A meeting of the Planning & Zoning of the City of Rexburg, Madison County, •
held December 14, 1983, at the City Hall.
Present were the following: Chairman: Chuck Frost
Members of the Board: Bab Purrington
Gerald Taylor

Also Present: Rose Bagley, City Clerk
Minutes of the August 23, 1983, meeting were discussed and a motion by Chris h1ix
and seconded by Gerald Taylor to approve the minutes.. All Aye.
The Planning Board discussed fences that have been built directly next to the
street. This is hazardous for students that walk to school, they-have to walk
in the road because there are no sidewalks and the fences go to the curb. This
is especially-true by the high school. They felt that it was a serious problem.
Jhere they are already existing it is a controversy. Chuck Frost asked the
city clerk to talk to the mayor about it. They felt it was an enforcement
problem.
The first item on the agenda was Ken Belnap with a request for a Dental Lab to
be built in the Professional Plaza. Steve Leavitt, a dental lab technician,
was at the meeting to represent Ken Belnap; drawings were passed .out. The
property in question is a piece of property they plan to buy from Doug Smith..
This runs directly behind Steve. Christensen's building. They want to know what
is allowed there and what is not allowed. The property is quite small and is
set up about 4 feet above the parking area, it is 66' x 40'. This would be strictly
a wholesaler to the dentists, there is no contact with the public. Chuck Frost
said that is zone Rl with a special variance in the middle for professional offices.
Chuck Frost told the group that we had asked the City. Attorney for an opinion on
the property. She said the property is specifically designed for professional
offices and it is not intended. in the variance for manufacturing. He said the
question is if they are providing a professional service or manufacturing. Chuck
said if this is treated as a professional office they would be required to .have
on the property in question two parking places plus one for each three ernployees, so
they would need three parking places; parking places are normally 10 x 15. If they
do not have this parking, they would. have to have an agreement to use parking nearby.
A motion was made by Bob Purrington to recommend to the city council that he be given
a variance to permit him to have a dental lab in the Professional Plaza with the
understanding that he meet the parking regulations and all other regulations in
this area and that it be used strictly for wholesale business and if it becomes a
retail business, it will not be permitted. Seconded. by Mary Lee Hill. All Aye.
The second item on the agenda was Karla Butler requesting to put a 1~eauty shop in
her home at 250 Melanie zoned R2. Karla said she had just moved there from the
Teton Basin where she had had a beauty shop in her home, and she owned all of the
equipment. She wants to put a shop in her- basement. She .has her cosmetology license
and wants only to work part time in the shop. She said she had parking for four •
cars, She would only have one customer at a time in the shop, and would not
employ anyone. She would run it herself. Chuck Frost said. it makes a difficult
situation because we have a lot of commercial property that we need to urilize in
the city. Bob Purrington said that when we make a variance for one, we open. it
for others and it gets out of hand. Chuck Porter said we need to be sure it would
meet the state requirements, and felt that. if she met these state requirements,
• and the neighbors agreed and she operated with only one customer at a time it
might be okay. She would also have to meet all zoning regulations. She was
advised to talk with the people within 300 feet of the property and get their
feeling and find out the costs and set back regulations and come back to the
next meeting.
Gary Olsen was next on the agenda requesting to put a business on the lot next to
Barnetts. The lot is 55' x 113 and is zoned commercial. He also wanted to know if
it was on the LID for parking. He was told it was. Chuck Frost told him the set
backs on commercial property is negotiable. It is recommended that they meet the
set backs of the neighbors. He said he would like to put a retail store in the
front and office spaces in the back and on a second floor. The Planning board
told him there would be no problem.
Next was David G. Sevy. He wants to put a musical instrument service center at
169 North 5th ',Jest, which is zoned R2. Mr. Sevy has~a shop in Idaho Falls. Later
he would like to employ 1 or 2 full-time college students besides his family.
Right now he and his family would run the shop. He would have one or two customers
at one time and most of them would be by appointment. He has room for parking on
the north side of his driveway 50 x 133. Chuck Porter said he thought it needed to
be rezoned to commercial or get another location zoned for it. Chuck Frost said
if it were rezoned to R3 customary office business would be allowed. Chris Mix
suggested that he could set up his business in conjunction with Bowen Music or
Rexburg P1usic and do the work at home. The Planning Board felt that he should get
the feeling of the neighbors within 300 feet and come back to the Planning P~ Zoning.
The Planning Board felt that people who move into neighborhoods and want to change
the neighborhood should check on what they can do in the neighborhood before they
move in.
The mayor had suggested that the Planning & Zoning make recommendations on a
Condominium Ordinance. It was tabled for the next meeting.
