A motion was made by Jim Long and seconded by Mike Larson to approve
the minutes. All Aye
RE: NEW PLANNING & ZONING ORDINANCE
Re Nee Mc Gee, who is employed with the Idaho Falls Planning & Zoning,
was at the meeting to discuss the new Planning & Zoning Ordinance. The
city has authorized the Planning & Zoning Commission to help them to
prepare a new zoning ordinance. Mrs Mc Gee outlined the things that
need to be done.
1. A partial Use Survey needs to be done and needs to be put on paper.
(a) To support what we do in the future.
(b) When we know what is there if we see it on paper it is easier to
deal with in terms of a zoning ordinance.
2. To have meetings with the neighborhoods before we sit down and draft
the ordinance. We need to find out what kind of zoning the
neighborhoods would like in their areas.
3. From that point sit down and draft the ordinance or she suggested
the use of the the Arlo Nelson Zoning Ordinance.
4. Then we would need to go to Public Hearings.
RE: PROBLEMS WITH THE ORDINANCE
John Millar asked her about using the Idaho Falls Zoning Ordinance.
Mrs Mc Gee said the major part of that ordinance was written in 1962
and it was beginning to show it's age, and it has some problems. She
said the Arlo Nelson Zoning Ordinance floor mat was easier to
administer.
Suggested issues to be put in the new zoning ordinance were:
1. Chuck Frost stated that their was a problem in the business area
that we need to be sure the existing land use is protected. Re Nee
said Grandfathering would protect it, by the language you could control
it.
2. Jim Long ask if as you do the land use survey, could we consider
traffic patterns. and traffic flow. Re Nee said it needs to be
ao~
considered as you are drafting the ordinance. Re Nee said the
commission would outline problems before the neighborhood meetings are
held for a guideline.
3. John Millar said another issue we need to address is the impact
area. We have done nothing to address zoning in the impact area. Our
zoning stops at the city limits. J. D. Hancock said the Idaho Code
does address it.
4. Jim Long suggested that we need to address the Bed and Breakfast
issue.
5. We also need to address landscaping.
6. Jim also asked if we could put in the ordinance that we require a
design review before a building permit is issued for a commercial
building or a multi family dwelling.
7. Mayor Boyle also stated that a licensed architect or engineer
should be required to design any apartment over a four plex to meet
with the code.
8. Jim Long suggested that we require a landscape architect to design
the landscaping on apartment complexes.
9. Chuck Frost stated that we also need to address home businesses and
neighborhood businesses.
Re Nee suggested that we start having work sessions. The city attorney
was ask to draw up a contract from Mrs Mc Gee.
RE: A VARIANCE FOR ABOUT 355 EAST 2ND NORTH TO BUILD A DOCTOR'S
OFFICE
Next on the agenda was a request from Frank Bell and Dr Gerrie to get
a variance for about 355 East 2nd iJorth to build a doctor's office. A
petition has been circulated (copy on file). There was only one
objection. It would look like a small house. They would work with the
Medical Center on the parking on the East side of the building. This
lot is solid dirt. Chuck Frost stated that it is already established
for professional offices. A motion was made by Jim Long to grant a
Limited Commercial Zoning for that property to allow a doctor's office
to be built. Seconded by Chuck Frost. All Aye
RE: CHANGE THE ZONING ON PROPERTY OWNED BY RULON NIEDERER FROM R-2
TO COMMERCIAL
There is a request from Rulon Niederer and Ririe Godfrey to
change the zoning on the property owned by Rulon Niederer located
North of 344 West 4th South and East of Bare Street from R2 to
Commercial to allow additional storage buildings to be built. Mike
Larson told them we would need to circulate a petition to find out if
the neighborhood has any objection. There is already storage sheds
just South of this property owned by Central Storage, and this would be
an addition to them. The access would be from the South from 4th
South. They would not connect the road with Bare Street. Mr Godfrey
said their other buildings are lighted and they would put more lighting
on the new buildings. Chuck Frost told Mr Godfrey there would need
to be a buffer possibly a fence between the property if zoned
commercial and the residential area. John Millar told him he would not

