A u~eetiny of the Planning & Zoning -for the City of Rexburg, Madison County, held February,
19B5, at the City Hall.
Present were the following:

Chuck Frost read the minutes of November 28, 1984, a motion was made by Bob Purri.rlgton and
seconded by Chris Mi to approve the minutes.. All Aye.
Dr. Heiner was at the meeting to make a proposal for a new office at 236 East Main. He
showed a mars showing the location of the building. He said he had not talked to an architect
yet but needed to know what margins he needed to have. Chuck Frost said that looking on the
map the current zoning for that piece of property is Rl, in order to put an office there h
would have to have a conditional use permit or a variance, or re-zone the property. Chuc
said if it were done it would have to be with. the same type of covenants. that was used whe
Or. Peterson put his office in. The City clerk told the committee that the Mayor. had said
that when Dr. Peterson put his office in he was not supposed to have parking in the front
but that Mayor Shirley had let him put the parking in front. Chuck told him that to re-zone
would be an advantage if he wanted to sell the property later on, with a variance there
would be some restrictions. Chuck Porter said that we need to consider if we re-zone to
also re-zone the property that Keith Grover owns that joins tY~e property.' Glen Pond said
that they should consider that six months ago we talked about spot zoning. Chuck Frost
stated that area was used for professional offices, and this would just extend it. Dr. Heiner
said that the lot is twice as big as the one Dr. Peterson is on, and a little bit smaller than
Dr. Workmans. If the zone was changed it would be a Cl Zone in the new ordinance and could be
R3 in the old ordinance.. The committee felt that it would be an improvement in the use of
the land. Dr. Heiner-said he did not have a preferance in a variance or to re-zone, he did
not expect to be selling the building. Chuck Frost told him that he needed. to get his.
architect to draw up a plot plan showing the limits of the property, haw the entrances would
come into the parking lot, how he intended to sight the building. on the land, and the parking
places. Design it according to R3 and bring it back for a variance.
Steve Clark was at the meeting. He and J.D. Hawkes would like to buy the property at 143
South lst East where the old John Bingham home was.. They had bought five homes that were at
Challis which had not been occupied after they were built. They had an option on the ground
pending an approval from the Planning and .Zoning. The property is 346 Feet deep, the front
is only about 72 feet wide,. but at 181 feet back it widens out another 50 feet, so there is
X24 feet in the back by 165 feet. They are nice three bedroom homes. They would use the
xisting home for a managers home. They would like to put two homes together on each sid e
and put one home on the one end. They would be duplex on a full foundation and a full
basement, with three bedroom apartments. When it is finished they would hold 120 students.
The garage would be altered. There would be 20 units. Chuck Frost told him, he would have
to figure out his parking, he would need 44 parking places. He was told he would have to
modify the homes to code for duplex, and there would have to be 10 feet between buildings.
Chuck Porter told him he would need a variance to cluster that many duplex on the property,
and if they altered the garages it would make them 4 plex. He would need 10,500 sq. f t. oe-
