Mr Bagley is in the process of designing a new house on Yale Ave. He has a deep lot, 150 feet deep, it is my understanding that a minimum set back is 30 feet. Anparentiy there is ao a~zaximure set back. We would like t.o move the house back further s.o we can do some landscaping. John Millar told him there was no restriction on a maximum set back so there would be no problem. They ta?d him he would only have to watch his back yard and not get. back too far and watcri the side yards. G1eri Bean, building Inspector, discussed the Clark apartments. Ne said he had submitted a plan from a Landscape Architect, but John Millar told hire he would have to make some modifications. They need to tear out the existing steps and replace them with fireproof steps. Cn the new apartments they will have to have fireproof steps. Rex Larson said he would not approve it until the parking was done so a fire truck coui.d get iii a.nd o'~t. The setbacks are okay. Rex Larson said rie would like the city to make sure afire truck could get in and out before we let him proceed with the apartments. Mike Larson ask what happened. with the Question of the four plea. Gren said ?''ary Smith was suppose to give us an opiniuon that that but we still don't have it. John Millar said he would get with Steve Clarkk and get the corrections made. Lane Ward was at the meeting. He has a cinder black fence around the back of his house, it starts at the south west corner of the ho~~se and it goes back from there 36 feet and then it takes a 5 foot jog to the east and then it continues on back another 100 feet.. My plan is to use the cinder block Fence as a wail and then have the rest of it ,built out of cinder block and have a metal roof but have it all contained with my side of the cinder block fence so nothing ~~3 would overlap on my neighbor's property. T'ne shed would be 12 x 12". The variance is to build a shed next to my neighbors property without a five foot side yard. There will be no eves. John Millar read out of the zoning ordinance "Required yards for accessory building 5 feet side and none rear if fire proof." The variance you are asking for is the ~ feet side yard. Mike Larsen stated that when the neighbors buy the property they anticipate that the city will enforce the city zoning. In granting a variance, it should be done for a hardship. When I moved into an area 1 wished that the code would have been enforced in my neighborhood. If you built this shed it would restrict your neighbors from, using that portion of their property. The code reads contrary to you building up to your property Line. Dan Hess said if everyone builds up to the property lines look what a mess we would have. The fence is about 7 foot tall and the. roof of the building would be within the fence. Mike said he thought we are limited by the laws as to when we can g-rant a variance. ire would subject the city to some liability if we okay the variance. Bean Ricks was at the meeting and he suggested putting a temporary building with two posts, making a shelter. A motion was made by Mike Larsen and seconded by Dan Hess to deny .the uariance. All Aye Variance denied. Randy Landon was at the meeting to present. a set of plans for an apartment complex between the Calaway Motel and the Bunkhouse Apartments at about 359 South 2nd West. This would be for college housing. The building inspector had the plans and had reviewed them. Randy said as far as they could .see they are within in all the building codes and. regulations.Rex Larson made suggestions about taking out a parking place at the ane end so the. fire truck could turn around there. There are 24 apartments and l4°~ students, there is enough parking for 59 parking places and according to the Cade 52 parking. places are required. They would hook on to the city storm drain out in the street.Rex told them they would 'nave to keep -the fire line open.. The building would be built with a double fire wall. A motion was made by Dan Hess and seconded by Barry Genta to approve the plans. All Aye J. D.F3ancock and Gaylen Gneiting was at the meeting to present the plans for a trail co~a.rt ©n his property on youth 5th West. He had been able to buy the needed property from Dr. Peterson to allow him to have the required amount of property for the trailer court, As they reviewed the plans,Rex Larson told them they would need to change it so there would be enough room for the fire. truck to turn around. They said they would put in a cul-de-sac for the truck to turn around< They woa~ld need about 70` to 75' to turn around. Chuck Frost told them they would need $~ grass area fur recreation area. There would also need to be an area for the garbage. They discussed that. they would. probably need a 24 foot bridge. Thera is also a requirement ti:at the trailer court must be fenced or have greenery around the court. A motion was made by Chuck Frost and seconded by Dan Hess to except the plan as drawn with the conditions that he have a 80'cul-d-sac for the fire ~~Y • I• truck to turn around, a recreation area, a garbage area, and a fey:ce or greenery .around the trailer court. All Aye Dell Virgin was at the meeting. He is buying a house on the earner of 5th West ar:~d Main. At the present there is a little porch on the i~ause that is 6'~6' wide now, he would like to add 18" to the porch to make it 8' wide. Where is a house down on the corner that if you eye palled it would l}e in line with the extension that he wanted to make. That would put him beyond the restriction of the set back, the existing porch is beyond the set back. It would have to have 3 variance to build it making it fit' wide, A motion was made by Dan Hess that he be allowed to buz.ld out only to the. existing line and go the length of the house making the addition 6 1/2 feet line making it 6 X 6. Seconded by Mike Larsen. All Aye Sohn Millar said there. is one other item that the mayor would like us to look at in the future and that is taking another look at the parking requirements for college housing. We cannot go back and change what there is but we can the new ones, Glen Pand suggested that we look at what the other college communities have done and try to pattern ours after one of them that would fit our needs. The City Clark was ask to check with some of these cities.. Rex Larson staid lie would like to see the city pass an ordinance restricting buildings 2 I/'~ storys out of the ground for fire protection. If they do build higher there needs to be some stiff requirements on sprinklers. The board said they would make that recommendation to the city council. Meeting adjourned. •
