A motion was made by Dan Hess and seconded by Jim Long to approve the

RE: VARIANCE FOR ZONE CHANGE
Discussion on the variance for Neal Brown Apartments. Glen Pond told
the members that the couzrcl felt that a 10 foot. variance instead of a
5 foot variance might be acceptable. The neighbor that the variance
would effect, Mr. Thornock, did not object to that. A petition had
been sent around to all the neighbors for the variance and the. zane
change. The council had voted to hold a public hearing. far the zone
change and had referred the variance back to the Planning and Zoning.
Rex Larson from the fire department was at the meeting and objected to
not having a full scale ,drawing. Chuck Porter said any recommendation
would have to be on the condition that it be drawn to scale and meet
all other existing safety codes. Chuck Prost said the drawing we have
doesn't tell us anything. The members discussed the zone change. The
rest of the block is zoned R3, so this would bring the corner in
compliance with the rest of the block.
Chuck Frost told the members there are two decisions to Hake, (1) do we
want to go along with the zone change with the provision that they-have
a variance for a 10 foot sat hack from the rear property line, (2) can
we do anything without a detailed, drawing to scale? The. city council
has approved a hearing for the zone change, so the variance is what the
P & Z needs to approve. Jim Long said it concerns him that we give
away the open space and Tandscaping. Glen Pond said the reason he was
asking for the variance was so he could save the trees out in front.
RE: VARIANCE .PLOT PLAN
Chuck Frost said until we get a plot plan we can't give a variance. We
need a detailed plot plan... A motion was made by Chuck Porter that they
come back with a detailed plan that meets the fire code that can be
studied by the city officials, and determine the exact use of the land
At that time we will consider a variance. Seconded by Chris Mix. All

RE: TRAILER COURT S. 5th WEST

Next item on the agenda is a trailer court on South nth Nest. Gaylen
Gneiting and tierna Gneiting were at the meeting. Chuck Frost read some
old minutes giving permissian for the trailer court to be put on their
( property. This was to be built according to the ordinance and the
}i plans. The construction of the improvements on the trailer court would
need permits. The city would need an updated plan se that all the city
officials could review the plat. It would be filed just like a regular
sub-division plat. All of the plans need to be drawn and the
construction started before anyone lives there. Mr. Gneiting said he
is planning on buying the Trailers and then renting them. He said he
~ was going to start to put sidewalks in and when that is finished he
would put. asphalt in. He said they would start putting power and gas
in in about two weeks. The city clerk told him he would need to get
permits for any building ,.and all utilities. Mrs. Gneiting. said the
reason the trailers were .;moved before the court was finished because
they were able to buy the trailers at a goad price if they took them
now and lined them ail up in position. He was told he would have to
bring in a final copy of the drawing in to City Hall. Mr. Gneiting
said he would guarantee that this trailer court will be a nice looking
court when it is finished. Mrs. Gneiting said these are not new
trailers, but they plan to .fix them and paint them so they will look
' nice. Chuck Frost. told h.m to be sure to follow the trailer court
ordinance.
RE: OBJECTION TO TRAZI:ER C~JRT
Glennis Nedrow- "We don't like the trailer court. We don'.t like the
type of trailers that are being moved in. {ie don't want the type of
people that that type of trailers will attract, we have a nice
neighborhood. Is there room for parking in there, what about the
cul-de-sac for the fire truck?" The trailer court ordinance requires a
2 acre plot, the property is zoned for a trailer court.
Shaunna Henderson-She had just moved from by a trailer court a year
ago. "It destroyed the value of my home. You look at it and you can't
guarantee what kind of .people gill be living there."
Dan Nedrow- '°We know what thss will do to ocir property value. They are
old garbage looking trailers you're are putting in there." He said the
doors were open on the trailers and dogs and cats are running. in and
out.
Mrs. Gneiting said they will refurbish the trailers and make them look
nice. She said there will be a lawn and a play area, everything that
the plans call for. The :city clerk told them they would need permits
to fix up the trailers.
Chuck Frost told the group at this point where approvals have been
given, and the property is zoned correctly. As far as the Planning &
Zoning is concerned, if the trailer park meets the requirements of the
mobile home ordinance, you have a valid authorization to proceed with
the project. If the people in the neighborhood feel that there is a
great concern, it becomes a Legal matter that cannot be handled here.
They are under construction and they have met the requirements of the
zoning ordinance at this point. If the neighbors feel that it should
not be there, then it has to go another route. Mr. Gneiting was

!~ advised to get all the needed permits necessary. There was a
discussion with the neighbors, the Gneitings, and Mrs. Hancock about
the condition of the trailers and the type of people that would be
renting the trailers. Mrs. Hancock asked the neighbors to give them a
I chance to work with the trailer court, she pointed out they are in
construction at this time.
Chuck Frost told them we would have to bring this issue to a
conclusion. As Planning ~ Zoning all we can do is require that the
conditions of the ordinance be met. He advised the Gneitings to do

j everything they could to do exactly and beyond the requirements of the
ordinance, so the neighbors know that you are more than in good faith
trying to go beyond the requirements of the law. The neighbors need to
gives the Gneitings a chance to coffiplete the project according to the
approved plan. Bef ore a license to operate would be issued by the
city, the city would require that ordinance anal codes be followed
completely.
Chuck Porter asked if there xas a procedure that rental property meet
a31 the codes before they can be rented? The city clerk told him it
would fall under the inspection ordinance.
Chuck Porter stated that we need same strict inspection procedures for
trailer courts.
RE: PARKING HARMONY HOUSE
'~'~ Parking an Harmony House. Chuck Frost read a letter which the cit

clerk had written to ?'t='. Fluknger about the parking and also the
letter he had written back xith a copy of the new parking proposal.
(copy attached .and on file? He needs a total of 86 parking places. He
.proposes to remove the green area. Glen Bean said he does not have a
dimension of the parking. The planning board asked the clerk to have
John Millar check the plan out to make sure he has enough. parking. fle
will have. to meet the parking regulations before he can occupy it with
students.
RE: LANDSCAPE ~ TREE ORDINANCE
Jim Long asked the clerk to get so®e copies of Landscape and Tree
ordinances, so an ordinance for Rexburg can be drain up.
RE: CLARK OCCUPANCX CERTIFICATE
Ghuck Frost read a letter the citq attorney wrote to Steve Clark
(copy attached). He is still out of compliance and is in violation. He
has now been on legal notice from the city to put it in compliance.
The certificate of occupancy comes from the city and if the city denys
him this certificate the college vauld not approve him for college
housing. It would have to be some kind of a safety violation. The
members asked the clerk to have the city attorney write another letter
to Steve Glark that the Planning fr Zoning have advised Ricks College
• that if he is not in compliance by Augeist 1S with the fire lane, make

the stairs safe, and pave and make the parking lot in compliance that
his occupancy permit Will ~e denied.
