Chuck Frost reviewed the minutes of the February 26, 1986 meeting.
A motion was made by Bob Purrington and seconded by Chris Mix to
approve the minutes. All Aye
Gordon Merdith was at the meeting to request putting a 4' x 8' sign for
his Sunbeam Daycare Center up above the concrete wall between P.O.D. and
the Kenneth Wagoner residence. He gave them a letter giving him premission
from. the Wagoners (attached).. Bob Purrington anal. Chuck Frost told him.
it could not legally be put on the residential side, it would have to
be on the commercial side. Mr. Merdith said he could not get permission from
P.O.D.'s to put-the sign on their side. They suggested that he arrange to
put it across the street in the commercial zone. Lf he put it on the
commercial property across. the. street or on P.O.D.'s property there would
be no problem. Chuck Frost stated that we need a sign Ordinance, ask the
city clerk to check on it.
Kristy & Rod Keller of 117 Webster Ave, was at the meeting to present a
petition requesting the property on Webster Ave, North First East, and
East First North (a portion of Block 34) be changed from commercial zone
to residential zone. They also submitted a letter explaining the reason for the
reques (attached.) Chuck Frost told them that the. policy. they had
adopted in the last meeting was that they would take the petitions as they
come in and include them as part of our master hearing.
Kenneth Hart of 367-Salem Ave was at the meeting to request building
a garage on his property. .The garage would be 20' x 30r to be built toward
the front of the lot. The houses on the side of the street are back on
the lots about 30' but he would like to put the garage out about 22'
from the curb which would not be in line with the homes, it would stick
out farther than_ the houses in the established line. It would be out.
about 9.' to 11'. Chuck Frost told him that. the Zoning Ordinance establishes
that front yards be uniform, and he would have to get a variance to do
this. The commettee discussed that it might be a problem if at a future date
that street might be widened. A motion was made by Chris Mix and seconded
by Dan Hess to table it fo the next meeting until the commettee have
a chance to view the property. All Aye.
It was decided that the next meeting. would. be at 6:30 P. M. on
Webdnesday May 21, instead of May 28 because of the Seminary Graduation.

Chuck Frost reported on a controversy with Dave Hannah at 125 North lst East •
who builds fireworks, and is oae o.f the two licensed fireworks fabricaters in
the State of Idaho. He makes fireworks, sets them off at ballgames-for
High School and College and at a number of functions. He has a license from
the Federal Department of 'TQbacco and Firearms. Ostia inspected him on the
same day the complaint came to the Planning & Zoning about him storing
fireworks in a shed behind hips house. At the sametime the Fire Marshall
went over to do an inspection. The Fire Marshall came up and talked to
Chuck about it. Dave has a p~s~rder magazine out in Hibbard, where a great
majority of his black powder is stored, but he does do some fabrication
on his premise. The report of the Fire Marshall is that he has less than
50 Ib of black powder at anyone time stored on premise, and his operation
met all regulations. They ~%d recommend that he do somemore grounding
of his person, so that stray sparks couldn't cause trouble when he was
in the assembly process. Tt~e conclusion we came to is if he keeps his
major items stored at his .magazine in Hibbard, less than 50 lbs of black
powder on premise and meets ail .applicable Ostia and Federal regulations
that there. probably isn`t :any problem in assembling fireworks on .p remise.
The finished product is stored out at Hibbard. It is more of a hobby.
The Fire Marshall said he would. submit a full report to the City Council.

To Whom It May Concern:
We, Kenneth and Laura Wagoner, of 270 West Main
Street, Rexburg, Idaho, owners and residents of the
afore noted property which is located just west of
the former P.O.D.'s Place, do hereby grant Gordon
Meredith, proprietor of the Sunbeam Daycare Center
and Preschool, permission to erect a 4' x 8' sign on
our property.
This sign is to be located in the southeast
corner of our property, next to and extending above
the. concrete wall that separates the two properties.
