RE: APPRQVE MINUTES
A motion was made by Mike Larson and seconded by Chuck Frost to approve
the minutes. A11 Aye.
RE: SU$DIVISION
':~ Greg Fullmer sub division- John Millar said the area in question was
platted and filed in 1979. In order to make any changes the plat will
have to be abandoned. Mrs Spaulding presented a sketch of the new plat
as it would appear. The members discussed through streets on the
plat. John said he went up and looked at the property. Shoshone if
projected on up cannot go further south unless a home is moved. If 5th
South was extended onto the East, it would run into Ruth and Lyle
Smith's home. There is already a half road in front of Dee Sellers
home, John said he would presume-that someday they would develop that
road. That road could go around Ruth and Lyle Smiths home. Greg
Fullmer called on a conference call. Chuck Frost said 5th South is a
crucial issue in order to get people in and out of that neighborhood.
There is no other through street. John Millar explained to Greg Fullmer
that most of them had looked at the site and are looking at the
sketches, and are discussing how it would affect traffic pattern in the
area. They had discussed changing the cul de sacs to come in from the
north heading south. John Millar told Greg it would help the flow of
traffic if 5th South was extended through where the two cul de sacs go
to the east, and then tie them together so 5th South could extend to
the east, then tie Shoshone and 5th East into 5th South and take two
or three cul de sacs off 5th South going toward the South. Chuck Frost
suggested to eliminate 550 South. The problem that Greg said he had is
he had already cut out about three lots, and by doing this he would
have to cut out some more lots and it soon becomes so it isn't
economical feasible. Mrs Spaulding ask if that would hold them up.
John Millar told her we don't really have our preliminary submittal
yet, it is very well defined in the Sub division ordinance. We are
really in a concept phase. Richard Smith suggested that a better
arterial further South would be better. John Millar told him that 4th

South is called a collecter arterial. The major plan is for an
arterial on 9th South. Richard said he farmed on Millhollow, and he
is concerned about how many streets we are going to have going onto
Millhollow. It is a dangerous situation right now, unless we shut it
off to truck traffic. Richard suggested that as long as Millhollow is
going to continue to be a major arterial into the city, that the fewer
entries onto Millhollow the better off we will be. Some point in time
truck traffic is going to have to stop on Millhollow. He said he would
hope that they would do what every necessary to stop bringing this
traffic into the residential areas. Chuck Frost said we were trying to
design it so the residential areas have access to the major arterials.
The flow of traffic was discussed further. Richard Smith suggested
that if we bring 5th South all the way through that they do not bring
it onto Millhollow, it would open it up to unnecessary traffic. Chuck
Frost said the master plan shows 5th South ending at Shoshone and not
extended to Millhollow. John Millar told Greg to summarize where we
are, as he had mentioned before it is really more of a concept rather
than a preliminary plat. There is mixed feeling whether it would be
approved without 5th South being a through street. Discussion on
changing the plat that has already been platted. First of all the city
would have to agree to abandon the streets, they belong to the city.
If the city agrees to abandon the streets, it starts over with the
preliminary plat with the sub division procedures. Glen Pond explained
that the City Council is waiting for a recommendation from the Planning
& Zoning. The way it stands now if the streets were abandoned there
would have to be a series of hearings. First Greg will have to arrange
for the abandonment of the plat and the streets. In conjunction with
that you would have to choose a preliminary plat and it would have to
comply with the sub-division ordinance. Then it would have to come
before the Planning & Zoning. Greg ask if they could pole the
council. Glen Pond said he is sure the council would have to have
public hearings. It will take a period of time and probably all summer
at least two months. Richard Smith ask if Greg could get a feeling of
the Planning & Zoning. John Millar - 5th South is a critical street;
Chuck Frost- I agree 5th South is a critical street; Mary Ann Mounts- I
don't know, she felt that Millhollow should not have anymore streets
feeding into it; Mike Larson- I am not so concerned about that road
going to Millhollow; Scott Mortensen- He did not think it was a
critical street; Chris Mix it is a critical street.. It is a split
issue. Greg said he would take this all into consideration and talk to
his attorney about the abandonment of the plat.
RE: NEW CHURCH PROPERTY
Dean Ricks and Gene Palmer were at the meeting to discuss the location
of the new church property. Part of the Ricks Palmer Sub Division has
been developed. The church bought undeveloped property. Ricks & Palmer
agreed to bring sewer and water to the location. Chuck Frost said if
the church bought undeveloped ground they would have to put in the
streets. Chuck Frost said it might be an advantage to develop the
street. The city needs to say that we will require a road and if the
the property isn't developed it would fall back to the church to build
the roads. The Street on the West is an requirement. Glen Pond ask
Gene Palmer if he would furnish him with a copy of the agreement. And

