more landscaping. There would need to be physical limitations on the site. Chris Mix ask if we would need to warrant a change in R1 because it is a college town. Re Nae said another issue is there is a hospital in the north end of the area and you have doctors who need offices. Where do you think those offices should be located. Home occupations and considering bed and breakfasts need to be considered. She ask if the traffic access to that area was adequate. She ask if they needed a park in this area. Residents felt this area should be R1 and anyone wanting a duplex would need a conditional use permit. It should look like a single family house, have the parking, and not create more traffic. Some of the questions was is a group of students a family? Can you • bring in relatives in to live in the basement without paying rent? With a duplex would you have to live there? Re Nae said she did not {` • know about the students, they don't have to be a man and wife or related by blood, but you could limit the number. You could have relatives if they did not pay rent and you didn't need to live in a duplex. The group specified this area should be R1 with no Conditional Use Permit for two family dwellings. RE: PHYSICIAN OFFICES DISCUSSED Physician offices were discussed. They were not comfortable with multi physician offices in a neighborhood. They felt that they should be put in the old hospital or on land east of hospital. They discussed manufactured homes. RE: HOME OCCUPATIONS DISCUSSED Home occupations were discussed. Tn Idaho Falls they allow in some areas home occupations if they don't have signs, if they have enough parking, if they don't produce noise or increase traffic. They also have a list of standards they have to meet. There is a staff level review of the home occupation. They can't not change the residential character of the home. They felt that a home occupation should not be allowed to have more than one client at a time. If it is a day care, ~\• you would need to put a number on the number of children. Re Nae in summary stated that the feeling tonight that this area should stay single family dwelling with larger lots,and more expensive. Meeting adjourned to a regular Planning Meeting. John Millar called the meeting to order. RE: APPROVAL OF A MODIFICATION OF THE PLOT PLAN FOR JIM NEWMAN'S DRIVEWAY Jim Newman was at the meeting to discuss a driveway problem. The zone calls for a 2Q foot driveway. His driveway is next to Steve Clark property. Mr Clark owns 2 1/2 feet of the Newsman driveway. We were under the impression we had one foot west of our garage. When we surveyed the property we found we were two feet short and would like a two foot variance. A discussion on the established property line laws. Mary Ann Mounts made a motion to recommend that he be given a variance under a hardship case. Jahn Millar stated that they would not need a variance only a modification of the plot plan. Mary Ann changed her motion for a modification of the plot plan. Seconded by Jim Long. All Aye. RE: DISCUSSION OF BONNIE AND GARY SKOY'S GIRLS RESIDENTIAL TREATMENT k • FOSTER HOME Bonnie and Gary Skoy was at the meeting: They would like to locate in Rexburg a Girls Residential Treatment Foster Home. It would house not ~~ more than twelve girls and would be licensed in the State of Idaho. • The girls would be between the age of 13 and 17. They would attend school and be employed in this area. These girls would be awards of the court by reason of being abused. These girls have been sexually, physically or mentally abused. There is no residential or group homes in this area of the state. They don't have a criminal record. It would be a residential home with a full time house parent. It is a family based service and a healing unit with family living. The state has designated this region to come up with an area. The board suggested that it would need to be put in R2, R3 or commercial. John Millar suggested that if it is R2 or R3 we would need to let the public know. If it is in commercial they would not need to come back to P & Z. There are residential homes in commercial zone that would be available. It is business related and would require a special use permit in a residential zone. Mrs Skoy said they would need a seven bedroom home. RE: DISCUSSION ON THE ARCHITECT'S STAMP ON BUILDING PLANS Dean Ricks was at the meeting to voice his concern about having to have an architect's stamp on his plans. He had not done it in the past. It would be expensive. He had plans already to go on a new apartment complex. Kent Jolly was at the meeting with plans for a motel. Dan Hess suggested that we should go with the reliable builders and plans. Jim Long said we would be hypocritical if we okay these plans and don't stick to the rule we set up at the first person to ask for an • exception. Chuck Frost said to be fair to everyone we have to have professional plans to make sure the city is protected. If we make a rule it needs to be fairly administrated. Kent Jolley said he had has his plans for some time and an architect was not covered under the financing. He did not feel it was fair to adopt a law and take action in the middle of an action. If you had actually passed an ordinance requiring this, you should have an alternative to have your qualified building inspector check them. Re Nae Mc Gee told the group that Idaho Fa11s has a licensed architect who checks the plans. They have a staff costing $100,000 to do plan checking. Builders pay through fees. They charge a plan checking fee. Jim Long said we need to stick by this rule for the safety of the community. Chuck Frost said maybe we could charge a plan check fee and send the plans out to be checked. Kent said these type of plans for the Super 8 Motel has been drawn by architects and engineers for years. Chuck Frost suggested that if they have an architect in house they could stamp the plans. Kent said he would have no problem of getting a letter or certificate from the Super 8 people. Kent showed the plans to the group. Jim Long told him we were not qualified to evaluate the plans. (a discussion followed). John Millar ask if it would be possible for Idaho Falls to do plan • checks for Rexburg. Re Nae said she would check. ~; ~• Mike Larson stated that he did not feel we could make an exception tonight that we couldn't do next week. The purpose is to make sure the buildings are safe. Dean Ricks felt that they were being penalized because of Steve Clark. Chuck Frost suggested that we get a plan check after they are done or have the plans done by an architect or an engineer. There is an obligation of the city to use the best professional advise we can get when buildings are constructed. It is not unreasonable to expect commercial projects to have professionals involved in the design and the construction. Kent said he would get a certificate stamped by the Super 8 people saying it meets all UBC code and a certificate or letter from an architect or engineer on their staff. Chuck Frost said he did not have a problem with it as long as it meet all codes. Jim Long questioned it. A motion was made by Chris Mix to recommend that they review what Idaho Falls does and some other cities in plan checking and evaluate it. Jim Long said we have already established a precedence on what we have to do. Chuck Frost moved that the motion be amended to add that the plans • either have a plan check or they be drawn by a professional licensed ~ engineer or architect. Chris amended her motion to that effect. Seconded by Mike Larson. All Aye. RE: APPROVAL OF KENT JOLLEY'S PLANS IF HE MEETS THE REQUIREMENTS A motion was made by Dan Hess that we recommend to the city council that with the P & Z approval that we approve Kent Jolley's plans if he gets a certificate or a letter from Super 8 architect or engineer that it meets all UBC codes because he was already in the process of the plans when the resolution was in place. seconded by Mary Ann Mounts.