be able to go a zero lot line on a Commercial Zone next to a
Residential Zone. All signs are on the buildings that are already
there. There would be no addition signs. A motion was made by Chris
Mix to recommend the property be re-zonded to Commercial contingent
of the approval of the neighborhood, seconded by Jim Long. All Aye.
RE: PRELIMINARY PLAT FOR GREG FULLMER'S SUBDIVISION
A preliminary plat was presented for Greg Fullmer's new sub division
by Garth Cunningham of Mountain River Engineering. John Millar said
the preliminary plat has been reviewed by the fire chief, police chief,
public works director and the water and sewer superintendent. The fire
department thinks the cul de sacs should be 75' in radius to make it
easier for the fire trucks to turn. The public works director felt the
75' radius would make it easier to plow snow. The 75' radius is in the
Sub Division Ordinance. The fire chief did want another fire hydrant
on 5th East street. The radius shown on the preliminary plat is 50' cul
de sacs. The water department would like to see on that deep of cul de
sac there be a way to loop the water line. The sewer department said
the sewer lines needs to go down the back of the lots.
Garth said it appears that there is some concerns about various part
of the sub division. They want to create some residential lots that
will provide safety for children and seclusion for the residents. Cui
de sacs are more private and more secluded. Greg Fullmer called on a
conference call and John Millar told him of the concerns of the
~` department heads about the radius of the Cul de Sacs. John said he had
told Greg that he felt that a 50 radius would be sufficient. Greg
stated that was the widest radius he had ever seen required. A 75 foot
cul de sac is half the length of a football field. John Millar told
the members that Edith Circle is 50' radius. Greg's concern was in
order to utilize the cul de sac, you have to have some property left.
Chuck Frost said he did not remember why the 75 foot radius had been
put in the sub division ordinance. Idaho Falls radius for a cul de sac
is 45'. A large group attended the meeting who was interested in this
sub division and living on cul de sacs. A big inconvenience is snow
plowing.
Chris Mix stated that you are looking at the worst area in the city for
snow removal. We will be talking piles of snow and cars and then there
will be an emergency and the fire truck won't be able to get through.
Chuck Frost said you need to consider 15 feet of snow up there in the
winter clear up to the eaves.
John Millar told the members that we still have the initial question,
are we going to allow deviation of the existing plat. Jim Long ask if
everyone understood that everyone coming out of that area will have to
come out on 450 South, that will be the only access out of there.
Bob Walker showed a petition the neighbors had circulated showing the
• proposed plot plan. They are not opposed to the cul de sac situation
that ,it shows. The preliminary plat presented tonight is a little
different than the initial plat that was circulated, however the
neighbors still felt the same about the preliminary plat. Major

streets was discussed. Mr Walker said the neighbors are opposed to 5th .
South being a through street. John Millar told them that 5th South
right now is a through street. A discussion on the through streets
coming out of the sub division. John Millar said it looked like you
have about 80 or 90 percent of the sub division in cul de sacs.. Jim
Long ask which street you would want as a collector street. Chuck
Frost said the master plan calls for 5th South as a collector street.
The engineer suggested that 550 South go straight through with a cul de
sac at the eastern end. That would take the load of 450 South. Greg
agreed with that change. Mike Larson suggested that unless lot 17 was
taken out it cuts off access to the south. Greg said that would not be
a problem.
Chuck Frost said we would have to have a public hearing before we could
vacate the plat. John Millar told them we couldn't approve this plat
until we go through the process of vacating the previous plat. Greg
said he understood that you could abandon the previous plat and and a
final approval of the new plat at the same time. J. D. Hancock told
him it could not be done that way, you have to go through the procedure
of having a public hearing. Greg understood you could advertise to
have a public hearing for the next meeting and turn around and approve
the final plat. John Millar told him the best we could do tonight is
to approve the preliminary plat contingent upon no opposition upon the
abandonment. Mayor Boyle said he thought we could do the abandonment
and approval of the preliminary plat at the same meeting.

Victoria Crouch said as a group she thought they all preferred the
1st plat rather than the new one. It gives the people more than one
option to get out of the area and does not dump everyone onto 450 South
or 5th East Street. It would disperse the traffic more evenly. We
would prefer cul de sacs. Jim Long said we need to do something
physically to help the snow problem, possibly a buffer zone with a
fence.
RE: WHAT TO DO WITH FIFTH SOUTH
Richard Smith ask what they had decided to do about Fifth South. He
said Lyle and Ruth Smith would not let that go through their property
without condemnation procedures.
Dr Mix told them he had a chance to buy that subdivision at one time.
Darrell Neville would sell a strip of property which would allow
for wider cul de sacs.
John Millar said the key issue is can we recommend an abandonment of
the existing plat. A Motion was made by Jim Long to recommend the
abandonment of the existing plat. Seconded by Mike Larson.

