All Aye. Sheryl Moulton was at the meeting to request the property a 107 East 1st North chahged from residential to commercial. The reason for the change is she is a beautician, and if someone would like to come and have her do their ha ir, she would like to do it legally. They will .not advertise, nor will she have a sign, and would be the only beautician there. I am not in anyway trying to cause an attraction to this area. This would make it so she vould spend more time with her family, if she could do it in her home. The mayor said there use to be a gift shop in there. Bob Purrington said they couldn't change the zone but could maybe give a variance.. There had previously been a request for a real estate office in that house, and he was turned down. Chuck Frost ask about the house down the street at 75 East lst North where Kerma Sommers lives, she is displaying dolls. The city clerk said she had never applied for a business license. Mayor Porter said we have granted variances for just one beauty operator in a home before. Bob Purrington told her that she would have to meet the requirements of the state. i+ls Moulton said they would remod~~ to meet the state requirements. A motion was made by Dan Hess to recommend to the city council to allow a variance to ~1s 'Moulton at 107 East 1st North, for one lady beauty shop, with no signs, no adver- tizing and that it meets all State regulations, and that the variance ceases if the property is sold. Seconded by Bob Purrington. All Aye. Laura Carroll of 232 West 3rd South was at the meeting to request changing the zoning from Commercial to Residential. This house is about three houses West of Taco Time, which was owned by John ~lordord. They have been trying to re-finance the house and are having a problem because it zoned commercial. It is right next to residential. They are also remodeling the basement for a possible apartment for college students. Chuck Frost told her, if they stay commercial they can put an apartment in and not have any problerns. Chuck Frost said if we re-zone it we would probably want to take all three houses and re-zone them. .Chuck ask her if she thought the neighbors would like to have the zone changed. They mayor explained that the reason that was zoned commercial, was because the highway went past there and it was zoned comrercial to the middle of the bcl©ck, on either side of the road. The mayor suggested that iMr Nelson across the street might be interested in having his property zoned residential, so he could sell some .lots. Chuck Porter suggested that we would need to leave one lot along the. old highway zoned commercial. The mayor said the people on Orchard came iri a few years ago and were interested in purchasing the Nelson property and building some houses on it and having Orchard Street a Dedicated Street. ~~~ • `~~ That isn't a dedicated street and is not paved, they would like it paved. They might be interested in re-zoning. Chuck Frost said as far as he is concerned, he would like to see the whole area re-zoned if the neighbors want it on both sides of the street. The mayor said his feeling are that the Diet Center would not want the two • houses. they own re-zoned, because they might want to expand their business. E~ayor Porter suggested that Ms Carroll visit with her neighbors and get their feelings, and reprot back to the city clerk. If they are interested, we can get the boundary they want and have a petition go around.. The Planning & Zonign was willing to make the change. f~1s. Carroll said they have a problem with the Diet Center dumping junk along their easement that goes along the edge of their property. She finally called Mike Ferguson and he got it cleaned up. She said she also tends children, sometimes 10 children. She was told she would have to have a city business license and meet the city regualtions. We have nothing back on the house. Chuck Frost said of you ;stayed Commercial she could put a sign out and there would be less restrictions. WORK SESSION ON ZONIEdG ORDINANCE AND MAP Mayor Porter expressed his concerns about the ordinance. He said he had read over the new ordinance, then I read over the ordinance of Arlo Nelson's and looked over the old ordinance. His idea was to take parts of Arlo. Nelson's and combine it with the old one and forget all about these setbacks in the business area. Bob Purrington expressed that he felt that would simplify things. Chuck Frost said when they started on the ordinance that was one of the real concerns, should we revise the old ordinance and ammend it or try to come up with a new one. He .said he was a little disappointed with the new ordinance. The mayor said he thought in the old ordinance we should do away with that class one and two, it is confusing. In the ordinance of Arlo Nelson's, he has a sign section, and he has some other things in there we should have. He also has a flood zone. The mayor said the flood zone and flood insurance ,presents a problem. Chuck Frost ask if we would lose credibility. with the citizens if we decide now maybe there were too many problems with that ordinance.. The committee said we would just tell them that we have revised the ordinance. The mayor said there are some things in the new ordinance that need to go in the ordinance. Chuck said we could revise the map, he felt that we need more zones than are in the old ordinance. Mayor Porter said the committee would go over the ordinance and put those things in it and eliminate some of the sections in the old ordinance that are ambiguous. Chuck Frost said he did not think the new ordinance fit very well, there were a lot of areas where the changes-were too radical. He said we did find that there are several areas in the city that need. to be re-zoned. He had gone throught the petitions we ahd received at the hearings and had separated out those he felt definitely there was a consensus to change the zoning and that should be reflected on any new map. Chuck Frost said maybe if we took the old ordinance and take the things that are ambiguous and incorporate as much as possible-the new stuff. A motion was made by Chuck Porter to incorporate the good parts of the PJewkirk Ordinance and the Arlo Edelson Ordinance into the existing Ordinance and eliminate the ambiguous pars out of the old ordinance. E~leeting Adjourned. • To tdhom It Nay Concern, The reason I`m attending this meeting is I would like tc move to a house located at 1Q7 East 1st North Street, in Rexburg, which is residential. The reason for the change from residential to commercial, is I am a Beautician and if someone would like me to do their hair, I would like to do so legally. I will not advertise nor have a sign., and I will be the only Beautician there. I am not in any way trying to cause any attraction to this area. I dust want to legally be able to do hair in my home. Also this move would enable me to spend more time with my daughter. :4 ~~'-° •
