New Zoning Ordinance

An Information Public Hearing for the new Zoning Ordinance and Map, held at the
Kennedy School, January 28, 1987, at 7:00 P. M.

Glen Pond introduced the City Council and Planning Zoning
briefly explained that they wanted to get a feed back from
the new ordinance and map.

Chuck Frost took charge of the meeting-and gave the group a brief summary of
what they are trying to do with the. new zoning ordinance,. and told them the
procedures, of the hearing.. We would like you stand and gibe u.s your name and
tell us your concerns about the ordinance or map and speak loud enough so
we ca,~ get it on the tape recorder, speak your name. We also need to get
your written input on a sheet of paper, so after we are done we will have
a record of everything we have talked about.
Paul Cotter- I live on K Street and work at Ferguson Lab, part of Diet Center,
Diet Center ask if I would come torsight and, explain to you that our Lab down
on South 5th West are manufacturing. We have a warehouse there, but we produce
approximately 50 million vitamin and mineral supplements per month. We feel
that perhaps that .area should be zoned .for Light Industry, rather than a
commercial .zone, ..such as the Barrick Candy Company across the street and the
Cabinet ?flaking Shop down the street. So there won't be any problem in the
future, they ask me to come and ask that this be changes.
Mr. Cotter- Concerned about K Street. He said he didn't have his hasement
rented out at the present time, but it is made so it can be rented out, so
he has concerns there where it is listed in the Green Zone. He said there
are also a couple of duplex on the street. Chuck ask if he thought the
people on K Street would want an R2 zone? Janet Goodliffe from K Street ask
if they would have to go to R2, if they could possibly go to the R1C. Chuck
said if there are already duplex on the street,, then we get into how do we
define the neighborhood? Janet said she thought it was R2 before. Chuck
checked the old map, it was zoned Rl. Janet ask how the duplex got there.
Chuck said they probably should not have been put there. Janet ask if there was
anything '_ between R2 and Rl. The .new zoning calls for a conversion zone,
that was for around the college, as people began converting their basements,
or sub-dividing part of their houses for apartments. It is possible that
whole street could be changes to that zoning, if everyone on that street
wanted it. Mr Cotter said there are several people who have basement
conversions already.

Looking bn page 37 in new ordinance on what is allowed in R2. They ask
if there is anyway to make it R1C, Chuck told them that in R1C Duplex .are
not allowed. The ones that are there would be grandfathered in. We would
appreciate it if you would let you neighbors know about-the concern and if
they would like to have a change to R1C or R2. It would be difficult to
change z block. It is a neighborhood and would be better to make it all
one zone.
RobertL~eGrant Bowen- concerned about the property on 2nd West and 7th South.
Robert Lee, I am representing myself, Sylvan Seeley, and Gem State Irrigation.
and Grant Bowen has the same concern. We own property on both-sides of the
2nd. West between 5th South and 6th South. Mr. Bowen owns property on both
sides 2nd West between 6th South and 7th South. We bought- that property about
10 years ago as an investment. At that time there was considerable talk
about-the traffic pattern into Rexburg.. There would be a feeder route on
2nd West to bring the traffic into town., .then the road would continue on
up to 2nd East, We bought .that property thinking. that it would be
ideally.-suited to a.commercial use because of the volume of traffic that
would eventually develop there. We-were looking for a-long term investment
on that basis.. At that time and at the present time the property is all
zoned commercial. We paid a commercial price for it. We beleive that is
still the plan to have 2nd West be one of the major access routes into
Rexburg, and it should experience a lot of traffic. I don't think it to
be very computable to have a lot of R3 Zoning with a lot of residence
along 2nd West. In inquiring why it was proposed to be zoned R3, they said
well it would be ideal to provide apartments for Ricks College. Right now
,\ • there are more than enough apartments for Ricks College. Another point is
with the construction of the new Nursing Home, that will act as a magnate
for support facilities, such as a drug store, convenient store and possibly
apartments, doctors offices, clinics for a support for that facility. I
.feel that it should stay commercial..
Dan Spaulding - 380 West Main. Mr Lauder has come to us for a zone change
on West Main between 3rd West and 5th West, to change the zone to commercial.
I want it to remain residential, so we can sell our property if we want to.
Eduardo Gonzoles- 375 West Main- I am against having- West Main between
3rd West and 5th West changed from residential to commercial.
Nolan Peterson, speaking on behalf of my mother-in-law, Clara M Perry,
370 West Main, and we want Tdest Main to to remain residential, between 3rd W
and 5th West.
Orrin and Marjorie Bates- 328 West Main, we are against having that changed
to Commercial.
Lester Nelson 457 West Main- I am against having it changes to Commercial,
and want to remain residential.
Marie Seeley- 33 South 5th West, I want it to remain as shown on the map,
I da not want it changed to commercial.
Bill Christensen- 27 North 3rd West- I want West Main to remain as it is.
Ken Wagner- 270 West Main- I want it to stay residential.
Syvel Nelson - 37 North 3rd West- I want West Main to remain residential.
When Mr. Lauder came around, he said he would build condominiums now he
-wants to build something else. If the zone was changed to commercial it would be
• hard to sell our-home.
In checking the zoning map, Chuck Frost said it was zoned residential because
that looked like it was the character of the neighborhood,

