February 23, 1983
• A meeting of the Planning and Zoning Committee for the City of Rexburg,
Madiosn County, held January_26,_1983, at the City Ha11.
Present were the following: Chairman: Chuck Frost
Councilman: Glen Pond
Committee: Gerald Taylor
Bob Purrington
Jim Flamm
Mary Lee Hill
Meeting ~.=as called to order by Chuck Frost.
A motion was made by Bob Purrington and seconded by Gerald Taylor tc
approve the minutes. A11 Aye. _
Chucl, Frost told the committee that the only_ item on the agenda was
Robert Farmsworth who wants to convert some existing apartments into
condominiums. Mr. Farmsworth showed the committee plans for preliminary
plat. The apartments were purchased from Carol Walker, there are two
four-plex apartments. The name of the apartments is Glenbrook Apartments
at 235 & 248 South 3rd West, Chuck said as far as he knew there was no
applicable. law in F.exburg for conversion.
Mr. Farmsworth said that Carol Walker told him she had orginally built
them as condominiums and because of the economy was down they rented
• them. They were built about 32 years ago. He said his idea was to sell
as few as he could, he said he may sell two.and he may sell four. He
said the drawings that he was presenting was done as a preliminary plat,
and they were going to hire Forsgren Perkins to do a final plat. He said
the units were all two bedroom, there is one garage for each unit and
there is adequate parking. He said there was one item that would appear
to have needed a variance, which is there is a deck that extends out
farther than the five fbet from the property line, it is over a concrete
deck; hooaever Mrs. Walker said th.e city had inspected it and approved it.
Mr. Farmsworth said he would offer to the current tenants first chance
to buy and at extremely good terms. He has no intention of evicting
anyone. Jim Flamm questioned Mr. Farmsworth about his wanting to sell
a limited number of the, and why he did not want to sell them alJ_. Mr.
Farmsworth said he wanted to retain the ones he did not sell as condominiums
and rent them out as income for his kids going to college.
Chuck Frost said the deck that Mr. Farmsworth merLtioned apparently was
passed by the city building inspector. It apparently does not meet
with the set backs according to the zoning regulations, but he did not
think it Boas a serious problem.
Chuck said if it is going to be platted in order to sell it, it could be
handled just like a small sub-division, with a preliminary plat and then
when he comes back and is ready to sell it with a final plat and then it
will be taken through the regular procedures. He was advised to complete
the check off list given him for sub-divisions.

A motion teas made by Bob Purrington to except this preliminary plat as •
drawn as a sub-division with the restrictive covenants as proposed and
except the building as it is constructed, .and that it be referred to
the city council to proceed with ..the advertising and final plat.
Seconded by Mary Lee Hill. Unanimously Carried.
T~1r. Farmswort'n said he would take the restrictive covenants to a local
attorney to see if they conform.
