A motion was made by Scott Mortensen and seconded by Dan Hess to
approve as corrected. All Aye.
RE: DISCUSSION OF DR CROUCH'S REQUEST FOR A SPECIAL USE PERMIT
Dr Max Crouch was at the meeting to present a proposal for a Special
Use Permit for a Doctors Plaza off of Ash and First South. Jim Long
\~ stated that he would have a conflict of interest. He was a neighbor
and had been working as a consultant on the planning of the plaza. The
city clerk told him as long as he disclosed his conflict he could sit
on the board and even vote. John Millar said he would also have some
conflict because his firm did some drafting for Dr. Crouch. In the
last plan he had proposed putting Ash through to the end of his
property. That met with vocal opposition. He now showed an alternate
plan that would block off Ash permanently. It would have a row of
trees and parking down the middle where Ash would have gone. He would
build his office and in the future there would be about five additional
offices. There would be sidewalk and a sidewalk path. He talked about
the steep slope of one corner of the lot. Chuck Frost told him if he
sold lots it would need to be platted. He told him he could plat it as
a preliminary plat and then start construction.
John Millar told him another option was to have it under one ownership
and lease sites. Dr Crouch said he is putting in a lot of expense
getting this development started, so he would want to sell the lots.
Jim Long ask what kind of an obligation does he have to the city to
commit himself to this plan. Chuck Frost said that is why you file a
preliminary plat. John Millar said it is a different situation when he
is proposing a multiple Conditional Use Permit but applying for one.
There is no definition on the other five buildings. We can attach
restrictions on a Conditional Use Permit, that before a building permit
is granted it will adhere to the approved plan and the approved use,
• and each user as they then are established will then have to seek a
Conditional Use Permit at that time.

Re Nee Mc Gee stated that if you approve it on the bases of site plan •
then that is the plan that is approved and if there is any substantial
variance from that in the future they would have to come back for a
variance. Dr. Crouch ask what if he had to move the buildings forward
because of the slope. Re Nee told him if he needed to do it now. She
said approval at this time should be for the six professional offices
with that square footage. Chuck Frost suggested that Dr Crouch write
restrictive covenants on the way he wants the land to be developed.
Jim Long could the Permit be issued based on further engineering
studies?
Scott Mortensen suggested a basement. Dr Crouch said because of the
steep grade, that would not work.
John Millar stated that there were two petitions taken around, one on
the preliminary plan that was presented before with a lot of
opposition. With the new plan the city circulated a new petition with
22 not objecting and 4 that did object, which is about 85~.
Mary Ann Mounts was concerned about safety where the road narrows and
there is no sidewalk. Jim Long said the main concern was traffic and
sidewalks. If a conventional sidewalks are put in you would have to
take out trees. If sidewalks are put in we need to be creative. Mary
Ann was concerned with the amount of traffic this would draw. Dr
Crouch said he would have the same type of professional offices that
Professional Plaza has. Mary Ann Mounts said with Job Service in
Profession Plaza it draws traffic. John Millar said we would need to
address that in the Protective Covenants.
Keith Steiner, representing the hospital, was at the meeting. He said
they did not have an approved position on it yet, but they are working
on a master plan. We will present in about 90 to 120 days.. He stated
that many doctors like Dr Crouch need a good access to the hospital.
He gets an emergency call, he needs to be near by. He is running back
and forth to the hospital for many hours. Whenever we recruit new
doctors, they always ask what is available in office space. That is a
major problem and one that has got to be addressed. It will work
nicely with our plan. We can't provide any space to help Dr Crouch.
It makes sense to have this as close to the hospital as possible. He
said they are evaluating the entire campus to see what they can come up
with. This would be appropriate to their master plan in focus.
Chris Mix as as they value the land use and consider closing off Ash as
a street, we should be mindful. John Millar said it was preliminarily
plated as a city street, but was not followed through on the plating.
Jim Long ask if Ash was a feeder street. Chuck Frost told him it was
not, it would not bother him to have Ash as a cul-de-sac. John Millar
said that if Ash was a through street it would cause more problem than
Birch. Discussion on traffic.
Re Nee Mc Gee said her first thought of the development was not real .
positive. After she had looked at it and seen the design she liked it.
If you are having trouble on Birch then this looks like a way to make

