HomeMy WebLinkAboutP&Z MINUTES JANUARY 27, 1988~- Planning & Zoning January 27, 1988 Those Present: Chairman: John Millar Members: Barry Genta Chris Mix Jim Long Chuck Frost Dan Hess Chuck Porter Mike Larson Councilman: Glen Pond City Clerk: .Rose Bagley Building Inspector: Jeff Teeples John Millar revied the minutes from the last meeting, a motion was made by Dan Hess and seconded by Chris Mix to approve 'the minutes.. All Aye They discussed the parking ordinance. Glen Pond told them the council had not done anything to change the ordinance. The intent of the council was after the discussion. of the Ricks Apartments, was that the planning and zoning review and see if they want to make-some changes to the off street parking for apartment complexes if they want to increas that. We have several letters from apartment owners requesting that reouirement be changed. That they be required to provide more parking than is required. at the present because more students seem to be brining cars.to school than they did when the ordinance was written. John Millar ask Glen if the police had. monitored the parking lots to see if they were filled up. Glen said he had not talked to Blair about it. Glen ask what night would be best to meet with Rod Gilcrest. It was decided that on .Wednesday night possibly on the 4th Wednesday. Jeff Teeples, Building Inspector, was at the meeting to discuss problems. 1. On commercial job s: when occupancy is changed and we inspect it we can .stop hasles with parking,'or a business that will create a noise or nuisance. We can make sure they conform to the uniform building code.. We will not give a certificate of occupancy and they cannot occupy that building until they have conformed to all the regulations. This certificate of occupancy has been given on a hit and miss basis. 2. Inspection fees increased for a business license. When they come in and apply for a business license, they have to conform to the building codes, sometimes the inspections require a lot of time. After the inspections are done we will issues a certificate of occupancy. Right now the business license is $20 and the inspection fees for all. four inspectors to do inspections is an additional $5.00. They are not required to get a building permit unless they do something .structural to the building. Jim Long-ask if a Certificate been in the building code all this time why has it been hit or miss, why 1~`~ • of Occupancy h~ hasn't it been inforced. Jeff said the building code is changing all the time and Nile Brown is 79 years old, and it is hard to keep up on it alI the time. . Chuck-Frost said it is high time that we need to enforce it. ~e~f said he would like a recommendation to the city council to require the certificate of occupancy and also that we charge a fee of $20 or $25 for the inspection for a business license. Mike Larson questioned what a certificate of occupancy would be given for. Jeff explained that a certificate of occupancy { was good until he went in and rejected it. Jim long questioned what would ha-peen if someone had built an apartment where it is not zoned for it would be out of business? The grandfather law would cover that. Glen Pond clarified it, if the .apartment complex. Jeff discussed stop work orders. Chuck Frost questioned if in the apartments they found a rat trap if they could pull the certificate of occupancy until it met the code. Chuck Porter ask if we have adopted the uniform . building code with the clause in it-about required certificate of occupancy? As a Planning Board we need to recommend to the city council that the provision be enforced.. Chuck Porter suggested that if a place was in such a state that it became a fire hazard or a health. hazard it would come under the fire code or the health code, more than the building code. If we make a recommendation to the city council that the law be enforced in its present from, but before we get too specific we need to see what the provision is in 'the law. John Millar wondered if it should be more of a sliding fee, according to the size of the building. Jeff said in something very large they will have. to get a building permit, plumbing permit and electrical.. A motion was made by Dan Hess that we recommend to the city council to require a certificate of occupancy ahd also that we increase the fee. charged for inspections when a business license is sisued to $20 or $25. The city should ret~~.n one copy of the commercial plans. There should also be a plan review on residential buildings. The city clerk told .them that there has been a plan review on commercial buildings. Chuck Porter stated that we s{~ou1d have a regular plan review. A subdivision plot plan will have to be checked by the Planning & Zoning, and each department head.. Jim Long stated that : it seems that f~1r. ,Teeples_wants ,to _do__what__he. wants o _;do and wants our support. We as a committee want to see the things get done that are suppose. to .get done. What do we have to do as a board to make sure the laws are enforced the way the laws are written. Jeff said he wanted the committee to be aware of what his procedure is going to be. Jeff said he thought that the Planning & Zoning was the board of appeals. Chuck Porter told him that the city council was the board of appeals, all the Planning &'Zoning did was make recommendations. Jim Long said the way that Jeff could help the community best is by enforcement. He said he lives in a house that was never inspected, and he added on to my house and it still was not inspected.. • The committee told Jeff that they supported him in what he is doing in reviewing both commercial and residential plans. ~~~ ._ ( ~~ The committee discussed having our inspector go out with the college inspector j to inspect off campus housing. Jeff Teeples had met with Don Packer concering • this inspection. 'The city thought they could charge a fee of $25 for the unit and $1 per apartment for the inspection. Mike Larson stated that we would have to be careful on inspecting only college housing. It should be a standard inspection for everyone. Mike ask what the purpose for .the inspection. Glen said Ricks College ask for. the inspection. Jim Long said the inspection needs to be standard for everyone, you can't just segregate it. If Ricks makes a request for the inspection and pays the fee, the other apartment owners could make the same request and pay the fee. Jim Long ask what the purpose of the inspection is if the only time you inspect it is when the guy requests it. Jim Long ask how this could be an optional thing if it is a building and safety ordinance. Chuck Porter said for Ricks College it is not optional but fbr the city it is optional. Jim ask about the city liabiality if our inspector certifys that the building is safe. Jeff Teeples said he would be looking for (1) smoke alarms, (2) required exits, (3) make sure they are conforming to the square foot of occupancy. Jim. Long ask if they wasp'-t talking about a bunch of stuff that has nothing to do with planning and zoning? We support him, but this is not why we ara here at this meeting. Mike Larson said we can only-make a recommendation that we enforce existing laws of the Uniform Building Code. Seconded by Chuck Porter. A11 Aye: Chuck Porter ask. him if he was a health .and safety inspector or a building inspector. Do you have a right to go around existing buildings and inspect without a building permit issued. Chuck Porter said he would like a legal • opinion on i I would-like the-city attorney to look into it_ I am not in favor. of the building inspector doing random inspection from time to time for fire and code violations. John Millar ask if the city wanted the liability they would have for just collecting $50 for an inspection and then someone would get hurt the next day, or a fire the next day or month.