the City Attorney will need to write a letter to the church telling
them there would need to be a road put in.
RE: HIGH COUNTRY POTATO IS MOVING
High Country Potatoes are moving their plant out by Spuds. It will not
be in the city limits, but it is in the impact area. They need to
present the plans to the Planning & Zoning. Glen Pond suggested that
we need to look into annexing it into the city if we extend the water
and sewer lines out to them.
RE: IDAHO FALL'S ORDINANCE
John Millar said we talked about the Zoning Ordinance and we have a
proposal from Re Nee Mc Gee. We also have a copy of the Zoning
Ordinance from Idaho Falls. The Mayor's feeling is to retain Re Nee Mc
Gee on an hourly basis and take Idaho Fall's Ordinance and cut it down
to fit Rexburg. A motion was made by Mary Ann Mounts to retain Re Nee
Mc Gee on this basis and have her meet the Planning & Zoning on a
regular basis. Seconded by Mike Larson all aye.
RE: ABSENCES BY THE MEMBERS OF THE BOARD
John Millar told the Planning & Zoning Board that the mayor had made a
recommendation that this board be compensated for their time. He is
hoping that this would spur a little better attendance. The board
suggested that rather they are compensated or not, if there was three
unexcused absences in a six months time by members of the board they
should be released. A motion was made by Chris Mix that the attendance
be monitored and those who do not attend and are not excused will be
released from the board for three unexcused absences during a six month
time. Seconded by Mary Ann Mounts. All Aye.
RE: STEVE CLARK APARTMENTS
The committee discussed the Steve Clark apartments. Glen Bean said
there had been no progress since last fall. Glen had talked to him,
but he doesn't seem to do anything. The city had received a letter
from a attorney representing Greenbrier Apartments, saying they were
going to take action if this is not taken care of. Mike Larson said
last fall we were going to withhold his permit and not let students
live in those apartments. Glen Pond said that was the parking and
banisters and he met those requirements. Glen Bean said he doesn't even
have enough parking for the existing students. John Millar said he
could not occupy the new buildings until he finishes the upper parking
lot. Greenbrier said he does not have enough room. Glen Pond said the
understanding was the first story was suppose to be underground and it
isn't. Glen Bean said according the building code that 80~ of his
first floor has to be underground and it isn't. The members stated
that a Stop Order should be put on the buildings until the requirements
are met of the uniform building code and require him to get competent
contractors in to work on it.
Chuck Frost made a recommendation that he will be writing a letter
telling him we would hire a constructional engineer to come in and look
a the footings and at the Uniform building Code. It would cost $200
or $300 to get a constructional engineer. They also told Mr Bean that
all problems and instructions to him from now on be made in writing.
Chuck Frost made a motion to hire a constructional engineer to evaluate
the construction of the building and put a stop order on the building
until we get that recommendation. Seconded by Chris Mix. All Aye
RE: HOUSE ON 128 WEBSTER
Glen Bean told the members that there is a house on 128 Webster Avenue
owned by James Change, which was partly destroyed by fire about a year
ago and nothing has been done to repair it or tear it down. We have
received a complaint that it is a nuisance. John Millar state that if
it is 50~ destroyed it has to be torn down or the city can declare it a
nuisance and tear it down and bill him. The members recommended that
he be sent a legal notice by the City Attorney and just give him a
period of time to do this.
RE: BOWEN & HALL IMPROVEMENTS
We received a letter from Bowen & Hall sending a letter of Insurance,
they are moving ahead with their improvements.
RE: NEW FLOOD PLANE MAP
John Millar handed out the new Flood Plane Map. This was discussed.
They felt there was no rhyme or reason to the map. John Millar would
write them a letter outlining the areas that should not be in the flood
zone.

A motion was made by Chuck Frost and seconded By Chris Mix to adjourn.