Verlan Lauder- I own the property between 4th and 5th on the north side of
Main Street. I would like to see it zoned commercial, because I would like to
~~ sell my property. I will not be able to sell it for residential property for
building lots. I am the one that has the petition. He said he only wanted
2 of the block changed to commercial.
Susan Peterson- When you came around, you said you were putting up condos. We
live on the block where the Diet Center Visitors Center. When they came around
they didn't say anything about going commercial. They explained to our block
in a very nice manner what they were doing and said they would maintain it
good, which they have. I don`t see. why they couldn't do that with condos instead
of upsetting the neighborhood by trying to change it to commercial. When
Diet Center came to get permission to put up a sign, we told them we did not
want a big sign and they put it on the side of the building..
Nile Boyle said, If it was zoned commercial I think you would have trouble
getting a loan if you build condos, or apartments.
Mr. Lauder- I'm not sure I want to build condos in there, I might want to
build something else. I have been setting on all that land since the flood,
and I pay taxes just like the homeowners do, and I get nothing out of it.
Chuck Frost said this issue on West Main is one we have struggled with for
years.
Glen Pond- When did you buy that property, was zoned residential when you bought
it. Mr Lauder said it was zoned residential, his parents use to live on the
property. •

-Chuck Frost told him if that zoning was changed we would have to have a
separate Hearing.
Sharon Christensen- What would that do to our property, if we were sandwiched
between-two commercial areas? Chuck Frost told it that was not good zoning.
Syvel Nelson- When Mr. Lauder came around to get us to sign the petition, he told
us he wanted to put condos on his property, that is why we signed the petition.
If he changes the zane to commercial property and puts a business in, it would
devaluate our property and it would be hard 'to seel our homes.
Marjorie Bates- He told us he was .going to put condos on the property, which would
be okay, We don't want a business to go in there.
Orrin Bates- I think there is enough commercial peoperty in Rexburg, I want it
to remain as it is.
Sander Larson- From the point of view of commercial property. Frankley as a member
of the city council, I feel-that enough is enough. I think we need to live with
what we have and make it work, rather than always looking-for something else. and
ask for variances. Lets live with what we-have and try to maintain these lovely
neighborhoods in-the community- and build the community, rather than always trying
to convert and change. I am oppose to that, and as far as my part on the. city
council I would vote against it everytime. I appreciate what is being said and •
I think we need to listen to it.

Dwight Whittaker- Representing the Development Workshop, as many of you are aware
• Mr. .& ~Irs Porter recently donated the Art Porter Building to development workshop.
After reviewing the proposed zoning map, we would like to request if we could
and have drafted a letter (on file) that that particular facility be changes to
Ml from C2. The basis for our oppion on that are due to the fact of the number
of vocational and training activities, we-hope within June. or July of this year.
It would allow us much more flexibility. in identifying various contract work
that would be available to train persons with disabilities. In looking at the
C2 Zoning, we find that most of the triditional activities that we have performed
in Tdaho Falls and would propose to preform here would have to have special
use permits and special consideration given. We feel that the Ml zone would
be mose appropriate and .compatible with the neighborhood. Mr. Whittaker explained
and showed some of the things they would be manufacturing.
Chuck Frost ask how it would affect the other half of the building, as I understand
the Development Workshop got the south 2/3 of the building. Do the other building
owners have any plans for manufacturing? Mr. Whittaker said he could not speak
f_or them, I have tried to make contact with Randall Porter, but have not been
able ,to make contact. My overall impression would be that Ml would not
detract from what plans they have for the building.
Gary Olsen ask if an instutional.zoning would be better. We are training and
working with adults, Mr. Whittalker told him. Looking through the instutional
zoning, the things that we would be doing was not allowed and we would have to
ge special use permits.
Chuck Frost said the community welcomes the Development Workshop. Mr. Whittaker
`~. • said, as he went through and compaired the C2 and Ml, it would give us more
flexibility to be zoned Ml.
Orrin Bates- He had been to the workshop ir. Idaho Falls a lot of times. We
have a lot people that could benifit from it.
Gary Olsen- Klingler Addition block 6 and % on 5th West. Much of this area
is not in compliance according to the present use. At one time Gerwin Bowen
received permission to have that zoned R3, I donut know tahat happened to it.
At the present there are two A Alex apartments and another apartment house
and it-would not meet the .zoning. He also questioned. the ne ordinance on
the number of units per acre. Chuck Frost told him. it was an error.
Robert Schwarts- He was interested in the hospital property. Chuck told
him the hospital would be at the meeting tomorrow night to make a presentation.