'~ the land work but not harm the Residential neighborhood. It sound like
a good idea if you use landscaping.
Mary Ann Mounts said she felt like Re Nee. If it is landscaped and we
control what goes in, it would be a good thing for the neighborhood.
John Millar stated that we could limit the Conditional Use Permit for
this building only. Discussion on landscaping.
Chris Mix said she would like to see a Special Use Permit given to the
entire parcel of land. It was suggested that the Protective Covenants
be filed with the Planning & Zoning. Jim Long ask if in the Protective
Covenants there could be a clause stating that the Landscaping be done
before they could get an occupancy permit. John Millar said the
conventants leaves the enforcement up to him. I would like to see
those restrictions in the Conditional Use Permit. It was suggested
that before they be given a building permit, they will have to go
before Planning & Zoning.
Chuck Frost said he is comfortable with the concept but we still have
to have a preliminary plat filed. John Millar stated because he is on
a time schedule, we could give him this option that we would approve it
in concept, but prior to council action all requirements of the
preliminary plat would have to be presented to the council.
Thaine Robison- We appreciate Dr Crouch's efforts. He is a business
• man who wants to locate his business where it is justifiable. He
wanted to make an exception to something that was said at a prior
meeting. Chris Mix stated that the Professional Plaza parking lot was
an asset for kids to play in after hours. Two scouts were here and
said they were not allowed to play in the parking lot. Businesses does
not want kids in those areas. This will put a professional plaza
between our house and the school. He lives on the corner of Maple and
Ash which is probably the most dangerous corner in the city. The
biggest problem is the ambulance from the hospital and police cars.
The safety to the people who live in that area needs to be taken into
consideration. He was concerned about the esthetic value of his
property. Safety is the primary concern. He did not want a street
with no parking on one side.
Kathleen Nelson- Last week she had a thought Public Servants Who
Don't Consider The Needs Of The Common Citizen Are Not Doing Their
Job". I think there is very little consideration for the safety of
that area. I do like the plan. The grade of the street has not been
mentioned. It is a jogging street.
Mary Ann Mounts said the signing could be changed to help the safety.
Scott Mortensen stated that the residents seem to all want to keep Ash
from going through. John Millar said we do need to look at the safety
aspect of that street.
• Tony Perkins- A lot of his concerns had been voiced. He was concerned
about the 20 year growth in Rexburg and where the traffic will go.
Something needs to be done with the main traffic flow up and down the

hill. He said he always wanted a sidewalk along Birch, but some
residents would not participate in sidewalks. It appeared that Dr
Crouch is making a decision about the through road and he opposed to it
not being a through road. It is not conceivable that those lots might
sometimes be developed.
Mary Ann Mounts ask if we need to abandon Ash. Chuck stated if we
except the proposed concept then it is implicit that Ash would not go
through. It was his feeling that Ash should not go through.
John Millar recommended to Glen that the traffic safety committee
should study that area.
A motion was made by Chris Mix and seconded by Chuck Frost that we
accept the plan in concept based on recommendations from the Safety
Advisory Committee, based on some further engineering from the
architect and based on the fact that we all in concept agree on closing
Ash. John Millar ask Chris if we could add to the motion that the
restrictive covenants be approved by the Planning & Zoning and that
they be made an attachment to the Conditional Use Permit, and it will
have to go through plating. The preliminary plat does not require it
to be surveyed. It will have to follow the Sub Division requirements.

Dr Crouch was told that he would need to write the Protective Covenants
and get a preliminary plat and take care of the paper work. •
Dr Crouch ask if there would be any objection if the contractor started
with excavation before the Public Hearing. He was told he could run a
risk. They would favor him doing as little as possible on the site
until it is approved.
RE: DISCUSSION OF TETON COMMUNICATIONS REQUEST TO BUILD A STORAGE
BUILDING AND A SUPPORTING TOWER.
Teton Communications was at the meeting to request construction of 10 x
20 electronic storage building and a 60' self supporting tower by the
elevated water tower. He was ask what his plan was for the remainder
of the property. He said he didn't have one now but thought they would
like to put it into residential lots. We don't want to .detract from
the neighborhood. It was decided that it could be changed to Limited
Commercial for public radio transmission. A motion was made by Jim
Long to recommend a Limited Commercial zoning for utility equipment
transmission tower for Utility and Radio Transmission on that building
only, any further use will have to come back to the Planning Zoning.
Seconded by Dan Hess. All Aye.
RE: AGENDAS HANDED OUT FOR NEIGHBORHOOD MEETINGS
Re Nee Mc Gee gave a handout to all members with agendas of
neighborhood meetings. .These will be to gather information. We will
be seeking input in solving difficult problems in the city. •
RE: ADOPTION OF IDAHO FALLS BUILDING PERMIT REQUIREMENTS

• After a review of the building permit requirements that they have in
~ Idaho Falls and discussing it, the members felt that we needed to adopt
these requirements. A motion was made by Dan Hess and seconded by Mary
Ann Mounts to recommending the proposed requirements for building
permits. (copy attached) All Aye.