John Millar told Greg that the next step is to go before the City
Council with it and see if they concur or not concur with Planning &
Zoning.
John Millar told Garth that one solution they had looked at before
was the possibility of keeping 5th South and going cut de sacs off from
5th South, he told Garth that the board is flexible. John told him the
best position right now it to present it to the City Council and see if
their decision is different.
RE: URBAN LIMITS AND FUNCTIONAL CLASSIFIED SYSTEM
Mayor Boyle said he had a letter from the Department of Transportation
relative to the Urban Limits and Functional Classified System. We have
to have it in by May 15 if we want it changed. Twelve years ago they
had decided that 9th South would be the next good through street. We
now have either two or three homes that would be displaced. Going up
the hill it is steep. De Loy Ward would not give us an easement. We
get Urban D Funds for this. It isn't going to happen for a while. The
interchange is on 11th. Chuck Frost said the long term plan for the
college is someday they are looking at a 10,000 seat auditorium off of
4th South. There needs to be someway to get the people off the freeway
and to auditorium and back to the freeway. That is why they would look
with favor at something at 9th South. A motion was made by Chuck Frost
to recommend we use the 11th South with some kind of a diagonal over to
9th corridor and then onto the college property to comply with the
master plan. Seconded by Jim Long. A11 Aye.
Wayne Parkinson presented the Henderson Sub Division. Jahn Millar
said he had a direct involvement on this and ask Chuck Frost to take
over this for him. It was rezoned from R2 to R1. He said they are
getting ready to sell some lots. They would come off of 5th West.
They did not plan to develop the entire thing at once. Mike Larson ask
if there would be traffic congestion. Chuck Frost said it would dump
into a major street. They suggested that they adjust the corners
radius so the equipment can get through. John Millar said they could
be changes to 50'.
RE: AMEND THE ORDINANCE TO CHANGE THE 75' CUL-DE-SAC TO THE REQUIRED

Dan Hess made a recommendation to the city council amend the ordinance
to change the 75' cul de sacs to require 50' cul-de-sacs. Seconded by
Scott Mortenson. All Aye
John Millar stepped out because he had a conflict of interest. A
motion was made by Chris Mix to except the preliminary plat as drawn
with the modifications to adjust the corners to a 50' radius. Seconded
by Jim Long. A11 Aye.
RE: NEW CHURCH IN THE RICKS PALMER SUBDIVISION

John Watson was at the meeting to show plans and discuss the new church S
in the Ricks Palmer sub division. He said they were anxious to
proceed. The city only has a preliminary plat for the entire addition,
only a portion was drawn to be excepted for the final plat. The church
will be 300 feet wide. Glen Pond said they need to come in with a plat
changing the street where the church will be built. Chuck suggested
that they file an amended preliminary plat for that section that the
church has bought. They don't have to finish it out, but need to show
how the church will change the plat. John Millar stated that before
the street is put in we want the water and sewer put in. Gene Palmer
and Dean Ricks agreed to putting the water and sewer in, but they did
not want to put the street in. Glen Pond said someone has to put the
street in. John Millar told him the required width of the street is 40
foot back to curb, back to curb. Glen Pond said the Stake President
will contact someone out of the Boise office to contact Palmer and
Ricks let them know about the amended preliminary plat and that the
developer will put the street in. John Millar said the main problem is
the church or developer need to get the utilities in. Chuck said there
also has to be a final plat.
RE: PLUMBING AT THE HIGH SCHOOL
John Watson said he had some concerns about the high school and the way
the plumbing inspector was handling it. He did not think he should be
forced to put the meter at the street. The city did not have any
drawings for the utilities there, only as built drawings. That is why
we had two leaks over there. We had a fire line to the auditorium, and
another line went in the corner of another building and another line
going through the concrete of the building and not sleeved. It was
different than any drawings indicated it should have been. The high
school is not isolated so the city has to go all over to shut the water
off. He said he now has a $18,000 change order. John said there should
be an isolation valve. He said he wants to put the isolation valve and
a fire line in and then the meter next to the building. John Millar
told him he had their support, but the Mayor would need to work it out
with De Lynn.
RE: STEVE CLARK APARTMENTS
Mayor Boyle reported on the Steve Clark Apartments. He said our
building inspector should have caught the problems. That is why we
need to have an engineer and architect for everything over a 4 Alex. A
motion was made by Chuck Frost to recommend to the city council that
anything commercial or more than a 4 plex be required to have an
engineer or an architect. Seconded by Dan Hess. All Aye.
The mayor said in the Uniform Building Code it says that basement has
to 4 feet in the ground over 50~ of its base. (copies of letter from
the mayor to Clark and copy of the Engineer's letter on file.)
The mayor reported on the Jay Flukinger apartment parking.
RE: BURNED HOUSE ON WEBSTER AVE.

~% • He then reported on the progress of the burned house on Webster Ave.
A party is planning on buying the house and repairing it for a rental.
The city clerk said there is a concern because there are too many
people building without a building permit. The board recommended that
a building permit be shown in an obvious spot. Any building started
without a permit should be charged double.
RE: HIGH COUNTRY POTATO
The mayor reported on High Country Potato. They are trying to get a
grant from EPA to get water and sewer out there. Glen Pond said we
need to annex that property so we can better control it.
